CONTRACT OF SERVICE

KNOW ALL MEN BY THESE PRESENTS:

This Contract made and entered by and between:

The Department of Education, Division of Palawan, a government agency with the office address
at PEO Road, Bancao-Bancao, Puerto Princesa City, represented by ROGER F. CAPA, CESO VI,
hereinafter referred to as “First Party”;

- And -

<NAME OF PERSON TO BE HIRED>, of legal age, <single/married/widow/widower>,

Filipino and a resident of <TYPE ADDRESS OF PERSON TO BE HIRED>, hereinafter
referred to as the “Second Party”;

1. That the First Party, in the exigency of the service, engages the services of the Second Party
who shall perform work that cannot be performed by the present number of the regular
personnel of the First Party.

2. That the Second Party has signified her intention, to which the First Party has accepted, to
provide the services needed by the latter, subject to the terms and conditions of this contract;

3. That the Second Party hereby possesses the experience and skills required to perform the job
as described herein;

4. That the Second Party hereby attests that she is not related within the third degree of
consanguinity of affinity to the hiring authority and / or the representative of the First Party;
that she has not been previously dismissed from government service by reason of an
administrative offense; and that she has not already reached the compulsory retirement age of
sixty five (65);

5. That in view hereof, the Second Party is hereby contracted from <duration which shall not be
longer than 1 year>, in consideration of the monthly rate of <amount based on the prevailing
market rates, subject to the provisions of RA 9184 and its Implementing Rules and
Regulations> to be paid every < on regular basis with an interval of at least once a month>

6. That the Second Party shall serve as an <POSITION> and to perform the following task at
<Place of Station>:

7. That the Second Party shall perform work at a time and schedule to be agreed upon by both
parties;

8. That it is understood that this contract does not create an employer-employee relationship
between the First Party and the Second Party; that the services of the contract of service are not
covered by Civil Service law rules thus, not considered and not creditable as government service;
and that the latter is not entitled to benefits enjoyed by the regular personnel of the First Party;
9. That it is expressly understood between the parties that the Second Party is an independent
contractor, and that he/she is not authorized to make any contract, agreement, warranty, or
representation on behalf of the First Party or create any obligation, express or implied, on its
behalf;

10. That to ensure protection of the existing Contract of Service workers, the latter shall be given
priority in the appointment by the agency to its vacant positions provided that the worker meet
the appropriate eligibility and other qualification requirements for the position subject to existing
Civil Service law and rules;

11. That any dispute under this Contract shall be settled by the First Party, and its decision shall
be final.

12. That the Second Party acknowledges and agrees that he/she voluntarily undertakes this
assignment with the knowledge of the risks and dangers to which he/she may be exposed and
that he/she freely and explicitly assumes all such risks and personal responsibility for his/her
safety and security;

13. The Second Party further explicitly agrees that neither he/she, his/her dependents,
representatives, heirs or assigns shall bring any legal claim or action against the First Party or
any member of its permanent or contract staff as a result of any illness, injury, or other physical
or mental trauma sustained in the course of providing his/her services;

14. That this contract shall cease to be in force and effect in the event of unsatisfactory work
performance by the Second Party; for other just and valid as may be determined by the First
Party or as may be provided by law; or upon written notice by either party, provided that the
party terminating the contract shall ensure that the notice shall be received by the other party at
least fifteen (15) days prior to the termination hereof. Upon receipt of the notice of termination,
the Second Party must immediately cease further work and will be compensated only for work
undertaken until the issuance of the notice of termination.
