खण्ड-अ (Section-A)

Note: सभी ऩाॉच प्रश्नों को हऱ कीजजए। प्रत्येक प्रश्न 4 अॊक का है । अनधकतम 75 शब्दों में ऱघु उत्तर
अऩेजऺत है ।
Attempt all the five questions. Each question carries 4 marks. Very short answer is required not
exceeding 75 words.
1. प्रासॊनगक विचार को ऩररभावित कीजजये।

2. दीिानी न्यानयक प्रशासन एिॊ आऩरानधक न्यानयक प्रशासन।

Note: ननम्ननऱजखत तीन प्रश्नों में से ककन्हीॊ दो प्रश्नों का उत्तर दीजजए। प्रत्येक प्रश्न 10 अॊक का है ।
अनधकतम 200 शब्दों में ऱघु उत्तर अऩेजऺत है ।
Attempt any two questions out of the following three questions. Each question carries 10 marks.

6. विनध और नैनतकता के बीच सम्बन्धों की वििेचना कीजजये।
Discuss the relationship between law and morals.
7. स्िानमत्ि के प्रकारों की वििेचना कीजजये।
Discuss the kinds of ownership.
8. 'राज्य' शब्द को ऩररभावित कीजजये। राज्य की उत्ऩवत्त के नसद्धान्त क्या हैं ?
Define the word 'State'. What are the theories of its origin?

Note: ननम्ननऱजखत ऩाॉच में से तीन प्रश्नों का उत्तर दीजजए।प्रत्येक प्रश्न 20 अॊक का है । विस्तृत उत्तर
अऩेजऺत हैं ।
Attempt any three questions out of the following five questions. Each question carries 20 marks.
Answer is required in detail.
9. दण्ड के विनभन्न नसद्धान्त क्या है ? भारतीय समाज के नऱये कौन-सा नसद्धान्त उऩयुक्त है ? वििेचना
कीजजये।
What are the various theories of punishment? Which theory is most suitable for Indian society?
Discuss.
10. "विनधक व्यवक्तत्ि और कुछ नहीॊ केिऱ एक कल्ऩना मात्र है ।' व्याख्या कीजजये।
'Legal personality is nothing but a fiction.' Explain.
11. न्यानयक ऩूिव ननणवय क्या है ? विनध के विकास में न्यानयक ऩूिव ननणवयों के योगदान का मूल्याॊकन
करें ।
What is precedent? Evaluate the contribution of precedent in the development of law. Discuss.
12. "आनधऩत्य के नऱए न तो माननसक इच्छा और न ही भौनतक अनधकार ऩयावप्त है । आनधऩत्य का
आरम्भ ही दोनों के योग से होता है तथा तब समाप्त होता है जब या तो एक अथिा दोनों अदृश्य
हो जाते हैं । वििेचना कीजजये।
