This Judicial Affidavit is taken at Acosta Law Office, 25 Mabini Street,

Oroquieta City on October 13, 2021 at 10:00 o’clock in the morning by ATTY.
MAXRIO LOUEL R. SIMBAJON.

AMENDED JUDICIAL AFFIDAVIT

1. Question: Unsa nga pinulungan ang imong gusto sa pagkuha niini nga
affidavit? (In what language do you want this affidavit taken?)
Answer: Binisaya. (Visayan.)

2. Q: Manumpa ka ba nga magsulti ka sa matood ug sa matood lamang? (Do

you swear to tell the truth and nothing but the truth?)
A: Oo, manumpa ako. (I swear.)

3. Q: Kahibalo ba ka nga kung dili ka magsulti sa tinood makasuhan ka ug

perjury or false testimony? (Are you aware that if you will not tell the
truth you can be criminally liable for perjury or false testimony?)
A: Oo, Kahibalo ko. (Yes, I am aware.)
4. Q: Isulti imong ngalan, edad, trabaho ug address? (State your name, age,
occupation and address.)
A: ROBERT JORULAN BAID, 54 ang panuigon, construction worker ug
nagpuyo sa Purok 1, Casul,Sapang Dalaga, Misamis Occidental. (ROBERT
JORULAN BAID, 54, construction worker and a resident of Purok 1,
Casul,Sapang Dalaga, Misamis Occidental.)

5. Q: Nganong nia man ka dinhi karon? (Why are you here?)

A: Aron sa paghatag sa akong testimonya isip rebuttal witness nga
nagpmatood nga ako isa sa sumusunod ni Vicente Baid ug usa sa tag-iya sa
yuta nga gi-angkon sa mga sinumbong. (In order to testify that I am one of
the heirs of Vicente Baid and one of the co-owners of the land.)

6. Q: Tig-unsa nimo ni si Vicente Baid? (How are you related to Vicente

Baid?)
A: Siya maoy amahan sa akong apohan nga si Roque Ajeas Baid, mahulog
na nako siya nga apohan sa tuhod. (He was the father of my grandfather,
Roque Ajeas Baid, which make him my great grandfather.

7. Q. Sa imong nahibaw-an kanus-a mani namatay si Vicente Baid? (When

did Vicente died, if you know?)
A: Namatay si Vicente Baid adtong Enero 16, 1949. (Vicente Baid died in
January 16, 1949).

8. Q: Kinsa ni Cristina Ajeas? (Who is this Cristina Ajeas?)

A: Asawa ni siya ni Vicente Baid, og akong Lola na sa tuhod kay inahan
man na sya sa akong apohan nga si Roque Baid. (She is the wife of Vicente
Baid, which makes her my great grandmother, and she is also the
mother of my grandfather, Roque Baid.)

9. Q: Matud pa sa mga sinumbong nga gibaligya kuno na nga yuta nila sa

imong apohan sa tuhod nga si Cristina?(According to the defendants this
land was sold to the predecessor-in-interest of the defendants by your
great grandmother Cristina?)
A: Wala ko kabalo, pero akong nahibaloan kini nga yuta kay gipanunod na
sa akong apohan nga si Roque Baid, uban sa iyang mga igsoon gikan sa
ilang amahan nga si Vicente Baid. (I have no knowledge about it, but
what I know is that my grandfather, Roque Baid have inherited the
subject land with the other heirs from Vicente Baid.)
 10.Q: Sa pagka-karon duna bay sumusunod ni Vicente Baid nga nagpuyo sa
yuta? (At present are there any heirs of Vicente Baid residing on the
land?)
A: Oo. (Yes.)

11. Q: Kinsa mani sila? (Who are they?)

A: Akong inahan si Beatrice Jorulan-Baid, alias “Bating”, akong mga
igsson sila Elizabeth Baid ug si Santander Baid alias “Adoy”, akong ig-agaw
nga apo ni Celedonia Ajeas (anak ni Vicente Baid), si Alredo Pelayre Jr, og
akong uyoan nga si Eddie Baid Lamoste. (They are my mother Beatrice
Jorulan-Baid, alias “Bating”, and my siblings Elizabeth Baid and
Santander Baid, alias “Adoy”, and my cousin, Alredo Pelayre Jr, who is
the grandchild of Celedonia, the daughter of Vicente Baid, and my uncle,
Eddie Baid Lamoste.)

12.Q: Aduna ko mga litrato dri, palihug ko tan-aw dayun sultihi ko unsa ni
sila? (I have photos here, kindly look over them and tell me what they
are?)
A: (Affiant looked over the photos.) Litrato ni sila sa mga balay sa akong
inahan og mga igsoon, sila Elizabeth og Santander, og akong ig-agaw og uyoan
nga sila Alfredo Pelayre Jr, og si Eddie Baid Lamoste. (These photos shows the
respective houses of my mother and my siblings, Elizabeth and Santander, my
cousin and my uncle Alfredo Pelayre Jr. and Eddie Baid Lamoste,
correspondingly, hereto attached and collectively marked as Exhibits “U”.)

13. Q: Aduna pa lain mga litrato dri, unsa man ni sila? (There are other
photos here, what does these photos show?)
A: Mao ni sila litrato nga diin ngpakita sa puloy-anan nilang Dante Gaco
og kang Yenyen Gaco nga anak ni Dante Gaco, nga kini ila puloy-anan
nasulod sa gihisgutang yuta nga panag-iya ni Vicente Baid. (These are the
photos showing the houses of Dante Gaco and that of Yenyen Gaco, Dante
Gaco’s daughter, and that their houses are situated inside the subject land
belonging to Vicente Baid, hereto attached and collectively marked as,
Exhibits “V” to “V-2” )

14. Q: Kinsa man ngkuha ini nga litrato? (Who took this photos?)
A: Kami ni Bernaldo B. Nuňez. (Bernaldo B. Nuňez and me.)

15. Q: Kanus-a man ninyi ni gikuha ning mga litratuha? (When did you take
these photos?
A: Adtong Domingo, Oktubre 9, 2022 panahon sa paniudto. (It was on a
Sunday, October 9, 2022 during lunch time.)
 16.Q: Imo ba nga barogan nga tinood kining imong mga tubag sa mga panguta
nga nakasulat sa taas? (Will you stand as to the truthfulness of your
answers in the above questions?)
A: Akong barogan. (I stand.)

17.Q: Aron sa pagmatood niini, imo ba kining pirmahan? (In order to vouch
for its truthfulness are you willing to sign this judicial affidavit?)
