1. Formal Relationship between Pancasila and the 1945 Constitution

• The formulation of Pancasila as the State Foundation of the Republic of Indonesia is stated in the
Preamble of the 1945 Constitution, especially in paragraph 4 which is the core of the Preamble to
the 1945 Constitution.

• The preamble to the 1945 Constitution is the Principle of Fundamental State Principles and has 2
positions, namely as the basis of Indonesian law as well as as the highest legal order.

• Apart from serving as the Mukadimah (introduction), the Preamble to the 1945 Constitution has a
different function and position from its articles. The preamble to the 1945 Constitution with
Pancasila as its core, in fact, does not depend on the body of the 1945 Constitution but instead
becomes the source.

• Pancasila as the Fundamental Principles of the State is also the basis for the survival of the life of
Indonesia.

• Pancasila is the core of the Preamble to the 1945 Constitution which has a strong, permanent,
immutable, and inherent position in the life of the Republic of Indonesia.

2. Material Relationship between Pancasila and the 1945 Constitution

• Based on the historical chronology, Pancasila material was formulated first as the basis of the state
in BPUPKI meetings. After that, it was followed by the Preamble of the 1945 Constitution. Thus, the
Preamble of the 1945 Constitution is the highest legal order in Indonesia, while Pancasila is the
source of legal order itself.

• The preamble to the 1945 Constitution is the Principle of Fundamental State Principles with
Pancasila as its core.
