II. MATTERS INVESTAGATED

5. To determine the facts and circumstances surrounding the
stabbing incident which resulted to frustrated murder of Mr. Rodrigues Medina Cruz in
front of Rizal Elementary school, Barangay San Francisco, Panabo City Davao Del
Norte on January 25, 2022 at around 7:00 pm in the evening which the suspects
fugitively ran from the crime scene of their action; and,
6. To Determine the criminal liabilities of the person involved, and
whether they are culpable of the offense as charged

III. FCTS OF THE CASE

7. That on about 7:00 pm in the evening of April 25, 2022, a

stabbing incident took place at in front of Rizal Elementary school, Barangay San
Fransico, Panabo City Davao Del Norte. The incident was reported by ELRIC Y
DAMON, 22 years old, single and a resident of PUROK 16, LUV MI HOMES SUB. NEW
VISAYAS, PANABO CITY in front of Rizal Elementary school at the dark corner Mr.
JAYSON REYES after passing of Mr. RODRIGUES MEDINA CRUZ in corner he was
stab by Mr. Jayson Reyes after the stabbing incident immediately caught by the concern
citizen. (Police Report dated A, January 25, 2022 hereto attached as Tab “C” and its
extract copy hereto attached as Tab “D” respectively).

8. Upon receipt of the report, the elements of this station led by MIKO
MONTILDE, were dispatched to the said area of incident to conduct ocular investigation
(Spot Report dated January 25,2022 A hereto attached as Tab “E”).

9. Investigation conducted disclosed that the suspects were identified as

JAYSON REYES, 24 years old and a resident of New Pandan, Panabo City, were
revealed through the aid of the CCTV footage and were verified by a witness who
requested to hide his identity, who saw the suspects. While RODRIGUES MEDINA was
walking alone in front of Rizal Elementary School Barangay San Francisco, Panabo
City, He immediately runs away from the crime scene. In addition, we didn’t recover
knife from the scene. Further, the knife that used in the crime. RODRIGUES MEDINA
was brought to Rivera Medical Hospital, Barangay San Francisco, Panabo City. On
January 25,2022, on or about 8:30 o’clock in the evening, the office received
information from an informant that the suspects were last seen around the residence of
on JAYSON REYES or about 2000h. After receiving the tip, the station commander
JUANILLO directed response to the said location to arrest the suspects. Upon arrival to
the area, the suspects were seen In front of the school, sitting and having a
conversation. The arresting officers immediately came to them and informed them the
nature of arrest and further their constitutional rights, wherein they submitted
themselves peacefully. Moreover, the knife was recovered by JAYSON REYES.

the Crime Scene hereto attached as Tab “G”, and Photographs of the Evidences hereto
attached as Tab” H”).

10. In the sworn statement of BLER BATAC, a passer-by who witnessed the incident
stated that the he was on his way home after buying school supplies for his daughter
when he heard successive shouting. He immediately turned to
where he heard shouting and saw JAYSON REYES running which he was aiming their
knife to. After that, he flew from the area of incident, which was in front of the Rizal
Elementary School, Panabo City, towards Cagangohan (Affidavit BLER BATAC
attached as Tab “I”).

11. In the sworn statement of DARYL ZITA, also a passer-by who witnessed the
incident stated that while she was driving her car Rizal Elementary School, she saw
JAYSON REYES walking towards to RODRIGUES MEDINA and the people around the
area and also causing for him. were JAYSON REYES pointing a knife to the
RODRIGUES MEDINA at In front Rizal Elementary School. (Affidavit of DARYL ZITA
hereto attached as Tab “J”).

12. In the joint affidavit of arrest of PMSG Lester Sososco, PMSG Manuel Santos Baso,
PMSG Rey Kyle Yorong, PSMSG Antonio Luna and PSMSG John Mosquida police
officers of Police Station Office, they asserted that on January 25, 2022 at around
8:30pm o’clock in the evening, they were directed by the chief of police to effect the
arrest on the suspects upon receiving a tip from an informant that the suspects were
seen around the residence of JAYSON REYES, New Padan, Panabo City. The
operatives immediately proceeded to the above mentioned location to arrest the
suspects who were responsible for stabbing of Rodrigues Medina Cruz and for causing
injury. Thereupon the arrival in the said location, the suspects were informed of the
reason of their arrest and further their constitutional rights wherein they submitted
themselves peacefully and was brought to station for proper disposition of action and
investigation (Joint Affidavit of Arrest of PMSG Millan Apostol, PMSG Lester Sososco,
Manuel Santos Baal, PSMSG Manuel Santos Baso and PSMSG John Mosquida hereto
attached as Tab “K”).

13. Based on the Medical Certificate issued by the Office of the Civil Registrar General
in Panabo City, the victim, Rodrigues Medina sustained four (3)stab wounds on his left
chest that caused excessive bleeding which instantaneously hereto attached as Tab
“L”)., based on the Medical Certificate issued by her attending physician in Southern
Philippines Rivera Medical Center , Panabo City, that the herein victim has sustained
multiple stab wounds which caused paralysis to his facial nerves, jawbone fracture, and
fracture in the distal 3rd of the 2nd metacarpal bone in her left index finger which
resulted to paralysis. (Medical Certificate hereto attached as Tab “M”).

