SUBJECT : BENRO PERSONNEL WERE REQUESTED TO CONDUCT


INVESTIGATION AND INVENTORY BASED ON THE REPORT REGARDING THE
ALLEGED STOLEN LIGHTING FACILITIES IN SIMAYA CHECKPOINT.

PRELIMINARIES:

The BENRO personnel composed of Mr. Dennis G. Dagooc and Mr. Roland P.
Lasaca was requested by Mrs. Cecille M. Egnar, PENR officer of BENRO, to
conduct investigation and inventory at Simaya checkpoint based on the report
submitted by the BENRO inspectors assigned in Simaya regarding alleged stolen
lighting facilities.

ACTION/UNDERTAKINGS TAKEN:

 The BENRO personnel went to the office of the barangay chairman of


barangay Old Kibawe, Kibawe, Bukidnon, to refer the complaint to the
barangay chairman;

 The BENRO personnel, proceeded to the contested area for inspection,


verification, and GPS reading with the assistance of the project of RRN Engr.
Gerry Bulay-og;
 The BENRO personnel, went to the office of RRN to conduct an inquiry to the
person in charge of the project a day before the actual investigation.

FINDINGS AND OBSERVATIONS:

 During the conduct of the site inspection and verification, the BENRO
personnel found out that the contested area was not a quarry site but part of
the road concreating and widening project of the DPWH;

 During the area verification, the BENRO personnel tried to contact the
complainant but accordingly, the complainant Mr. Alfredo Veluz, Jr., was not
residing within the barangay where the contested area was located. The
BENRO personnel, was able to spoke with the son of Mr. Honorato Salupado,
Rene Salupado, while the BENRO personnel was conducting the
investigation.

 According to Mr. Rene Salupado, prior to the turn over of the project finished
by the RRN construction, part of the finished project or the slope protection
area of the project collapsed due the earth quake last april 18, 2017, as part
of the responsibility of the contractor (RRN) in maintaining the
complete/finished state of the project area, RRN construction made a back job
on their project since it collapsed before turning it over with the barangay, but
allegedly by Mr. Rene Salupado, the RRN used the portion of the land owned
by the Salupado’s which was alongside of the road concreating and widening
project of the DPWH.

 Mr. Rene Salupado also added that some of the planted trees were damaged
during the excavation/cutting and filling process for the restoration of the slope
protection. The latter also stated that the RRN quarried part of their area for
the said restoration.

 According to Engr. Gerry Bulay-og of the RRN construction, Mr. Veluz and the
head project engineer of RRN construction, Engr. Jerson Limocon, had an
agreement before regarding the damaged planted trees of the former, it will
be replaced by the latter at his expense, but Mr. Veluz changed his mind and
instead he ask payment for damages worth Php. 50, 000.00, in which the
claim and complaint was lodged in barangay Mailag, Valencia City. The
BENRO personnel explained to the Mr. Rene Salupado, that their filling of
complaint in barangay Mailag, Valencia City will not prosper due to violation of
jurisdiction, and they were advised to refer the complaint back to barangay
Old Kibawe, Kibawe, Bukidnon.
 I was also found out during the conduct of the inquiry, according to Mr. Rene
Salupado, the conflict between the RRN construction and Mr. Alfredo Veluz,
Jr. originated when one time, Mr. Veluz asked the project foreman of RRN
Construction to load and deliver to Valencia City, cut logs of gemelina tree to
be used as firewood but the head project engineer did not allow it, but he
instead offered that Mr. Veluz will look for a vehicle to be used for hauling the
cut logs and the former will pay for the expenses, but unfortunately there was
no hauling occurred.

 After the inquiry, the parties were advised to wait for the invitation letter from
the office of Bukidnon Environment and Natural Resources Office of the
Provincial Government of Bukidnon for a dialog.

 The BENRO personnel went to the office of the barangay chairman of


barangay old Kibawe, Kibawe, Bukidnon, to refer the issue at hand, and to
inquire if they have any knowledge of the complaint, the BENRO personnel,
was able to spoke to the barangay chairman Elsie Jaspe to address the issue
properly.

 According to her, the complaint of Mr. Honorato Salupado and Mr. Alfredo
Veluz, Jr. never came in to her knowledge nor did the letter/communication of
the complaint reached her office. The BENRO personnel explained that such
complaint made by the complainant to barangay Mailag, Valencia City was
not proper and was a violation under the rules of procedure regarding
jurisdiction over the land in dispute. The BENRO personnel advise the
Punong Barangay Jaspe, to wait for an invitation for a dialog to discuss further
the issue at hand.

RECOMMENDATION:

The BENRO investigating team has come up with the following


recommendations based on the findings and Observation:

1. That the complainant, Mr. Panda Saripada must be called in the office of
BENRO verification regarding his allegations in his complaint.
