๑. ความหมายของกฎหมาย
๓. อนุสัญญาระหวYางประเทศที่เกี่ยวกับการขนสYงทางทะเล
๓.๑ อนุสัญญาระหวYางประเทศ คือ ความตกลงระหวYางประเทศในเรื่องใดเรื่องหนึ่ง โดยกำหนด
หลักการและหลักปฏิบัติเพื่อใหFยึดถือปฏิบัติไปในแนวทางเดียวกัน
อนุสัญญามีผลบังคับใชFอยYางเปdนกฎหมายระหวYางประเทศในกลุYมประเทศยอมรับ คือ การ
ยินยอมผูกพันตนที่จะปฏิบัตติ ามกฎเกณฑoที่กำหนดในอนุสัญญา โดยการทำใหFอนุสัญญาเปdนกฎหมายใชFบังคับ
ในประเทศตนไดF เรียกวYา การอนุวัติการ (Implementation) เมื่อประเทศภาคีสมาชิกอนุสัญญานำเอาไปทำ
ใหFเปdนกฎหมายของตนก็จะทำใหFการปฏิบัติระหวYางประเทศเปdนไปในรูปแบบเดียวกัน (uniform practice
internationally) ลดปÖญหาความแตกตYางหรือการขัดกันของกฎหมายของแตYละประเทศลงไดF ทำใหFการ
ประกอบธุรกิจขนสYงทางทะเลมีกฎกติกาที่เปdนสากล ลดอุปสรรคทางการคFาระหวYางประเทศ 1
กฎเกณฑoของอนุสัญญามีทั้งสYวนที่เปdนบทบังคับ (Mandatory) ซึ่งเปdนพันธะที่รัฐตFองปฏิบัติ
โดยหลีกเลี่ยงไมYไดF กับสYวนที่เปdนขFอแนะนำ (Recommendation) ซึ่งไมYเปdนพันธะแกYรัฐ แตYเปdนขFอแนะนำ
กฎเกณฑoของอนุสัญญา หากรัฐเห็นวYาเหมาะสมก็นำไปออกดำเนินการภายใตFกฎหมายของตนก็ไดF
การไมYปฏิบัติตามอนุสัญญาที่ตนใหFการยอมรับไมYมีการลงโทษตYอประเทศแตYอยYางใด แตYอาจ
เปdนอุปสรรคทางการคFาหรือการประกอบธุรกิจระหวYางประเทศไดF เชYน การสรFางมาตรการกีดกันทางการคFา
การปรับใชFมาตรการที่เขFมงวด เปdนตFน

๕.๑ อำนาจทางกฎหมายของรัฐ คือ เปdนอธิปไตยของรัฐในการออกกฎหมาย การบังคับใชF
กฎหมาย (Law Enforcement) โดยวิธกี ารกำกับ ควบคุม ตรวจสอบการปฏิบัติใหFเปdนไปตามบทบัญญัตขิ อง
กฎหมาย และอำนาจลงโทษผูFฝgาฝhนกฎหมาย
๕.๒ เรือเดินทะเลระหวYางประเทศเปdนพาหนะที่ใชFเดินทางทางทะเล ซึ่งมีการเดินเขFาไปและ
ออกมาจากทYาเรือของประเทศตYาง ๆ จึงมีกฎหมายที่เรือตFองปฏิบัตทิ ั้งที่เปdนกฎหมายของรัฐ กฎหมายระหวYาง
ประเทศ

๕.๓.๑ อำนาจทางกฎหมายในฐานะรัฐเจFาของธง (Flag State Jurisdiction)

ตัวอยYางกฎหมายไทย
พระราชบัญญัติการเดินเรือในนYานน้ำไทย พ.ศ. ๒๔๕๖ มาตรา ๑๖๐ วรรค ๔ เมื่อเจFาทYา
ตรวจพบวYาเรือตYางประเทศที่เขFามาในเขตทYาเรือของประเทศไทยมีอุปกรณoและเครื่องใชFประจำเรือไมYถูกตFอง
หรือไมYอยูYในสภาพที่ใชFการไดFตามใบสำคัญตามที่กำหนดในกฎขFอบังคับสำหรับการตรวจเรือตามมาตรา ๑๖๓
ใหFเจFาทYามีอำนาจออกคำสั่งเปdนหนังสือใหFนายเรือแกFไขใหFถูกตFองเสียกYอน เมื่อเห็นวYาถูกตFองแลFวจึงจะอนุญาต
ใหFออกเรือไดF
๖. การปฏิบัติตามอนุสัญญาระหวYางประเทศ
Port State Control (PSC) is the inspection of foreign ships in other national ports by PSC officers (inspectors) for
the purpose of verifying that the competency of the master and officers on board, and the condition of the ship and its
equipment comply with the requirements of international conventions (e.g. SOLAS, ...

Port State jurisdiction refers to the power of a State to enforce rules and prosecute violations occurring within the
jurisdiction of the port State. Many of the IMO conventions and a few ILO conventions include provisions giving rise to port
State jurisdiction. The powers of the port State include inspection of certificates, inspection of the ship and in some cases
detention of the ship.
9 IMO Model Course
The “no more favourable treatment” clause, mentioned in objective 4.6.1.1 provides that State parties are under
the obligation to apply the relevant convention in the same manner to foreign ships flying the flag of a State which is not a

party as to ships sailing under the flag of a State Party to the convention. The result is that ships flying the flags of non-
party States will have to comply with the standards of those conventions when calling at ports of a State party.
10 IMO conventions
The majority of conventions adopted under the auspices of IMO or for which the Organization is otherwise
responsible, fall into three main categories.
The first group is concerned with maritime safety; the second with the prevention of marine pollution; and the
third with liability and compensation, especially in relation to damage caused by pollution. Outside these major groupings
are a number of other conventions dealing with facilitation, tonnage measurement, unlawful acts against shipping and
salvage, etc.
