National Technical Advisor to Support the Development of the Action Plan to Implement
the Child Protection Policy in Schools

Terms of Reference

1. Background

In 2014, the Steering Committee on Violence against Children, composed of 13 Ministries including
the Ministry of Education, Youth and Sport (MoEYS), made a commitment to prevent and respond to
violence against children in Cambodia. The MoEYS has committed itself to call for zero tolerance of
violence against children and to promote social norms that condemn all forms of violence. To fulfil
its commitment, the MoEYS has developed the Child Protection Policy in Schools with technical
support from UNICEF and financial support from NGOs including Plan International and Child
Rights Foundation. The Policy aims to ensure all children are given protection as well as an
equitable and safe learning environment in public and private education establishments, which was
endorsed by the Minister in September 2016.

To make sure of its effective implementation, the MoEYS has requested UNICEF and NGOs to
provide support through the MoEYS intra-Ministerial Technical Working Group (TWG). In
particular, with the contribution through the Education Section from SIDA, UNICEF will provide
technical and financial support in the recruitment of a national technical advisor to support MoEYS,
specially the Primary Education Department in the development of a long-term action plan for the
implementation of the MoEYS Child Protection Policy in Schools.

2. Purpose and Objective

The overall objective of the consultancy is to develop a long-term action plan for the
implementation of the Child Protection Policy in Schools which was endorsed by the MoEYS
in September 2016 and will be implemented by the MoEYS, particularly the Primary
Education Department (PED).

3. Programme Area, Outputs and Specific Key Results Areas in the Rolling Work Plan 2016-2018

inclusive basic education particularly amongst indigenous minorities and children with disabilities
including in emergencies.
Milestone: Percentage of primary schools with teachers who have been trained in positive discipline
and child protection in six target provinces (assuming a total of 1,600 primary schools).

4. Work Assignments

The Technical Advisor (TA) will support the PED, which is under the supervision of the UNICEF’s
Education Specialist, to develop the action plan for the implementation of the Child Protection
Policy in Schools including accompanying documents such as a monitoring and evaluation
framework.

The TA will review relevant policies and guidelines and good practices regarding child protection
policies in schools from other countries to draft the action plan, which reflects the current
Cambodia’s situations, challenges, opportunities, and strategies to tackle the child protection issues.

The TA will also help coordinate with and consolidate technical inputs from the TWG by attending
the TWG regular meetings and presenting the progress of work to the TWG. It is expected that the
finalization will take 24 days and the MoEYS and UNICEF will provide support until this process is
completed.

5. Qualifications of Successful Candidate

Education
Advanced University degree (at least Masters) in a relevant field such as education planning, child
protection, child rights and policy development

Years of relevant experience


 At least five-year experiences on education policy planning and development
 Recent and relevant experience of national, sub-national, and school-level education sector
issues, including regional perspective.
 Experience of sectorial planning and reporting arrangements, including working in professional
teams and use of results frameworks, logical frameworks and work planning arrangements.

6. Location & Duration

The Technical Adviser (TA) will be based in the PED, MoEYS in Phnom Penh. The TA will use his/her
own laptop and will also cover all associated cost of the assignment. The duration of the assignment
will be up to 24 working days from June 2017 to end of December 2017.

Note:
 2 weeks are required for UNICEF and partners to review each deliverable.
 Prepare all final materials in Khmer. UNICEF will take responsibility for translation of the final
products if necessary.

8. Reporting Requirements

All working documents and the final products shall be submitted electronically in Khmer, produced
in high quality, delivered in an engaging and accessible format, and guided by the guidelines set
forth in the UNICEF Style Book. UNICEF Education Section as well as Child Protection Section should
receive all the reports.

