Dear Sir/Madam,
RE: TERMINATION OF TENANCY AGREEMENT DATED 20.07.2020 (“said
Tenancy”)
PROPERTY: LOT E19-0, GROUND FLOOR, BANDAR MUTIARA
SEMPORNA, JALAN HOSPITAL, SABAH (“said Premise”)

We act for the Tenant Jamil Bin Santoh and refer to the above matter.

We were informed that the said Premise was rented to our client on a “as is where is” basis,
deposits in the sum of RM14,000.00 (“said Deposits”) was paid and the monthly rentals have
been paid accordingly up to date.

However, you being the landlord had failed to comply with the said Tenancy more
specifically as follows:
i) in regards clause 6.3 of the said Tenancy, where our client has paid for the utility
charges and rentals but were not able to enjoy proper use of the electricity and the
said Premise since 01.08.2020, which resulted in damages to goods and loss of
business.
ii) That no fit out period was given by the Landlord as required under clause 4 of the
said Tenancy, but normal rental was charged to the tenant
iii) That you as the Landlord had without notice or permission entered the said Premise
and removed fixture/fittings causing disturbance to the business of our client and
could not operate at all since 18.10.2020, thus you have breached clauses 6.7 and
7.3 of the said Tenancy.
iv) Forcing our clients to sign additional agreements and made unreasonable demands
to our clients that were not included in the said Tenancy and which police report has
been made and further legal proceedings can be made.

Therefore due to the above breaches by you, our client have decided to terminate the said
Tenancy effectively on 31.10.2020 together with the refund of the said Deposit accordance
with clause 3.3 of the said Tenancy.

We also hereby DEMAND from you the following sum being the damages and loss incurred
to our client’s business due to the breach by the Landlord:
RM
a) Damages to foods, goods and stocks 15,930.00
b) Loss of profit and earning 46,500.00
c) Payment of salary to staff 12,368.00
d) Cost of relocating of business _3,750.00_
Total: 78,548.00

The payment of the said Deposit and the sum of RM78,548.00 as at 23.10.2020 shall be
paid to our client within Five (5) working days from the date of this letter failing which we
shall take legal action without any reference to you.

Kindly acknowledge receipt by signing on the duplicate copy of this letter.
