Marikina City;
CELIA C. RIGONAN, of legal age, Filipino, single and residing at 92-C East 12th Ave., 5th St. Grace Park,
Kaloocan City;

ALEJANDRO C. RIGONAN III, of legal age, Filipino, married and residing at 62 Sisa St. Acacia, Malabon
City;

DULCE C. RIGONAN, of legal age, Filipino, single and residing at 92-C East 12th Ave., 5th St. Grace Park,
Kaloocan City;

RANDI RIGONAN, of legal age, Filipino, single and residing at 92-B, East, 12th Ave. 5th St. Grace Park,
Kaloocan City; and

JOSELITO R. DE LA CRUZ, of legal age, Filipino, single and residing at 92-B, East, 12th Ave. 5th St. Grace
Park, Kaloocan City, having been duly sworn in accordanc with law, hereby depose and state that:

1. We are the siblings and/or representative of the siblings of the CARMELITA RIGONAN, whose
name appears in the Transfer Certificate of Title No. 85274;

2. We are a party to a purported sale annotated in the Transfer Certificate of Title No. 85274, to
wit: “Entry No. 4197/T-85274 for Sale of Unsegregated Portion executed by Carmelita C.
Rigonan in favor of RUBEN C. RIGONAN, married to Gloria Cabigan, resident of 1811 UP Bliss,
Diliman, Quezon City; REMEDIOS C. RIGONAN, married to Nicolas Zacarias, resident of 9 Capt.
Sindo St. Jesus Dela Peña, Marikina City; CELIA C. RIGONAN, single, resident of 92-C East 12th
Ave., 5th St. Grace Park, Kaloocan City; ALEJANDRO C. RIGONAN III, married to Remedios Deonon
resident of 62 Sisa St. Acacia, Malabon City; DULCE C. RIGONAN, single, resident of 92-C East
12th Ave., 5th St. Grace Park, Kaloocan City; RANDI RIGONAN, single, resident of 92-B, East, 12th
Ave. 5th St. Grace Park, Kaloocan City; and JOSELITO R. DE LA CRUZ, single, resident of 92-B, East,
12th Ave. 5th St. Grace Park, Kaloocan City, all of legal age, Filipinos, Affecting 420 SQ. M. of the
property herein described for the sum of P900,000.00, title to be issued to the venue upon
approval of the corresponding subd. plan and technical description by the Commissioner of the
Land Registration. (Doc. No. 251, Page No. 52, Book No. XXVIII, S-1994, of the Not. Pub. of
Regalado P. Castillo. Date of Instrument – Sept. 5, 1994; Date of Inscription – Sept. 9, 1994”;
 3. The said Sale of the Unsegregated Portion purported to be executed by us was simulated and
fictitious since our signatures therein were secured through fraud;

4. We hereby acknowledged that the said Sale of the Unsegregated Portion is NULL AND VOID for
being simulated and fictitious;

5. We hereby further acknowledge the full and absolute ownership of CARMELITA RIGONAN over
the real property covered by Transfer Certificate of Title No. 85274 with a total land area of five
hundred seventy three square meters and twenty decimeters (573.20) located at Pinahan,
Central, Quezon City;

6. We hereby further WAIVED, QUIT OUR CLAIMS AND RELINQUISH WHATEVER RIGHTS we might
have over the said parcel of land in favour CARMELITA RIGONAN;

7. We execute this affidavit to the truth of the foregoing and for whatever legal purpose this may
lawfully serve.