Inception report:
 The first, second and final draft will be prepared. The inception report should have a maximum
of 10 pages.
 Power Point presentations need to be prepared to summarize the inception report to be
presented by the consultant to the MoEYS intra-Ministerial Technical Working Group (TWG)
 The Minutes of meetings with the MoEYS TWG need to be taken and summarized by the
consultant

Draft and final version of an action plan:


 The first, second and final draft will be prepared in Khmer. The action plan should have a
maximum of 50 pages.
 Power Point presentations need to be prepared to summarize the first, second and final draft to
be presented by the consultant to the MoEYS intra-Ministerial Technical Working Group (TWG)
 The Minutes of meetings with the MoEYS TWG need to be taken and summarized by the
consultant

9. Payment Schedule linked to Satisfactory Deliverables (SMART)

The payment terms in relation to key deliverables in percentages are as follows:


 25% payment upon the completion of Deliverable 1
 25% payment upon the completion of Deliverable 2
 50% payment upon the completion of Deliverable 3

The payment installments should be directly linked with satisfactory deliverables at specific time
intervals and as certified by the manager.

The fees shall be calculated based on the days estimated to complete the assignment in the Terms of
Reference and shall be considered the maximum compensation as part of a lump sum contract and
agreed on a work plan for submission of deliverables. No additional fees shall be paid to complete
the assignment. Payment will be made upon delivery of all final products and full and satisfactory
completion of the assignment.

10. Administrative Issues

Confidentiality: The documents produced during the period of this consultancy will be treated strictly
confidential and the rights of distribution and/or publication solely reside with UNICEF.

11. Contract supervisor and other stakeholders

On a day-to-day basis the TA will be supervised by the UNICEF Education Section with technical
support from the UNICEF Child Protection Section.

12. Penalties for Underperformance

Payment of fees to the Contractor under this contractor, including each instalment or periodic
payment (if any), is subject to the Contractor’s full and complete performance of his or her
obligations under this contract with regard to such payment to UNICEF’s satisfaction, and UNICEF’s
certification to that effect.

Performance indicators: Consultants’ performance will be evaluated against the following criteria:
timeliness, quality, and relevance/feasibility of recommendations for UNICEF Cambodia.

13. Termination of Contract

This contract may be terminated by either party before its specified termination date by giving
notice in writing to the other party. The period of notice shall be five (5) business days (in the
UNICEF office engaging the Contractor) in the case of contracts for a total period of less than two (2)
months and fourteen (14) business days (in the UNICEF office engaging the Contractor) in the case
of contracts for a longer period; provided however that in the event of termination on the grounds
of impropriety or other misconduct by the Contractor (including but not limited to breach by the
Contractor of relevant UNICEF policies, procedures, and administrative instructions), UNICEF shall
be entitled to terminate the contract without notice.

14. Submission of applications

the terms of reference above (including travel and daily subsistence allowance, if
applicable). Applications submitted without a daily/monthly rate will not be considered.

The deadline for applications is 15/06/17.

15. Assessment Criteria

A two-stage procedure shall be utilized in evaluating technical assessment being completed prior to
any price proposal being compared. The Contract shall be awarded to candidate obtaining the highest
combined technical and financial scores, subject to the satisfactory result of the verification interview.

Applications shall therefore contain the following required documentation:

1. Technical Proposal: Containing a cover letter with indication of applicant’s ability and
availability, updated CV, and the example of applicant’s written report on end project
assessment or other references of similar consultancy assignments (if available).

For evaluation and selection method, the Cumulative Analysis Method (weight combined score
method) shall be used for this recruitment:

Technical Qualification (max. 100 points) weight 70 %

Quality of past work (e.g. understanding, methodology) (20 points)

2. Financial Proposal: Lump-sum offer with the cost breakdown: Please see the table in “16. Fee
and Funding Information”

Financial Qualification (max. 100 points) weight 30 %

The maximum number of points shall be allotted to the lowest Financial Proposal compared among
those technical qualified candidates who have attained a minimum 70 points score in the technical
evaluation. Other Financial Proposals will receive points in inverse proportion to the lowest price.
