CONSTRUCTION/CONCRETING OF NRJ ANILAO-MAHAYAHAY FARM
TO MARKET ROAD LOCATED IN VERUELA, AGUSAN DEL SUR

I. Background

The NCIP Regional Office was in receipt of a letter from the Office of the Municipal Mayor of
Veruela , Agusan del Sur dated September 8, 2014 endorsing their proposed PRDP I-Build
sub-project: the Construction/Concreting of NRJ Anilao-Mahayahay FMR situated in
Barangay Sampaguita (the project), for the issuance of Certificate of Non-Overlap (CNO). As
stated in the said letter, the CNO is a very important document for the issuance of NOL 2 by
the World Bank.1

Likewise, on September 11, 2014, this office received a letter 2 from the Department of
Agriculture (DA) requesting for the issuance of Certification of Non-Overlap for a list of
locations of the Philippine Rural Development Projects (PRDP) Year 1 I-BUILD Subprojects as
requirement by the World Bank prior to the issuance of No Objection Letter 2. The same
project endorsed by Mayor Salimar T. Mondejar of Veruela is one of the subprojects
requested by the DA for issuance of CNO.

On September 30, 2014, the NCIP Regional Director (RD) sent a letter-reply 3 to Mayor
Mondejar informing him on the issuance of Work Order No. 75-14-10 4 creating the Field-
Based Investigation/Validation Team for the conduct of FBI/validation of the endorsed
project, pursuant with NCIP Administrative Order No. 3, Series of 2012. The DA was also
informed of the same. However on October 10, 2014, the Provincial Officer of Agusan del Sur
sent a letter5 to the NCIP RD requesting for augmentation of personnel on the FBI/FPIC
activities directed to them. Thus, Work Order No. 96-14-11 6 dated November 12, 2014 was
issued reconstituting the FBI/Validating Team, superseding and revoking Work Order No. 75-
14-10.

II. The Project and The Proponent

A. General view of the program:

On August 29, 2014, The World Bank’s Board of Executive Directors approved a loan and
grant financing package for rural infrastructure as well as small business and livelihood
projects for farmers and fisherfolk in the Philippines. The assistance aims to raise rural
incomes and reduce poverty in the country.

Called the Philippine Rural Development Project (PRDP), the new US$508.25 million financial
package aims to improve the productivity of small farmers and fisherfolk as well as their
access to markets. This project will be implemented by the Department of Agriculture (DA).

Over 70 percent of total financing will be utilized for funding infrastructure projects of local
government units. This will include farm-to-market roads, bridges, tire tracks, communal
irrigation, potable water systems, post-harvest facilities, production facilities, fish landings,
fish sanctuaries, storage facilities, trading posts, green houses, solar driers, and slope
stabilization works.7

The Philippine Rural Development Project is a six-year (6) project designed to establish the
government platform for a modern, climate-smart and market-oriented agri-fishery sector.
PRDP will partner with the LGUs and the private sector in providing key infrastructure,
facilities, technology, and information that will raise incomes, productivity, and
competitiveness in the countryside.

Within the six-year (6) project intervention, it is expected to provide the following
outcomes:
 At least five percent (5%) increase in annual real farm incomes of PRDP in household
beneficiaries
 30% increase in income for targeted beneficiaries of enterprise development
 Seven percent (7%) increase in value of annual marketed output
 Twenty percent (20%) increase in number of farmers and fishers with improved
access to DA services.8

B. Brief description of the project and its proponent:

The road from Sitio Anilao of Barangay Sampaguita is an important access of farm products
like banana, rubber, palay and other farm products considering that this is a rubber
producing sitio and this area also produces substantial production of banana, fruit trees
(durian), vegetables, rootcrops and coffee. This is also an important access of the residents
of Sitio Anilao of Sampaguita and portion of Awao of the Municipality of Sta. Josefa and its
adjacent sitios of Barangays Sinobong and Sta Emilia.

If this road will be constructed, it will provide a dramatic increase in agricultural productivity,
and launch more socio-economic progress not only for the residents of Sitio Anilao,
Poblacion proper of Barangay Sampaguita and but also for its neighboring barangays.

Generally, the project aims to improve road accessibility of all the residents especially in
transporting agricultural products. Its specific objectives are as follows:

a. To construct by laying surfacing materials of gravel base (3.0) kms road NRJ from
Sitio Anilao to Sitio Mahayahay, all in barangay Sampaguita and concreting of the
whole stretch of the FMR;
b. To reduce travel time by 50%;
c. Reduce hauling cost of agricultural products by 50%;
d. Increase traffic count by at least 60%;
e. Eliminate damages during hauling and maintain good quality of Agri-products;
f. Facilitate the delivery of the newly harvested agricultural products to arrive fresh at
the market so as to demand higher market price;
g. To increase economic activities in the influence area and provide better access to
social service; and
h. Provide peace and order efforts/interventions to the community. 9

III. The Field-Based Investigation and Validation Activities

A. The FBI Activities:

On November 19, 2014, the FBI/Validating team visited the Municipal Hall of Veruela with the
letter10 notifying Mayor Mondejar on the team’s FBI activity. Since the Mayor was not
around including the PRDP project in-charge who is at the same time the Municipal Engineer
(ME), the Team was forwarded to the ME’s staff Engr. Reynan Aro and the team was given
with a copy of the Feasibility Study of the project.

