MEMORANDUM OF AGREEMENT

This Memorandum of Agreement is entered into this 1 st day of December 2022 in the Municipality
of Doña Remedios Trinidad, Bulacan, by and between:

The MUNICIPALITY OF DOÑA REMEDIOS TRINIDAD, a local government with original


charter, represented by MUNICIPAL MAYOR RONALDO T. FLORES, hereinafter as the
FIRST PARTY;

The DEPED DISTRICT SUPERVISOR, represented by CARLITO G. DELA CRUZ


hereinafter referred to as the SECOND PARTY.

WITNESSETH:

WHEREAS, disaster as defined in Republic Act No. 10121 (also known as the Philippine Disaster
Risk Reduction and Management Act of 2020, refer to a serious disruption of the functioning of a
community or a society involving widespread human, material, economic, or environmental losses
and impact, which exceeds the ability of the effected community or society to cope using its own
resources. Disaster are often described as a result of the combination of: the exposure to a hazard;
the conditions of vulnerability that are present; and insufficient capacity or measures to reduce or
cope with the potential negative consequences. Disaster impacts may include loss of life, injury,
disease and other negative effects on human, physical, mental and social well-being, together with
damage to property, destruction of assets, loss of services, social and economic disruption and
environmental degradation;

WHEREAS, it is the policy of the State, as embraced in the Implementing Rules and Regulations
of Republic Act No. 10121, to institutionalize the policies, structures, coordination mechanisms and
programs with continuing budget appropriation on disaster risk reduction from national down to the
local level towards building at disaster resilient nation and communities;

WHEREAS, for effective and economical governance the purpose of which is general welfare of
the city and its inhabitants, the FIRST PARTY as represented by the Municipal Mayor shall
carry out such emergency measures as may be necessary during and the aftermath of man-made and
natural disasters and calamities, pursuant to Chapter III, Article I, Section 455 (VII) of R.A. No
7160 also known as the Local Government Code of 1991.

WHEREAS, educational facilities in the schools under the jurisdiction of the SECOND PARTY
shall be utilized property. The use of the ground and facilities of the school other than for the
school activities must be subject to the approval of the Schools District Supervisor. Among other
public activities and utilization of the school grounds and facilities which may be permitted by the
Schools District Supervisor through the principal/head teacher is the use of school
building/classroom as evacuation centers in case of natural calamities, pursuant to Chapter 5 (C) of
the 2010 Educational Facilities Manual;

WHEREAS, Pursuant to Section 5 of Republic Act also known as the “Children’s Emergency
Relief and Protection act”, only in cases where there is no other available place or structure which
can be used as a general evacuation center may a school of child development center be used as an
evacuation center;

WHEREAS, pursuant to Section 5, Rule 6 of the IRR of R.A. 10821, Schools and child
development centers shall no be used as traditional shelters due to negative effects that such use
may cause to the education of children living inside and outside transitional shelters;
NOW THEREFORE, for and in consideration of the foregoing premises and of the mutual
covenants stipulated hereafter set forth, the PARTIES hereto agree to enter into this Memorandum
of Agreement and adhere to the following terms and conditions:

I.
STATEMENT OF THE PRIMARY COVENANT

All Schools under the jurisdiction of the SECOND PARTY may be used as evacuation centers for
the constituents of the FIRST PARTY, subject to the guidelines specified hereunder.

II.
DELINEATION OF RESPONSIBILITIES

A. Responsibilities of the FIRST PARTY:

The FIRST PARTY shall:

1. notify the SECOND PARTY, thru the school heads, prior the actual use of the school
premises;

2. pursuant to Section 2 (C), Rule 5 of the IRR of R.A. 10821, provide a report/written
documentation to the SECOND PARTY, if the use is predicted to exceed fifteen (15)
days, specifically stating the following matters;

a) The name and location of the school that are currently utilized as an evacuation
center
b) All alternative sites and proposal for final site selection;
c) Measures being implemented to prevent interference or disruption to the school and
educational activities of children; and
d) Timeline for the relocation of and plan of action for internally displaced persons to
sites outside of school or child development centers shall be approved by DepEd.

3. Use the classrooms as a last resort and shall first utilize the gymnasiums, learning and
activity centers, auditoriums and other open spaces; and

4. Pursuant to Section 4 (a), Rule 5 of the IRR of R.A. 10821, facilitate general cleaning,
fumigation, payment of utilities and repair of schools and child development centers
used as evacuation centers.

B. Responsibilities of the SECOND PARTY:

The SECOND PARTY shall:

1. Pursuant to Chapter 5 (C) (6) (c) of the 2010 Educational Facilities Manual, allow the
use of the schools under its jurisdiction as a evacuation centers when there is no other
safer place where the people from the community can take refuge;

2. Take measures to ensure proper coordination with the concerned school heads;

3. Thru its school heads, immediately report damages incurred by schools and child
development centers used as evacuation centers to the FIRST PARTY for appropriate
action.
C. Responsibilities of both PARTIES:

The PARTIES shall;

1. Monitor and assess the condition of the premises of the schools prior, during and after
the period of the actual use;

2. Coordinate to ensure the preservation of the schools’ facilities and properties and for the
immediate resumption of the respective operations of the schools after the disaster.

3. Pursuant Section 2 (d) Rule 5 of IRR of R.A. 10821, submit an inspection report to the
Secretary of DepEd, copy furnished the local chief executive, for the purpose of repair
of the damaged school or child development center used as an evacuation center.

III.
EFFECTIVITY

This agreement shall hold for the duration of three (3) years. The FIRST PARTY and the
SECOND PARTY shall submit their intention for renewal of this agreement through formal notice
within thirty (30) days before the expiration of this Agreement.

IV
MISCELLANEOUS PROVISIONS

Furthermore this Memorandum of Agreement supersedes and renders void any and all agreements
and undertakings, oral and/or written, previously entered by the parties and that this agreement may
not hereafter be modified or altered except by an instrument in writing duly signed by the Parties.

Any violation shall terminate this Agreement.

IN WITNESS WHEREOF, we have hereunto signed this Memorandum of Agreement


this 1st day of December 2022, hereat the Municipality of Doña Remedios Trinidad, Province of
Bulacan.
