PARENTAL AUTHORITY

ARTICLE 209: PURSUANT TO THE NATURAL RIGHT AND DUTY OF


PARENTS OVER THE PERSON AND PROPERTY OF THEIR
UNEMANCIPATED CHILDREN, PARENTAL AUTHORITY AND
RESPONSIBILITY SHALL INCLUDE THE CARING FOR AND REARING
THEM FOR CIVIC CONSCIOUSNESS AND EFFICIENCY AND THE
DEVELOPMENT OF THEIR MORAL, MENTAL AND PHYSICAL
CHARACTER AND WELL BEING.
ARTICLE 220:
THE PARENTS AND THOSE EXERCISING PARENTAL AUTHORITY
SHALL HAVE THE FOLLOWING RIGHTS AND DUTIES:

SECTION 5. PRINCIPLES OF SHARED GOVERNANCE


A. Shared governance is a principle which recognizes that every
unit in the education bureaucracy has a particular role, task
and responsibility inherent in the office and for which it is
principally accountable for outcomes;
(b)   The process of democratic consultation shall be observed in
the decision-making process at appropriate levels. Feedback
mechanisms shall be established to ensure coordination and
open communication of the central office with the regional,
division and school levels;
(c)  
The principles of accountability and transparency shall be
operationalized in the performance of functions and
responsibilities at all levels; and

(d)   The communication channels of field offices shall be


strengthened to facilitate flow of information and expand
linkages with other government agencies, local government units
and nongovernmental organizations for effective governance;
Art. 77. Parent-Teacher Associations. – Every elementary and
secondary school shall organize a parent-teacher association for
the purpose of providing a forum for the discussion of problems
and their solutions, relating to the total school program, and for
insuring the full cooperation of parents in the efficient
implementation of such program. All parents who have children
enrolled in a school are encouraged to be active members of its
PTA, and to comply with whatever obligations and
responsibilities such membership entails.

Guidelines for the Conduct of Elections of the Parents Teachers


Associations at the School level and their federations
DEPED ORDER NO. 117 S. 2009

1.The Parents-Teachers Associations (PTAs) are encouraged to involve


all stakeholders in the schools to ensure effective implementation of
responsive programs, projects and activities. The pupils and students,
being the ultimate beneficiaries of the PTAs, should be engaged in
matters that affect them. Pupils and students, as part of their holistic
school learning and experience, should also be exposed to actual
exercises of their civic duty in a participatory democracy and practice
which is one of the key attributes in the institution of the Parents-
Teachers Associations in the schools.
2. The cooperative partnership between the PTA and school-based pupil and
student organizations should also be fostered in order to teach the pupils and
students various lessons in good leadership, good citizenship, transparency and
accountability, the same values being practiced by the PTA as an organization.
3. Pupil and student participation in the Parents-Teachers Associations is essential
to strengthen channels of communication and consultative mechanism in the
operations of the organization since all programs and projects of the PTA are
concentrated to the development of the school for the benefit of the pupils and
students.
II. What is a PTA? (Sec. 2 & 3)

 A dynamic school-based organization that:


1. provides a forum for the discussion of learner-related
issues and resolutions relative to the school program;
2. ensures the full cooperation of parents/guardians in
efficiently implementing school programs;
3. ensures the active participation of teachers and other
school personnel towards a n environment of continuous
school improvement;
4. promotes school-home-community partnership for the
interest of the learners; and
5. adheres to all policies and guidelines of DepEd.

 A PTA shall NOT be used for political activity and


shall NOT engage in partisan politics in whatever
form.

II. Membership in a PTA (Sec. 8)

1. Membership shall be limited to:


a) Parents (or parent-members), or in their absen ce, the
guardians (or guardian-members) of duly enrolled learners
b) Teachers (or teacher-members), particularly Homeroom
Advisers in the case of HPTA.
(Teacher-members include teaching a n d non-teaching
personnel in a basic education school, whether public
or private.)

2. Legally appointed guardians may also hold a position in


the
Homeroom, Grade Level, School PTAs and/or Federated PTAs.

3. Membership in a PTA shall not be restricted by the non-


payment of the PTA membership dues, which shall be purely
on a voluntary basis.

4. A teacher-member elected as a member of the B O D shall not


be elected as a n officer, exceptO F as

5. The school head shall only serve as adviser to the SPTA.

6. A teacher-member with a child enrolled in the school where


he/she is assigned may only participate in HPTA, GrPTA, and
SPTA-BOD as a parent/guardian-member and may not be
elected as Officer except as Secretary of the HPTA.

7. In case suc h teacher-member ha s a child in another school,


he/she may be elected to any position in the HPTA except as a
President, Vice-President, or Treasurer.

8. A school head may be elected as a PTA officer of another


school where his/her child is enrolled, except for the positions
of S PTA-BO D Chairperson, Vice-Chairperson, or Treasurer.

NB The FPTA-BOD may elect between five (5) to fifteen (15) BOD members:
Provided that, the S D S shall specify the number of B O D members to be elected

II. Terms of Office of PTA Officers
1. One (1) year from date of election/appointment but not to exceed two
(2) consecutive terms. (Sec. 11.5.2)

2. In case of a fortuitous event or force majeure where conducting PTA


election per Section 10.6 is not possible, the existing officers shall
continue to hold over their respective offices or positions until a new
set of officers has been elected and qualified. (Sec. 11.5.3)

3. PTA officers in a hold-over capacity from the previous S Y (SY 2019-


2020/2020-2021) are allowed to stay and serve to the succeeding S Y
(SY 2020-2021/2021-2022) due to COV ID-1 9 pandemic. Remedial or
stop-gap measures to address election challenges adopted by the
school heads, S D S s , or R D s are hereby deemed recognized to the
extent that these are not violative of existing laws, rules, and
regulations on the matter. Their tenure shall continue until a new set
of PTA officers are elected and qualified. (Sec. 37) For concerns, refer
to Section 36 of D O 13, s. 2022 for resolution.
