Dear Sirs,

We are pleased to inform you that, pursuant to the relevant provisions of the CONTRACT, we have, as
we consider, completed the whole of the PERMANENT WORKS according to the CONTRACT, and that,
the PERMANENT WORKS are now ready for the tests and/or inspections by you, the CLIENT and/or the
authorities concerned.

We hereby request you to carry out and/or arrange to carry out in due course such tests and/or inspections
as specified in the CONTRACT and as may be required by laws, etc. We hereby apply to you for issue of
the Certificate of COMPLETION OF WORKS upon successful completion of the said tests and inspections
and upon your confirmation and recognition of the compliance of the PERMANENT WORKS with each
and every requirement called for under the CONTRACT.

The list of Remaining Minor Works is attached hereto, which Works we assure will be all completed on
or before April 2014. We are aware of the provision of the second Paragraph, Subclause (4), Clause 6.2
"COMPLETION OF WORKS" of the GENERAL TERMS AND CONDITIONS and, in the event if we fail
to complete all the remaining works by the aforementioned date, we shall make no objection to your
decision that you may according to the said provision make with regard to the date of COMPLETION OF
WORKS.
 We shall, as provided for in the CONTRACT and as per your instructions to be given, deal with and do
whatsoever work to your satisfaction concerning any and all of the Punch List Items that you may point out
to us in the course of the said tests and/or inspections, should there be any such item.

The CONTRACTOR hereby confirms and assures that he shall complete to the satisfaction of Toyo all
the above listed Remaining Minor Works respectively by the above-mentioned dates set down for
completion, and duly understands and accepts that the Certificate of COMPLETION OF WORKS is
issued under such conditions as aforementioned and that, in the event of the CONTRACTOR's failure
of so doing, the validity of the Certificate of COMPLETION OF WORKS may be suspended and the
date thereof may be carried over to the date on which all the Remaining Minor Works are completed
according to the CONTRACT.
