MEMORANDUM :
PRELIMINARIES:
The BENRO personnnel ask the barangay chairman, who owns the
equipment operating within Maridugao River, it was then said by the latter that
it was owned and operated by Mr. Butner Geron, resident of Brgy. Bangahan,
Pangantucan, in which the said area is adjacent to lot owned by Mr. Wilfredo
Reston;
It was then further discussed by the BENRO personnel that the said operation
of Mr. Geron was without permit even on whatever purpose they may use the
aggregates for the reason that there was no COMMERCIAL SAND AND
GRAVEL PERMIT (CSAG) was issued in favor of the latter;
It was then contended by the Brgy. Chairman that they do not have any idea
on what to do regarding the quarry operation matter;
The team explained to the Brgy. Chairman that they must not tolerate such
illegal operation until such CSAG permit is available and existing under the
name of Mr. Butner Geron, and the barangay’s responsibility to report such
illegal operation to the office of BENRO;
After the BENRO investigating team spoke to the Brgy. Chairman, the
BENRO personnel searched the residence of a certain Mr. Jose Lamayo,
father of Mr. Daniel Lamayo, resident of Brgy. Malipayon, to conduct a
separate interview and investigation on the complainant’s statement;
The team was not able to locate Mr. Jose Lamayo, but fortunate to spoke with
the siblings of Mr. Daniel Lamayo, namely Maricel Lamayo and Ramil
Lamayo, both residing in Brgy. Malipayon, Pangantucan; they stated that
portion of their titled land was illegally operated by Mr. Geron, in which they
feared that the said operation will damage their land including their crops; the
team was able to secure a contact number of Mr. Daniel Lamayo for
reference;
The BENRO personnel tried to locate Mr. Butner Geron, but unfortunately the
was out of town;
Upon coming to the station, the BENRO team called Mr. Daniel Lamayo, for
an interview and investigation regarding the basis of his complaint; the team
have found out that there is an existing title of the alleged lot registered under
the name of Mr. Jose Lamayo. After the conduct of the investigation, the
BENRO personnel went back to station;
RECOMMENDATION:
1. That the compalinant Mr. Daniel Lamayo; the Brgy. Chairman, Mr. Felipe
Soloveros; and the respondent, Mr. Butner Geron for a scheduled dialog in
the office of Bukidnon Environment and Natural Resources.
