EMPLOYMENT CONTRACT
BETWEEN
AND
GERALDO KAPAJ
(EMPLOYEE)
Duration of Contract
1. This contract shall have a duration of 24 months from the date that Geraldo Kapaj assumes
his position as a cook under the Foreign Worker program following the issuance of the Labour
Market Impact Assessment and a valid work permit.
2. Both parties agree that this contract is conditional upon Geraldo Kapaj obtaining a valid
closed work permit pursuant to the Immigration Regulations.
Job Description
Work Schedule
4. Geraldo Kapaj shall work 40 hours per week. He shall be paid overtime for any hours of
work exceeding 40 hours per week. His workday will usually start in the afternoon and end at
night. The schedule may vary from day to day. Geraldo Kapaj shall be entitled to a break time
to eat on each shift.
6. Geraldo Kapaj shall be entitled to 10 days of paid vacation. The period of paid vacation will be
adjusted in conformity with the Quebec Labour Standards.
7. Restaurant Bar Focaccio Inc. agrees to pay Geraldo Kapaj a wage of 19.00$ per hour which
shall be paid to him every two weeks.
8. Restaurant Bar Focaccio Inc. agrees to remit all of Geraldo Kapaj’s income deductions to the
Canada Revenue Agency as prescribed by law (including, but not limited to Employment
Insurance, Income Tax, Canada Pension Plan).
9. Restaurant Bar Focaccio Inc. shall not recoup from Geraldo Kapaj, through payroll
deductions or any other means, any costs incurred from recruiting Geraldo Kapaj.
10. Restaurant Bar Focaccio Inc. shall respect the Quebec Labour Standards in terms of
overtime, parental leave, meal pause, absences, and all statutory benefits pursuant to the
Labour Standards Act of Quebec.
Reviewing Wages
11. If applicable, Restaurant Bar Focaccio Inc. agrees to review and adjust (if necessary)
Geraldo Kapaj’s wage after 12 months of continuous employment, to ensure it meets the
prevailing wage rate for the position of cook.
Transportation Costs
13. Restaurant Bar Focaccio Inc. agrees to pay the transportation costs for a round-way ticket
from Geraldo Kapaj’s country of permanent residence to Canada, if he is obliged to leave
Canada at the end of his work contract. In such case, it is Restaurant Bar Focaccio Inc.’s
obligation and responsibility to pay for the transportation costs and said costs cannot be passed
on to Geraldo Kapaj (i.e. employee pays for his own transportation on behalf of Restaurant Bar
Focaccio Inc. and is reimbursed at a later date). Under no circumstances are those specific
transportation costs recoverable from Geraldo Kapaj.
14. If there is a termination of the employer-employee relationship and Geraldo Kapaj is hired by
a NEW EMPLOYER who has a neutral or positive Labour Market Opinion, Geraldo Kapaj shall
release Restaurant Bar Focaccio Inc. from the obligation to pay for his return transportation cost
to his country of permanent residence. The NEW EMPLOYER will be responsible for Geraldo
Kapaj’s transportation costs to the new location of work in Canada and back to Geraldo Kapaj’s
country of permanent residence. Transportation costs cannot be passed on to Geraldo Kapaj
(Geraldo Kapaj pays for his own transportation on behalf of Restaurant Bar Focaccio Inc. and is
reimbursed at a later date). Under no circumstances are transportation costs recoverable from
foreign workers.
Accommodation
15. Restaurant Bar Focaccio Inc. will not provide Geraldo Kapaj with accommodation as he
already has found suitable accommodation in Montreal and does not wish to reside at a different
location.
16. Restaurant Bar Focaccio Inc. agrees to provide health insurance at no cost to the foreign worker
until such time as the worker is eligible for applicable provincial health insurance.
17. Restaurant Bar Focaccio Inc. agrees to register Geraldo Kapaj under the relevant provincial
government insurance plan. Restaurant Bar Focaccio Inc. agrees not to deduct from Geraldo
Kapaj’s wages for this purpose.
Notice of Resignation
18. Should Geraldo Kapaj wish to terminate the present contract, Geraldo Kapaj agrees to give
Restaurant Bar Focaccio Inc. a written notice thereof at least two weeks in advance.
19. Restaurant Bar Focaccio Inc. must give written notice before terminating the present contract
if he has completed 3 months of uninterrupted service with Restaurant Bar Focaccio Inc. and if the
contract is not about to expire. This notice shall be provided at least two weeks in advance.
20. Restaurant Bar Focaccio Inc. is obliged to abide by the standards set out in the relevant
provincial labour standards act and, if applicable, the terms of any collective agreement in place.
In particular, Restaurant Bar Focaccio Inc. must abide by the standards with respect to how wages
are paid, how overtime is calculated, meal periods, statutory holidays, annual leave, family leave,
benefits, recourse under the terms of the Quebec labour standards. Any terms of this employment
contract less favourable to Geraldo Kapaj than the standards stipulated in the Quebec labour
standards act are null and void.
IN WITNESS WHEREOF the parties state that they have read and accepted all the terms and
conditions stipulated in the present contract.