The team interviewed Engr. Reynan Aro and it was validated that the project is within CADT-
089, wherein project beneficiaries are mainly the ICCs of Veruela, particularly of Barangay
Sampaguita. It was an agreement that a meeting with the Elders/Leaders of CADT-089 will
be held on November 26, 2014, 10:00 AM at Kalahi Farmers’ Center, Poblacion, Veruela,
Agusan del Sur for the validation process. It was also agreed that the meals and
transportation expenses of the Leaders/Elders are shouldered by the LGU.

On the same date, letters11 inviting the Leaders/Elders were sent through the Barangay
Captain of Sampaguita, who is a known supporter of the endeavors involving IP concerns in
the municipality.

B. The Validation Activities:

The Validating Team arrived at the agreed venue late in the morning of November 26, 2014
due to heavy rains. All of the Community Leaders involving CADT-089 together with the
Municipal Engineer, Engr. Rolando Peliño were so prepared to start the activity and upon
the team’s arrival, the meeting immediately started.

During the validation meeting, the FBI Team Leader explained the main purpose of the
validation, which is to determine if the project coincide or complement with the
development priorities of the community and will not in any way adversely affect the well-
being the ICCs/IPs of Veruela.

Hon. Ikel Asuncion (SB Member/Committee on IP Concerns), who is also a Manobo of
Veruela, in his message, recalled that said project was one of the needs of the ICCs identified
during the crafting of their ADSDPP. He was certain that the project was included in the ICCs’
ADSDP plan because the ADSDPP was integrated with the LGU plans.

Engr. Peliño presented the profile of the project and its nature wherein the Leaders/Elders
actively and positively responded during the open forum. The Tribal Leaders also mentioned
that said project is one of their priority needs identified in their ADSDPP. They also
expressed their humble requests to the LGU upon project implementation. Hawudon
Jamaico Cuyo, Barangay Tribal chieftain of Sampagita (the directly affected barangay),
informed the body that they (Barangay Tribal Council) already conducted a meeting prior to
the scheduled validation meeting regarding the proposed project, declaring that he brought
the voice of his community. He expressed his approval to the project since it aims for the
development of economic situation of the ICCs in the target sitios. He also raised the
requests of his Tribal Council to the LGU. The summary of their requests are as follows:

1. Conduct of ritual on the project site before the project implementation;


2. Prioritization of the ICC members in the hiring of manpower during the project
implementation; &
3. The potential quarry sites within the AD or near the project site shall not be used
without FPIC.

Engr. Peliño positively assured the Leaders/Elders that their requests were already part of
the program of the LGU during project implementations and that existing rules will be
strictly observed.

Consequently, the Elders/Leaders unanimously finalized and signed the Resolution 12 of


Consent and Acceptance of the Proposed Construction/Concreting of NRJ Anilao-Mahayahay
Farm to Market Road within CADT-089 in confirmation to their approval. See attached
copies of Minutes of the Meeting13, Attendance Sheet14, and Photo-documentation15.

IV. Findings and Observations

1. The proposed construction/concreting of NRJ Anilao-Mahayahay FMR is a project of


the local government to be implemented by LGU-Veruela, to be funded through the
Philippine Rural Development Program of the Department of Agriculture;

2. CADT-089 is covering areas within the Municipality of Veruela, Agusan del Sur;

3. There was an integration of the CADT-089 ADSDPP with the LGU Plans;

community within the influence area.

V. Conclusion

Therefore, the Team concludes the following:

1. Sections 40 and 43, Part VI (Other Processes) of the NCIP Administrative Order No. 3
Series of 2012 applies wherein Validation Process was conducted;

2. The whole 3-km road construction/concreting of NRJ Anilao-Mahayahay FMR project


is within CADT-089;

3. The project coincide or complement with the development priorities of the ICCs of
CADT-089;

4. The project will not in any way adversely affect the well-being of the ICCs/IPs.

VI. Recommendation

In view of the foregoing, the FBI/Validating Team hereby recommends the issuance of
CERTFICATION PRECONDITION in favor of LGU - Veruela, for their proposed
Construction/Concreting of NRJ Anilao-Mahayahay Farm to Market Road located in
Barangay Sampaguita, Municipality of Veruela, Province of Agusan del Sur.
