Dear Sir,

Reference is made to your letter No. 5130-34/PD/EHV I dated August 06, 2020, enclosing
Mis MREC (Pvt.) Ltd. letter No. MRECIT.N (R3)-IC-PHASE-Il/2020/144 dated August 04,
2020, vide which you have sought our comments pertaining to the subject matter.

It is normal practice that in every river crossing, closure of relevant gates and preparation of
access to tower locations have to be made as per site situations. However our para-wise
comments are given as under:

Point No.1:

Contractor mobilized 1st piling crew at T#286, about 56 days (wasted time) later than release of
tower locations after tower staking in field. Piling crew concreted T#286 and waited for 10 days
to shift at T# 284/285, as ramp preparation was in progress. A small patch of access was
prepared during the execution of piling & pile cap/tie beam at T#284/285. Please note that
highest water flow was faced during concreting of last pile of T#282/283 on April 15, 2018 and
not as Contractor is relating with T#284/285.

Executive Engineer Irrigation, Mr. Ghulam Rasool and his staff cooperated well for timely
closure of gates as they were requested. Hence this point is not valid.

Point No.2 & 3:

As claimed by the Contractor: 'Once all gates were got closed, we were then able to make the
foundations of Towers 277/278 to 286'.

T# 277/278, 279, 280/281 and T#286 are located in river bed but on dry land. Closing of gates
was not required or practiced during execution of construction activities at these towers. As these
tower locations are lying in river bed, so this area is affected only in highest water flow or flood
season. It may please be noted that T#284/285 and 282/283 are falling in main creek.

This piling crew concreted T# 284/285 from February 28, 2018 to March 20, 2018. M/s MREC
(Pvt.) Ltd. didn't deploy pile cap/tie beam crew despite our instructions. Please refer NESPAK-
BARQAAB JV Letter No. 32171l69/NA/0 1/3161 dated April 02, 2018. Contractor wasted dry
season and hence this point is not valid.

Point No.4:

• Tower erection was to be started on November 16, 2017 as per contract schedule but
practically I st tower T#264 was erected on October 12, 2018 after almost one year delay.
Pile cap/Tie beam ofT#284/285 was completed on December 31,2018.

• M/s MREC (Pvt.) Ltd. started tower erection in low water season but they didn't
prioritize the erection ofT#282/283 & 284/285 and hence they wasted dry season. Please
note that the Contractor erected five (05) towers T# 273/274, 326, 220, 219 & 327 of
same tower type/make up as ofT#284/285, on January 07, 2019, January 14,2019, April
07,2019, April 15,2019 and May 15, 2019, respectively, but did not erect T# 284/285.

• Mis MREC (Pvt.) Ltd. also wasted time from September 20,2019 to December 01,2019
as NTDC issued short tower material on September 20, 2019 and the Contractor
mobilized erection crew at site on December 0 I, 2019 resulting in delay on their part.

• It is further added that even after delayed shifting of tower material by the Contractor,
they had a golden opportunity to erect T#284/285 but they erected T# 197 and 282/283
(dry location) instead, resulting in wastage of dry season.

Project Manager NESPAK personally visited site ofT#284/285 and advised Contractor that they
had wasted a lot of time (especially dry seasons) which is totally on his part .He further
instructed the Contractor to make special arrangements for erection of T#284/285 instead of the
conventional ways as all delay was on their part.

•In a meeting held on January 29, 2020 in WAPDA House Lahore, Mis MREC (Pvt.) Ltd.
committed to erect T# 284/285 by February 20, 2020 and submitted undertaking in this
regard as well.
• In a meeting held on March 06, 2020, Mis MREC (Pvt.) Ltd. committed to erect
T#284/285 by the end of March 2020.
In this regard our correspondence with Contractor is given as under.

Hence, point is not valid.

Point No.5 & 6:

Mis MREC (Pvt.) Ltd. attempted the erection of T#284/285 in highest water flow season as
elaborated in above detailed descriptions. They tried to prepare access from March 15, 2020 to
March 16, 2020 by digging and using mudlsand from the river with the help of excavator (No
gunny bags were used at all, as claimed by the Mis MREC (Pvt.) Ltd.), but failed. Then due to
high pressure of water on gates, gates were opened by the Irrigation Department.

Likewise, there was a second attempt to prepare access in the same way on April 28, 2020 and
April 29, 2020 by digging and using mud from river with the help of excavator which was totally
useless and due to high water flow, attempt failed.

Point No.7 is valid.

Point No.8, 9 & 10

Mis MREC (Pvt.) Ltd. shifted tower erection crew at site on July 10,2020, started tower erection
of T# 284/285 on July 12, 2020 by engaging boats and other relevant arrangements. Tower
erection was completed on July 28, 2020. Tower erection crew was experienced and worked
efficiently. Safety measures were also properly adopted.

Please note that on completion of tower erection of T#284/285 on July 28, 2020, Jin Pole was
removed, main joints and other components of tower were roughly tightened. However, inside
braces of tower were to be installed after removal of Jin pole. Labour left for Eid holidays on
July 28, 2020. Tower tightening crew arrived late at site after EID Holidays, completed
tightening of tower on September 02, 2020 and tower inspection was carried out on September
03, 2020. Mis MREC (Pvt.) Ltd. stated that tightening inspection by NESPAK was awaited,
which is a complete misstatement.

In light of the foregoing, it can easily be concluded that Mis MREC (Pvt) Ltd. wasted three (03)
dry seasons; 2018, 2019 & 2020 to erect T#284/285 and all delay in this regard is on its account.
As per aforesaid facts, Contractor's claim for the variation order is unjustified.
