Little White Lies in Jewish Lawy
Little White Lies in Jewish Lawy
1
A Perspective from the Jewish Tradition
6. You shall not pervert the judgment of your poor man in his lawsuit.
7. Distance yourself from a false matter; and do not kill a truly innocent
person or one who has been declared innocent, for I will not vindicate a guilty
person. 8. You shall not accept a bribe, for a bribe will blind the clear sighted
and corrupt words that are right.
From untruths – this is speaking to the dayan, rabbinical court judge, he should
not adjudicate the case falsely. And you should not execute a righteous
guiltless person…if you know that he has behaved wickedly in some other
matter, do not say "since he has committed another serious offense, I will
execute him and take the stumbling block away from (society) - because I (G-d)
will exact judgment from him, and he will not escape my (justice)."
The root of this mitzvah is well known: כי השקר נתעב,שורש המצוה ידוע

11. Now Abraham and Sarah were old, coming on in years; Sarah had
ceased to have the way of the women. 12. And Sarah laughed within
herself, saying, "After I have become worn out, will I have smooth
flesh? And also, my master is old." 13. And the Lord said to Abraham,
"Why did Sarah laugh, saying, 'Is it really true that I will give birth,
although I am old?' 14. Is anything hidden from the Lord? At the
appointed time, I will return to you, at this time next year and Sarah will
have a son."
What did Sarah say – and how was her reaction conveyed to Avraham?

The Maharal of Prague explains that G-d really did "change" the story: Sarah seemed
to doubt if both hurdles could be overcome – her age and the age of her husband; when
Hashem reports the incident to Avraham, His omission implies that she even felt one
hurdle could not be miraculously overcome!

What happens if you’re asked how your host was?
The general prohibition against lying is derived from the
7
commandment to follow the ways of God [as our rabbis teach: we
must emulate Him] just as He is merciful, you too must be merciful …
This applies to the trait of honesty. Since the seal of God is truth, we
must try to emulate God and only speak the truth. However, there are
times when other good traits conflict, such as a conflict between the
trait of honesty and the trait of humility. We must choose one trait
over the other. Class notes of Rabbi Joseph B. Soloveitchik’s Talmud
lectures on Sh’vuot 31a,

Why did the Gemara not cite here that it is permissible to fib for the
sake of peace?......(the answer is) that these, too are for the sake of peace,
and are more common than other cases. That's why they were chosen
here.
What is truth and what is falsehood? When we went
to school we were taught that truth is to tell facts as ,הוא כשמספרים עובדות כמו שאירעו; ושקר
they occurred and falsehood is to deviate from this.
This is true in simple cases, but in life many .

Sometimes it may be wrong to “tell the truth” about

cases what appears to be true is false, since it
produces evil effects; and what appears to be false

Hillel said, be one of the students of Aharon, love peace and pursue
peace, love people and bring them closer to Torah
Avot d'R. Nattan explains: How did Aharon exhibit a love of peace?
When he saw two people arguing, he would approach each one without
the other's knowledge – and say: "See, your friend really regrets what he
did and is feeling badly that he wronged you, and he asked me to come
to you to forgive him." When the two would later meet each other they
would kiss each other.

How would he bring people closer to Torah? When he knew that a particular person
had done a transgression, he would befriend him.. this person would then be
embarrassed, and would say to himself, "If this Tzaddik knew of my wicked deeds,
he would stay away from me!" and through this, he would go back on the right path.
This is what the prophet Malachi (Ch. 2) attested to when he said, "He went with Me
in peace …and (thus) prompted many people to return from sin.."
