COMPROMISE AGREEMENT

KNOW ALL MEN BY THESES PRESENTS:

This Compromise Agreement is entered into this __ day of _______________

by and between:

CRISTELLE MAE R. MANGUBAT, Filipino, of legal age, married and a resident

of Proper Casay, Dalaguete, Cebu, Philippines, hereinafter referred to as the “FIRST
PARTY;

-AND-

SAMUEL JR. N. APLACADOR, Filipino, of legal age, married and resident of

Alaska, Mambaling, Cebu City, Philippines, hereinafter referred to as the “SECOND
PARTY”;

WITNESSETH:

The FIRST PARTY, is the representative and wife of the victim, JASON MAYOL
MANGUBAT, who was the driver of a motor vehicle known as HONDA BEAT motorcycle
bearing Plate No. 07010001035744 with expired registration under the name of Marly
M. Arcilla;

The SECOND PARTY, is the driver of HOWO Dump truck, Color: White bearing
Plate Number GAK1639, registered under the name of Penales Chlouyd, who was
involved in a motor vehicular accident;

WHEREAS, sometime on November 30, 2023 at around 1:30 am more or less

along Brgy. Colon, City of Naga, Cebu, both parties are travelling the same direction
heading towards Cebu City upon reaching the said place, the FIRST PARTY swerve to
the right lane and accidentally hit by the SECOND PARTY and incurred physical injuries
and damages to properties.;

WHEREAS, to buy peace and put an end to the consequences of the said
incident, the FIRST PARTY and the SECOND PARTY have agreed to the following terms
and conditions:

1. That SECOND PARTY is willing to assist and give reasonable and sufficient
amount for the hospitalization and medication of the FIRST PARTY;

2. That SECOND PARTY will also give the full amount that will be cater from
their Third-Party Liability Insurance to the FIRST PARTY;
 3. That FIRST PARTY shall refrain/desist from filling a case against the
SECOND PARTY and hereby release the motor vehicles/documents of both
parties at the Police custody of City of Naga, Cebu;

4. That PARTIES execute this Compromise Agreement on their will and volition
without any force or intimidation;

IN WITNESS WHEREOF, the parties hereby set their hands this __ day of _____
November 2023 at City of Talisay, Cebu, Philippines.
