CONTRACT OF LEASE

 
KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT OF LEASE is made and executed at the City of Roxas,

this day of 9 May 2023, by and between:
 
JUANITO DE MAYO, of legal age, married, Filipino, with residence
address of Poblacion, President Roxas, Capiz, hereinafter referred to as
the LESSOR.
 
-AND-
 
        Powell A. Del Rosario, Filipino, married. with business address at
Brgy. Ugsod, Banga, Aklan hereinafter referred to as the LESSEE.
 
WITNESSETH; That
 
WHEREAS, the LESSOR is the owner and possessor of a one (1) unit
backhoe (0.75 cubic meter capacity) KOMATSU PCC 200 and 2 units
FUSO Ten Wheeler Delivery Dump Trucks with Plate Nos. CAN2624 and
030101, operational and in good working condition;

WHEREAS, the LESSOR agrees to lease-out the above mentioned one (1)

unit backhoe (0.75 cubic meter capacity) and 2 units Ten Wheeler
Delivery Dump Trucks to the LESSEE and the LESSEE is willing to lease
the same;
 
NOW THEREFORE, for and in consideration of the foregoing premises,
the LESSOR leases unto the LESSEE and the LESSEE hereby accepts
from the LESSOR the LEASED equipments, subject to the following: 
  
The term of lease is for the whole duration of the “Commercial Sand and
Gravel Operations in Banga, Aklan.
 
The monthly rental rate for leased equipments shall be in PESOS: One
Hundred Fifty Thousand Pesos (P 150,000.00), Philippine Currency.
  
This CONTRACT OF LEASE shall be valid and binding between the
parties, their successors-in-interest and assigns.
 
IN WITNESS WHEREOF, parties herein affixed their signatures on the
date and place above written.

CERTIFICATION

This is to certify that the equipments listed in the foregoing Contract of Lease will be
available for the “Operation of the Commercial Sand and Gravel” and
possession will be transferred to Powell Del Rosario upon commencement of his
business operations.
