INTRODUCTION
The following report is an assessment of an application for a Construction Certificate (CC).
The proposed development is the construction of an in ground swimming pool, and has the required
Development Consent. The plans and specifications demonstrate compliance with the consent.
The application for Building approval has been assessed against the relevant legislative requirements
being the Environmental Planning and Assessment Act 1979, the Environmental Planning and
Assessment Regulations 2000, the Home Building Act 1989, the Swimming pools Act 1992, and the
Swimming Pools Regulations 2008.
The construction of the swimming pool has been assessed for compliance with the Building Code of
Australia, the NCC-BCA.
A site inspection has been carried out and documented.

SUMMARY OF FINDINGS
An assessment has been carried out on the proposed development being an in ground swimming
pool of concrete construction.
The proposed development has the required Development Consent, and the plans and design of the
swimming pool will comply with the conditions of the consent.
The plans and specifications demonstrate a satisfactory level of compliance with the Swimming
Pools Act 1992 and Swimming Pools Regulation 2008 and the Building Code of Australia, the NCC-
BCA Deemed to Satisfy pathway AS1926 parts 1, 2 & 3 to issue a Construction Certificate, subject to
inspections.
A site inspection has been carried out and its findings documented and supporting of the Building
Approval.
An approval is required from Albury City Environment and Waste Department, regarding the
connection of sewer and water.
An application form has been submitted along with the required plans, specifications and
documentation. The required Building Approval fee has been payed. A payment has been made to
the Long Service Levy Corporation and a Home Building Compensation Fund insurance policy has
been taken out for the build.

PAYMENT OF LONG SERVICE LEVY


Payment of Long Service Levy is required if the cost of the build is over $25,000. A payment has been
made to the Long Service Corporation.

HOME BUILDING COMPENSATION FUND


Home Warrant Insurance is required if the cost of the build is over $20,000. An insurance policy has
been taken out for the build.

COMPLIANE WITH THE RELEVANT CONDITIONS OF CONSENT


Condition 1: The plans and specifications are consistent with the approved Development Application
design plans.
Condition 2: A dilapidation report has been undertaken and submitted along with the required
security bond payment.
Condition 3: The site plan demonstrates compliance with the waste management plan and sediment
and erosion control measures.
Condition 4: The design demonstrates compliance with the Swimming Pools Act and Regulations.
The design demonstrates compliance with AS1926.1, AS1926.2, AS1926.3 and the NCC-BCA.
Condition 5: An internal referral and approval is required from Albury City Councils Environment and
Waste Department regarding the sewer connection.
Prescribed conditions: The plans, specifications and the Building approval application demonstrate
compliance with S98 and S98B. S98A and S98E will be required once the CC application has been
determined and if and when issued.

SWIMMIMG POOLS ACT 1992 AND
SWIMMIMG POOL REGULATION 2008
Part 2 Division 1 of the Swimming Pools Act 1992 states that the swimming pool must be surrounded
by a child restraint barrier that separates the swimming pool from any residential building situated
on the premises and from any place adjoining the premises and that the child restraint barrier is
designed, constructed, installed and maintained in accordance with the standards prescribed by the
regulations.
Part 2 Division 1 of the Swimming Pools Regulation 2008 states that the prescribed standards in
which a child restraint barrier is to be designed, constructed, installed and maintained are the
standards set out in the BCA.
Child restraint barrier location requirements are diagrams located in Schedule 1 of the Swimming
Pools Act 1992 and/or AS1926.2
The proposed swimming pool demonstrates compliance with the above provisions, subject to a final
inspection.

requires that a barrier must be provided to a swimming pool and must a) be continuous for the full
extent of the hazard; and b) be of a strength and rigidity to withstand the foreseeable impact of
people; and c) restrict the access of young children to the pool and the immediate pool surrounds;
and d) have any gates and doors fitted with latching devices not readily operated by young children,
and constructed to automatically close and latch.
Performance requirement 2.5.4; requires that a swimming pool water reticulation system must
incorporate safety measures to avoid entrapment of, or injury to a person.
Part 3.9.3 Swimming Pools of the BCA; the Performance Requirement for a) P2.5.3 is satisfied if it
has safety barriers installed in accordance with AS1926.1and AS1926.2, including windows and doors
leading into the pool from the dwelling and b) P2.5.4 is satisfied if it has a water reticulation system
that complies with AS1926.3.
The plans and specifications demonstrate a satisfactory level of compliance with the above
Performance requirements, subject to a final inspection of the safety barrier and reticulation system.

RECOMMENDATION
It is recommended that a Construction Certificate be granted subject to the conditions outlined in
the approved Development Application being DA 16/0001 and any Council Local Laws which may
affect the development.
