‫ت أ َ ْع َما َلنَا‬ َ ‫س َيئَا‬ َ ‫َو‬

‫ض َل ْل‬ َ ‫َّللاُ فَالَ ُم‬ َّ ‫َم ْن يَ ْه َد َه‬

‫أ َ ْش َه ُد أ َ ْن الَ اَلَهَ اَالَّ هللاُ َو ْح َدهُ َالش ََري َْك لَهُ‪،‬‬
‫س ُن نَ َديًّا‪.‬‬ ‫ش َها َدة َ َم ْن ُه َو َخي ٌْر َّمقَا ًما َوأ َ ْح َ‬ ‫َ‬
‫س ْولُهُ‬ ‫ع ْب ُدهُ َو َر ُ‬ ‫س َي َدنَا م َح َّمدًا َ‬ ‫َوأ َ ْش َه ُد أ َ َّن َ‬

‫علَى‬ ‫س ْوالً نَ َبيًّا‪َ ،‬و َ‬ ‫ان َر ُ‬ ‫صادَقَ ْال َو ْع َد َو َك َ‬ ‫َ‬
‫ص ْح َب َه الَّ َذي َْن يُ ْح َسنُ ْو َن َإ ْسالَ َم ُه ْم َولَ ْم‬‫آ َل َه َو َ‬
‫ش ْيئًا فَ َريًّا‪،‬‬ ‫يَ ْفعَلُ ْوا َ‬
‫اض ُر ْو َن َر َح َم ُك ُم‬ ‫أ َ َّما بَ ْعدُ‪ ،‬فَيَا أَيُّ َها ْال َح َ‬
‫ص ْي َن ْي نَ ْف َس ْي َو َإيَّا ُك ْم َبت َ ْق َوى َ‬
‫هللا‪،‬‬ ‫هللاُ‪ ،‬ا ُ ْو َ‬
‫‪.‬فَقَ ْد فَازَ ْال ُمتَّقُ ْو َن‬
‫قَا َل هللاُ تَعَالَى ‪:‬‬
‫ض َج َم ْيعًا‬ َ ‫ي َخلَقَ لَ ُك ْم َّما َفى ْاالَ ْر‬ ْ ‫ُه َو الَّ َذ‬
‫س ْب َع‬ َّ
‫ن‬
َ ُ ّٰ َ‫ه‬ ‫ى‬ ‫و‬ ‫س‬ َ ‫ف‬ ‫ء‬
َ ۤ
‫ا‬ َّ ‫ث ُ َّم ا ْست َ ٰٓوى َالَى ال‬
‫س َم‬
‫ع َل ْي ٌم‬
َ ‫ش ْي ٍء‬ َ ‫ت ۗ َو ُه َو َب ُك َل‬ٍ ‫سمو‬ َ
(Surah al-Baqarah [2]: 29)

Alhamdulillah, all praise belongs to Allah who has given us all the
blessings and bounties. The Most Ruler, Most Just, and Most
Righteous. Shalawat and salaam may always be poured out to the
lord of nature the Prophet sallallaahu 'alaihi wa sallam.

Indeed, the form of gratitude for the servant who has been given
so many blessings, there is nothing but obedience and obedience
to Him. Carry out His commands and stay away from His
prohibitions.

In the midst of a hard life, after two years of being hit by the Covid-
19 pandemic, the burden has now increased again. The price of
fuel oil (BBM) rose again. No need for a lot of theory, it is certain
that the price of goods will rise. The costs will add up. Who is the
victim? Are Officials, people's representatives, or conglomerates?
No, they are not. It is the people who suffer. Which in fact most of
them are Muslims. This is an unjust policy.

ou know, as a perfect religion, Islam also regulates this matter.
Based on the provisions of Islamic law, fuel, energy and other
natural resources that control the livelihood of many people
essentially belong to the people. This is based on a number of
hadiths. Among them is the history of Ibn 'Abbas radhiyallahu
'anhu who said that the Prophet sallallaahu 'alaihi wa sallam, once
said:

َ ‫ث فَى ْال َم‬


‫اء‬ ٍ َ‫ش َر َكا ُء فَى ثَال‬ ُ ‫ون‬ َ ‫ْال ُم ْس َل ُم‬
‫ار َوث َ َمنُهُ َح َرا ٌم‬
َ َّ ‫ن‬ ‫ال‬‫و‬َ ‫إل‬
َ َ
‫ك‬ ْ
‫ال‬‫َو‬
Muslims associate (have equal rights) in three matters: water,
pasture and fire. The price is haram (Narrated by Ibn Majah and ath-
Thabrani).

