EXTRA-JUDICIAL SETTLEMENT OF ESTATE

OF LEONCIO ABANA (WITH WAIVER OF RIGHTS)

KNOW ALL MEN BY THESE PRESENTS:

We, (a) PELAGIA A. PAMITTAN, AMANDO A. ABANA SR., and ROSEMARIE A.

ABANA, all of legal age, Filipinos, residents of Gammad, Iguig, Cagayan and the known direct
and compulsory heirs of Francisco Abana Sr., (b) DOMINGA B. ACOSTA, of legal age,
Filipino, resident of Gammad, Iguig, Cagayan and the representative of the Heirs of Conchita
Abana Banatao, (c) OSCAR ABANA, of legal age, Filipino and a resident of Gammad, Iguig,
Cagayan, (d) EDMUNDO ABANA, of legal age, Filipino, and a resident of Gammad, Iguig,
Cagayan, (d) SIEMON ABANA, of legal age, Filipino and a resident of Gammad, Iguig,
Cagayan, on our own volition, declare as follows:

1. That we are the legitimate and direct heirs of the deceased LEONCIO ABANA who died
on ______________ at Iguig, Cagayan;

2. That said deceased died intestate, without any Last Will or Testament, and without any
outstanding debts or accounts;

3. That the deceased left a certain unregistered parcel of land, more particularly described as
follows:
ORIGINAL CERTIFICATE OF TITLE NO. ________

“A parcel of land known as Lot 406, Pls-601, containing an area of One

Thousand Five Hundred Fifteen (1, 515) square meters, more or less, (exclusive
of barangay road) located at Barrio of Gammad, Municipality of Iguig, Province
Cagayan.”

4. That the above-described parcel of land is not tenanted and does not come within the
operation of the Comprehensive Agrarian Reform Program;

5. That pursuant to Section 1 of Rule 74 of the Revised Rules of Court of the Philippines, and
both being with full capacity to contract, we do hereby adjudicate unto ourselves the land
described above, pro-indiviso, in the following manner:

5.1 HEIRS OF FRANCISCO ABANA SR. -with an area of 303 square meters (101
square meters for each of PELAGIA A. PAMITTAN, AMANDO A. ABANA SR.,
and ROSEMARIE A. ABANA);
5.2 HEIRS OF CONCHITA A. BANATAO -with an area of 303 square meters;
5.3 OSCAR ABANA -with an area of 303 square meters;
5.4 EDMUNDO ABANA -with an area of 303 square meters; and
5.5 SIMEON ABANA -with an area of 303 square meters.

-and WITNESSETH FURTHER-

WAIVER

6. That further, I, AMANDO A. ABANA SR., for and in consideration of my love and
affection, hereby WAIVE my undivided share of the aforementioned subject property as heir
of Francisco Abana Sr., in favor of Amando Abana Jr., his heirs and assigns, all my rights,
interests and participation over the above property consisting of 101 square meters:

7. That further, we, EDMUNDO ABANA and SIMEON ABANA, for and in consideration of
our love and affection, hereby WAIVE our respective aforementioned undivided shares of
the subject property, in favor of and unto Legorio P. Abana and Sonny P. Abana; and

 Jerome Abana, respectively, their heirs and assigns, all our rights, interests and
participation over the subject property, in the following manner:

7.1 Edmundo Abana in favor of:

- Legorio P. Abana -151.5 square meters;
- Sonny P. Abana -151.5 square meters;

7.2 Simeon Abana

- Jerome P. Abana -303 square meters;

8. That we, Amando Abana Jr., Legorio P. Abana, Sonny P. Abana and Jerome Abana, the
aforementioned transferees signify our acceptance of the waiver made to us through our
respective signatures below.

IN WITNESS WHEREOF, we have hereunto set our hands, this ________________-, at

Tuguegarao City, Cagayan, Philippines.
