AFFIDAVIT OF CANCELLATION OF
ANNOTATION OF LEGAL ENCUMBRANCE
I, JOSE M. RIZAL of legal age, married to JOSEPHINE B. RIZAL, both Filipinos and with residence and
postal address at 126 Sikatuna Village, Cebu City, Philippines after having been duly sworn to in accordance with law,
do hereby depose and say that:

1. I am the registered owner of a parcel of land situated at Quezon City, Philippines, as evidenced by TCT
No. 123456, a copy of which is hereto attached as Annex “A”;

2. I am the heir of the deceased CRISTINO F. RIZAL;

3. The aforementioned parcel of land was Judicially reconstituted pursuant to RA 26 in relation to PD 1329
by a judicial order issued by the Regional Trial Court of Quezon City Branch 101 dated 19 January
1996;

4. Appearing on the accompanying TCT No.: 123456 relating to the condition that the building may be
constructed on this lot must be built of strong materials and to the liabilities to contingent claims of any
heirs, creditors or other person who might be deprived of lawful participation in the estate of the
deceased CRISTINO F. RIZAL as imposed by Rule 74, Section 4 of the Rules of Court;

5. The two (2) year period from 6 February 1968 has already expired and that nobody has presented any
claim whatsoever against the extrajudicial settlement and distribution of said estate;

6. This affidavit is executed to attest to the foregoing and pursuant to the provision of Section 86 of
Presidential Decree No. 1529 to petition this honorable office for the CANCELLATION OF THE
ANNOTATION of the legal encumbrance appearing on the TCT No.: 123456 registered under the
name of JOSE M. RIZAL married to JOSEPHINE B. RIZAL;

FURTHER AFFIANT SAYETH NAUGHT.