Based on this hadith, these three types of natural resources are


public property. However, its status as public property is based on
its nature, namely as goods needed by society in general (As-
Siyaasah al-Iqtishadiyah al-Mutslaa, p. 67).
So from the hadith it can be extracted the rule of law:

َ ً‫َم ْل َكيَّة‬
ً‫عا َمة‬
Every object (natural resource) that is part of the needs of the wider
community is public property (An-Nabhani, Asy-Syakhshiyyah al-
Islamiyyah, 3/466).

Thus not only water, fire and pasture. All natural resources that are
needed by the community at large (min maraafiq al-jamaa'ah) are
public property (An-Nabhani, An-Nizhaam al-Iqtishaadi, p. 201).

The reason is that the Prophet sallallaahu 'alaihi wa sallam once


gave control of the water in Taif and Khaibar to someone. The
water is not a place to depend on the community. This fact shows
that the prohibition on the possession of the three types of goods
in the above hadith contains 'illat. The illat is that the item is min
maraafiq al-jamaa'ah (community needs). In the rules of usul it is
stated:

َ ‫ا َ ْل َعلَّةُ تَد ُْو ُر َم َع ْال َم ْعلُ ْو َل ُو ُج ْودا ً َو‬


ً ‫ع َدما‬
The presence or absence of law depends on its 'illat.
Based on this rule, everything categorized as goods needed by the
public (min maraafiq al-jama'ah) is public property. Not only water,
meadows and fire. This includes fuel, energy and others.

Fuel oil and other energy (which has abundant deposits) as public
property is also included in the discussion of the hadith about
mining goods from the history of Abyadh bin Hammal radhiyallahu
'anhu.

‫سو َل‬ ُ ‫ض ب َْن َح َّما ٍل أَنَّهُ َوفَ َد َإلَى َر‬ َ َ‫ع ْن أ َ ْبي‬ َ
َ ‫ فَا ْست َ ْق‬-‫صلى هللا عليه وسلم‬- ‫َّللا‬
ُ‫َطعَه‬ َ َّ
‫َط َع لَهُ فَلَ َّما أ َ ْن َولَّى قَا َل َر ُج ٌل َم َن‬ َ َ‫ْال َم ْل َح فَق‬
‫ت‬ َ ‫َط ْع‬َ َ‫ت لَهُ َإنَّ َما ق‬ َ َ‫ْال َم ْج َل َس أَت َ ْد َرى َما ق‬
َ ‫َط ْع‬
ُ‫عهُ َم ْنه‬َ َ‫ قَا َل فَا ْنتَز‬.‫لَهُ ْال َما َء ْال َع َّد‬
From Abyadh bin Hammal: He once came to the Prophet sallallaahu
'alaihi wa sallam and asked him to give him a salt mine. He also gave
the mine to himself. When Abyadh bin Hamal radhiyallahu 'anhu had
left, a man in the assembly said to the Prophet sallallaahu 'alaihi wa
sallam, "Do you know what you have given him? Indeed you have
given him something like flowing water (al-maa' al-'idd)." Ibn al-
Mutawakkil said, "Then the Prophet sallallaahu 'alaihi wa sallam
withdrew the gift of the salt mine from him (Abyadh bin Hammal)."
(Narrated by Abu Dawud and at-Tirmidhi).

This hadith is maqbuul with many ways (katsrah ath-thuruq)


because it meets the minimum requirements as a hasan hadith
(Tuhfah al-Ahwadzi, 4/9).

This hadith is a proof that mining goods with abundant deposits


are public property. It should not be owned by individuals (Abdul
Qadim Zallum, Al-Amwal, pp. 54-56).

This applies not only to salt, as in the hadith above, but also to all
minerals.

Therefore, in the view of Islam, the ruler must give access to these
common properties to all his people, whether poor or rich.
Therefore, the Government's claim that the fuel subsidy has been
mistargeted because it is mostly enjoyed by the rich is a reason
that contradicts this sharia provision. This is because rich or poor
have the same right to enjoy all natural resources belonging to the
public (which control the livelihood of many people).
This public property is managed by the state for the public
interest. The state may give it to the people for free or set a low
price with the results returned to the people. This is because the
state only represents the people to manage these goods.

It is clear that the Government's policy to increase fuel prices,
whatever the reason, must be rejected! There are provisions of the
Shari'a that are violated. Supposedly, the government is obliged to
manage fuel and energy—as well as all natural resources
belonging to the people—in accordance with sharia provisions. Is
it possible? It seems impossible as long as this country implements
a capitalist-secular-liberal system.

This is among the rational reasons why this country should be


governed by Islamic sharia, and discard the liberal-capitalism
system. Only with the kaffah application of Islamic sharia, our lives
will be blessed, benefit, and get the pleasure of Allah subhanahu
wa ta'ala. []
