AN ORDINANCE MANDATING THE CREATION OF THE BARANGAY TOURISM


COUNCILS IN THE 22 BARANGAYS OF THE MUNICIPALITY OF SABLAYAN AND
DEFINING ITS IMPLEMENTING GUIDELINES

WHEREAS, in accordance with RA 9593, commonly referred to as the Tourism Act


of 2009, the State recognizes tourism as an indispensable cornerstone of the
national economy. Acknowledged as an industry of paramount national interest
and significance, tourism is deemed a vital catalyst for socio-economic
advancement and cultural validation. Its potential to stimulate investment,
cultivate foreign exchange reserves, and foster employment underscores its pivotal
role in encouraging the collective sense of national pride among all Filipinos;

WHEREAS, in adherence to Republic Act No. 7160, more commonly recognized as


the Local Government Code of 1991, Local Government Units (LGUs) are mandated
to formulate, adopt, execute, and oversee their respective local tourism programs;

WHEREAS, in accordance with the NIPAS (National Integrated Protected Areas


System) Act, the Municipality of Sablayan recognizes the significance of preserving
and safeguarding its natural resources, particularly those within designated
protected areas, as integral components of sustainable tourism development and
environmental conservation efforts;

WHEREAS, pursuant to the provisions of Local Government Code 389, the


Municipality of Sablayan acknowledges the importance of fostering the
development of diverse tourism products and gastronomy offerings, thereby
enriching the tourism experience for visitors and promoting local economic growth;

WHEREAS, the Municipality of Sablayan recognizes the imperative to optimize its


tourism potential and enrich visitor experiences to foster socio-economic growth
and empower local communities. This entails adhering to the foundational principle
of sustainable tourism development while concurrently enhancing the quality of life
for its residents;

WHEREAS, alongside nationwide endeavors to promote the tourism industry,


Sablayan Municipality pledges to develop its local tourist spots, explore potential
areas for development, and utilize all available resources to enhance tourism in this
part of the Province;

WHEREAS, the program for tourism development in Sablayan covers government


and non-government organizations' participation in all related activities;

WHEREAS, the Municipal Tourism Council serves as a guiding force and support
mechanism for the Barangay Tourism Councils, providing strategic direction,
technical expertise, and coordination in the formulation and execution of tourism
development plans, projects, and activities at the barangay level;

WHEREAS, the establishment of Barangay Tourism Councils is essential for the


Municipality of Sablayan to effectively harness its tourism potential, identify

tourism opportunities, coordinate local efforts, and promote sustainable


development initiatives at the grassroots level.

NOW THEREFORE, be it ordained by the Sangguniang Bayan of the Municipality


of Sablayan, in a regular session assembled that:

SECTION 1. Title. This ordinance shall be known as "AN ORDINANCE


MANDATING THE CREATION OF THE BARANGAY TOURISM COUNCILS IN THE 22
BARANGAYS OF THE MUNICIPALITY OF SABLAYAN AND DEFINING ITS
IMPLEMENTING GUIDELINES"

SECTION 2. Declaration of Policy. The Municipality of Sablayan affirms its


commitment to reinforce and boost the tourism sector by instituting Barangay
Tourism Councils across all barangays. These councils are legally mandated to
cultivate and proficiently oversee the tourism potential and resources within their
respective domains.

SECTION 3. Creation of Barangay Tourism Council

There shall be created a Barangay Tourism Council in each barangay of the


Municipality of Sablayan, to be composed of the following members:

a) The Barangay Captain, serving as the Chairperson;


b) The Chairperson of the Sangguniang Barangay Committee on Tourism,
acting as the Co-Chairperson;
c) A representative from tourism-related organizations operating within the
barangay;
d) A representative from the business sector;
e) A representative from the Academe;
f) A Youth representative or SK Chairperson;
g) A Religious sector representative;
h) Leaders within the community;
i) A representative from the Transport Sector;
j) A representative from Home Owners’ Associations or the Accommodations
Sector;
k) A representative from the Food and Beverage Association;
l) A representative from the Tour Guide’s Association;
m) A representative from the Farm Tourism Association;
n) A representative from the Travel and Tours sector;
o) A representative from a Non-Governmental Organization (NGO).

These members shall collectively form the Barangay Tourism Council,


dedicated to advancing tourism initiatives and development within their
respective barangays.

SECTION 4. Definition of Terms

For the purpose of this ordinance, the following terms shall be defined as follows:
a) Barangay – refers to the barangay within the jurisdiction of the Municipality
of Sablayan.
b) Barangay Captain – refers to the elected head of the barangay, responsible
for the overall administration and governance of the barangay.
c) Barangay Tourism Council (BTC) – refers to the council established in each
barangay to work towards the development and management of tourism
potential and resources within their respective areas.
d) Development Fund – refers to funds allocated by LGUs for various
development projects and initiatives aimed at improving the quality of life
and promoting economic growth within their jurisdiction.
e) Implementing Rules and Regulations (IRR) – refers to the detailed guidelines
and procedures issued to effectively implement and enforce laws or
ordinances.
f) Leaders within the community – refers to Influential individuals or
community leaders within the barangay who contribute their knowledge,
experience, and insights to the tourism council's activities.
g) Local Government Units (LGUs)- Administrative entities at the local level,
responsible for governing specific geographical areas such as municipalities,
cities, provinces, and barangays.
h) Municipality – refers to the Municipality of Sablayan.
i) Religious sector representative – refers to a delegate from religious
organizations or institutions within the barangay, contributing to
discussions and initiatives related to tourism from a religious perspective.
j) Representative from the Academe – refers to a member of the educational
community within the barangay, typically from schools or academic
institutions, providing insights and expertise related to tourism and related
fields.
k) Representative from the business sector – refers to a delegate representing
commercial entities and enterprises operating within the barangay,
particularly those engaged in tourism-related businesses.
l) Representative from the Farm Tourism Association – refers to a member
representing agricultural or farm tourism initiatives and organizations
within the barangay, focusing on agricultural tourism development and
promotion.
m) Representative from the Food and Beverage Association – refers to a member
from associations or businesses involved in food and beverage services
within the barangay, contributing to discussions on culinary tourism and
related matters.
n) Representative from Home Owners’ Associations or the Accommodations
Sector – refers to a delegate representing homeowners' associations or
entities involved in providing accommodations, such as hotels, resorts, or
homestays.
o) Representative from a Non-Governmental Organization (NGO) – refers to a
member from non-profit organizations operating within the barangay,

