2 Kebebasan

3.6.2.1 Kebebasan Diri

● Tiada warganegara pun boleh diambil nyawanya atau dilucutkan kebebasan


dirinya kecuali menurut undang-undang.
● Seseorang warganegara tidak boleh ditahan oleh pihak polis lebih 24 jam
kecuali setelah dibawa ke hadapan seorang majistret untuk mendapat
perintah tahanan.
● Seseorang warganegara yang ditangkap oleh pihak polis hendaklah
diberitahu tentang sebab-sebab dia ditangkap dengan seberapa segera yang
boleh bagi membolehkannya berunding dengan peguam yang dipilihnya dan
dibela oleh peguam tersebut.
● Jika seseorang warganegara itu ditangkap dengan tidak mengikut undang-
undang, dia boleh memohon habeas corpus daripada mahkamah untuk
membebaskan dirinya.
3.6.2.2 KEABDIAN DAN KERJA PAKSA
DILARANG
● Tiada mana-mana warganegara pun yang boleh ditahan
sebagai abdi.
● Segala jenis kerja paksa dilarang tetapi Parlimen boleh
dengan kuasa undang-undangnya membuat peruntukan
bagi tujuan perkhidmatan kerahan tenaga bagi maksud
negara.
● Kerja atau khidmat yang dikehendaki ke atas orang bersalah
mengikut mahkamah tidak dikira kerja paksa.
3.6.2.3 PERLINDUNGAN DARIPADA UNDANG-UNDANG
JENAYAH YANG BERKUAT KUASA KEBELAKANGAN DAN
PERBICARAAN BERULANG
● Tiada warganegara yang boleh dihukum jika perbuatan Itu
tidak menjadi kesalahan di Sisi undang-undang semasa
perbuatan itu dilakukan.
● Seseorang warganegara yang telah dibebaskan atau
disabitkan dengan sesuatu kesalahan tidak boleh

● Semua warganegara adalah sama rata di sisi


undang – undang. Oleh itu, mereka berhak untuk
mendapat perlindungan yang sama rata di sisi
undang – undang.
● Seseorang warganegara tidak boleh
diskriminasikan daripada aspek agama, kaum,
keturunan, atau tempat lahir.
3.6.2.4 Larangan Buang Negeri dan Bergerak

● Tiada warganegara yang boleh dibuang


negeri atau ditahan daripada memasuki