IV. DISCUSSION:
14. In this instant case under investigation, the herein victims were stab by the suspects
using a knife. The suspects fled afar from the scene of the crime for the reason that they
may be afraid to get caught by the authorities and avoided the accountability of their
actions for purposely killing Jayson Reyes and for the serious physical injuries attained
by another victim, Rodrigues Medina. The motive of stabbing was because of jealousy
since the victim Rodrigues Medina was once the girlfriend of one of the suspects,
Further, not a month later after their separation, Rodrigues Medina who was a rich
business tycoon and that they were live-in partners. The suspects showed no remorse
after committing the offense. It was evident that the offense was premeditated because
they already know the whereabouts of the victims at that day and chose a place where
they can easily run away from the scene. Further, they also caused serious harm to
others and may give trauma to the victims and to their families.
V. CONCLUSION:
15. After a careful perusal surrounding this particular incident based on the evidences
presented on hand, the investigation conducted, finds probable cause exists that the
herein suspects, namely: JAYSON REYES, are criminally liable and be charged for
MURDER AND SERIOUS PHYSICAL INJURY.

VI. RECOMMENDATION:
16. WHEREFORE, in view of the foregoing undersigned respectfully recommends that
the case of FRUSTRATED MURDER penalized under Article 7659 and SERIOUS
PHYSICAL INJURIES penalized under Article 263 (3) of the Revised Penal Code, be
filed against JAYSON REYES, respectively at the Prosecutor’s Office.

01. Q – Mr. ELRIC DAMON, why are you here in the office of the chief of police?
A – I am here in order to give my statement on the stabbing incident that
transpired wherein I am one of the victims and witnessed the incident.
02. Q – can you please name the victim involved in this Stabbing incident?
A- RODRIGUES MEDINA.
03. Q – When and where did the incident happen?
A – The incident happened along the Rizal Elementary School, Panabo City
particularly in front of the Rizal Elementary School.
04. Q – Will you please narrate the whole incident?
A – At this date, on or about 8:00 o’clock in the afternoon along Rizal
Elementary School Panabo City and upon arrival in front of the Rizal Elementary
School I heard shouting outside. We were not able to identify the suspects
because after stabbing Rodrigues Medina the suspect running away from the
crime scene.
05. Q – Then what happened afterwards?
A – There were a lot of people in the area of incident and were able to call
for help since concern citizen. After almost thirty minutes, police officers and the
ambulance also came was hurriedly brought to the nearest hospital.

City, Davao Del Norte, personally appeared in this
office and reported a stabbing incident. Around
1900H January 25, 2022. Along the street of Rizal
Elementary School a stabbing incident transpired
where in victim identified as one RODRIGUES
MEDINA CRUZ, 21 years old, single, student, a
native of Panabo City presently residing at Brgy
San Francisco Panabo City was stabbed by the
suspect identified as one JAYSON REYES aka
‘JR, 24 years old, Single Laborer native of Brgy
New Pandan, Panabo City. While the victim was
walking along the Rizal Elementary School Street
at the side of the gas station. Suddenly he noticed
JAYSON REYES following him, when he reached
the corner street. JAYSON REYES blocked the
way of RODRIGUES Y CRUZ and said “HOY
BAKIT ANG ANGAS NANG TINGIN MO SAKIN!”
After has words, he got his knife to his bag and
stabbed RODRIGUES MEDINA CRUZ three
times that caused him fell to the ground, JAYSON
REYES immediately escaped the place after the
incident but he immediately caught by the concern
citizens. The tricycle drivers of the place
immediately helped the victim and sent to the
Rivera Medical Hospital, that caused him to
survive from the death. Case referred to the
investigation section for appropriate action. For
record and future reference.

That we, PMSG Lester Sososco, PMSG Manuel Santos Baso, PMSG Rey Kyle Yorong,
PSMSG Antonio Luna and PSMSG Johnrey Mosquida of legal ages, bonafide members
of the Philippine National Police and are currently assigned in Police Station, Panabo
City after having been duly sworn to in accordance with law, do hereby depose and say:

1. That on January 25, 2022 at around 2000H, our office received information from an
informant that the identified suspects of the stabbing incident at Rizal Elementary
School Panabo City.

2. That upon receiving the given tip, our station commander PMAJ KARL Y. BATAC
ALVAREZ directed response to the said area to verify the veracity of the information
provided by the informant;

3. That upon arrival to the said location, we confirmed by ourselves that the suspects
JAYSON REYES, were on sight and were having a conversation outside the door of the
house of one of the suspects being identified as one JAYSON REYES at New Pandan,
Panabo City:

4. That we, PMSG Lester Sososco, PMSG Manuel Santos Baso, PMSG Kyle Yorong,
PSMSG Antonio Luna and PSMSG Johnrey Mosquida, immediately proceeded to the
said house of where the suspects are. Thereupon the arrival in front of the house of one
of the suspects, JAYSON REYES, we informed them the reason of the arrest and
further their constitutional rights wherein they submitted themselves peacefully;

5. That the arrested suspects were immediately brought to the station for further
investigation and appropriate action;

6. That we executed this affidavit to verify the authenticity of the above mentioned facts
and to support the filling for appropriate charges in the court against the arrested
suspects.

THIS IS TO CERTIFY that RODRIGUES MEDINA of Brgy. San Francisco, Panabo

City has undergone a wound exploration on her cervical AP/L and an operation for
treatment in her hand APOL due to multiple stab wounds on January 25, 2022 with the
following diagnosis:

Multiple Stab wounds: POEN 1. Left Preauricular Area POEX: None; POEN 2; 2nd
Interferential Space POEX: 1s Interferential Space; facial nerve paresis, left (House-
Brakeman IV), fracture on the jawbone secondary to gunshot injury; HAND APOL;
fracture in the distal 3 rd. of the 2nd metacarpal bone (loss of use thereof).
THAT, the operation conducted was the debridement of her left body, application of an
opaque external fixation device on the left body index finger, and wound exploration on
the neck (left).
THAT, follow up check-ups and therapy for her facial nerve paresis will be conducted for
3 months. The healing time for her fractured bone is estimated to be 6 to 9 months.
Further, the fracture in the distal 3rd of the 2nd metacarpal bone would need medical
attention for a month barring complication.