contributing to sustainable tourism development and community


engagement initiatives.
p) Representative from the Transport Sector – refers to a representative from
transportation-related businesses or services within the barangay, offering
expertise on transportation issues and infrastructure relevant to tourism.
q) Representative from the Travel and Tours sector – refers to a delegate from
travel agencies, tour operators, or related businesses within the barangay,
offering expertise on travel services and tour packages.
r) Representative from the Tour Guide’s Association – refers to a delegate from
associations or individuals engaged in providing tour guide services within
the barangay, offering expertise and insights on tourism guiding and
management.
s) Representative from tourism-related organizations operating within the
barangay – refers to a delegate from local associations, clubs, or groups
involved in tourism-related activities within the barangay.
t) Representative from the Transport Sector – refers to the representative from
transportation-related businesses or services within the barangay, offering
expertise on transportation issues and infrastructure relevant to tourism.
u) Sangguniang Barangay Committee on Tourism- A committee within the
barangay council focused on addressing tourism-related issues and
implementing tourism initiatives at the barangay level.
v) Sangguniang Barangay – refers to the legislative body of a barangay,
responsible for creating ordinances and resolutions for local governance.
w) Sangguniang Kabataan (SK) – refers to the youth council of a barangay,
composed of elected youth representatives tasked with addressing youth-
related concerns and implementing programs and projects for the youth
sector.
x) Sustainable Tourism Development – refers to the practice of promoting
tourism that maximizes benefits to local communities, preserves natural
resources, and respects cultural heritage while minimizing negative impacts.
y) Tourism Industry – refers to the business activity of attracting,
accommodating and entertaining tourists.
z) Tourism Product – refers to the combination of goods and services demanded
by tourists during travel and their stay at a destination, including
attractions, accommodations, transportation, and activities.
aa) Tourist Visitor Center- is a place where people can find information about the
place where the visitor center is located. It is generally used by people who are
on vacation or holiday so they can learn about things to do and see.
bb)One Entry Policy- refers to the policy of the municipal government that all
tours and or visit to the tourist attractions/spots in the Municipality of
Sablayan shall be coordinated to the LGU via the Tourist Visitor Center.

SECTION 5. Functions of the Barangay Tourism Council

The Barangay Tourism Council shall have the following functions:


a) Identify and develop potential tourist destinations, tourism beautification
and resources within the barangay.

b) Manage Barangay tourist destination areas, including but not limited to


covered courts, museums, parks, and playgrounds.
c) Facilitate the collection and dissemination of information on tourism-related
matters within the barangay such as barangay facts, figures, and marketing
materials to attract visitors/ Provide assistance and support for tourism-
related initiatives and activities within the barangay.
d) Design, organize and execute appropriate marketing activities/programs and
events to promote tourism locally.
e) Formulate and recommend policies to enhance tourism within the barangay.
f) Coordinate and collaborate with the Municipal Tourism Office to implement
tourism programs and projects, and actively participate in municipal
tourism activities.
g) Monitor and evaluate the effectiveness of tourism programs and projects
within the barangay.
h) Prepare a comprehensive Tourism Development Plan for the Barangay.
i) Perform any other functions as provided by law or competent authority.

SECTION 6. Meetings and Quorum

The Barangay Tourism Council shall meet at least once every quarter or as often as
necessary. A quorum shall be composed of a majority of its members.

SECTION 7. Budget and Funding

To provide a backbone to all municipal tourism programs and projects, there shall
be created a Council on Tourism in every Barangay in the Municipality of Sablayan.
Each Barangay shall be encouraged to allocate sufficient funding or at least five (5)
percent of the 20% Development Fund from their Annual Internal Revenue
Allotment Share. Additional funds may be sourced from donations, sponsorships or
grants.

SECTION 8. Implementing Rules and Regulations

The Municipal Tourism Office, in coordination with the Barangay Tourism


Councils, shall promulgate the necessary implementing rules and regulations of
this ordinance to ensure its effective implementation.

SECTION 9. Repealing Clause

Any ordinances, rules, regulations, or parts thereof inconsistent with this Barangay
Tourism Council ordinance are hereby repealed or modified accordingly.

SECTION 10. Separability Clause

If any provision or part of this ordinance is declared invalid or unconstitutional, the


remaining provisions or parts thereof shall remain in full force and effect.

SECTION 11. Effectivity

This ordinance shall take effect upon its approval and publication in the official
newspaper of the Municipality.

We hereby certify the correctness of the foregoing ordinance consisting of seven (7)
pages including this page.
