1. This has reference to Memorandum Spot Report Re: Stabbing Incident

dated 5 January 2023 and Progress Report dated 8 January 2023.

2. On January 5, 2023 at about 7:30 in the evening, a stabbing incident

happened in front of bus terminal of Santa Maria, Presentacion, Camarines Sur.
The victim was identified as Rico Sanchez y Gonzales, 22 years old, 3rd year
criminology student of Naga College Foundation, a resident of Zone 2, Brgy
Cagnipa, Presentacion, Camarines Sur. The suspect was identified as Gian Santos
y Angeles, 23 years old, 4th year criminology student of Partido College.

3. The victim is waiting for the bus and the suspect confronted the victim.
The suspect argued about yesterday basketball heated game. Gian suddenly
punch Rico and fell down and not satisfied, he took a deadly weapon in his left
side and stabbed him twice and the suspect fled away after the incident.
Thereafter, the witness informs the Presentacion Municipal Police Station about
the incident happened in bus terminal on January 5, 2023. Pat. Lorenzo Paat and
Pat. Rody Pamandago responded to the place of incident where they found the
laying on the ground.

4. The victim sustained three (3) stabbed wounds, one (1) lower side part of
the body, one (1) chest and one (1) stomach. Rico Sanchez was rushed to St.
John Hospital at Goa, Camarines Sur and suffering a critical condition. After the
incident, the suspect fled using his motor vehicle to unknown place. The butterfly
knife was the weapon used by the suspect and recovered by the police in the
incident.

5. In connection with the above reference the victim identified as Rico

Sanchez was declared dead by the doctor on the hospital two (2) days after the
incident while being confined. Meanwhile, the suspect voluntarily surrenders on
same day after the suspect found out the death of Rico Sanchez y Gonzales at
Presentacion Municipal Police Station.

6. The suspect held under the custody of Presentacion Municipal Police

Station for proper case disposition with a case of Murder under Article 248 of the
Revised Penal Code (RPC) and being prepared for immediate filing in court.

7. The case is already raffled at Branch 30 of San Jose Regional Trial Court.
The accused Gian Santos was arraigned on January 15, 2023 where he pleaded
Guilty and the case was set for pre-trial on January 20,2023
