Form 1-B – MEMORANDUM OF AGREEMENT


KNOW ALL MEN BY THESE PRESENTS:

Saint Augustine Institute, Incorporated, a corporation and an educational institution duly


organized, recognized and existing under the laws of the Philippines, with principal office at Ipil,
Gigaquit, Surigao del Norte, Philippines, represented herein by its Principal: Mr. Nickson E. Buctuan,
herein referred to as the EMPLOYER, and AIZELLE S. OINAL, Filipino of legal age, single/married,
and a resident of Purok – Magbabaol, San Isidro, Gigaquit, Surigao del Norte herein referred to as the
EMPLOYEE.
WITNESSETH

TERMS OF AGREEMENT

OBLIGATIONS OF THE EMPLOYER

1. Saint Augustine Institute, Incorporated, through its Principal as representative binds itself to:
a) provide employment to AIZELLE S. OINAL in the capacity as ( / ) full time/ ( ) part
time teacher/employee from the month of July 1 to the month of April 30 .
b) pay the teacher/employee according to what is stipulated in the letter of appointment;
c) pay the teacher/employee at the fifteenth and end of each month.
d) notify the teacher/employee at least one (1) month before the end of the specified time of
the contract, whether to renew the contract or not, unless sooner terminated by
either party for just cause.

OBLIGATIONS OF THE TEACHER/EMPLOYEE:


1. The teacher/employee or party of the second part binds himself/herself to:
a) be bound by the agreement during the entire duration of the contract unless terminated for
just cause or causes;
b) be available in the school campus Monday through Friday, and even through Saturday
and Sunday for those when the exigencies of the service demand;
c) teach the normal load stated in the letter of appointment
d) undertake all responsibilities relative to her job description as stipulated in the
employee’s handbook
e) assume other responsibilities that are delegated by the Director/Principal or his/her
representative;
f) meet the deadline for the submission of the reportorial requirements;
g) attend all faculty meetings, convocations, religious activities and other official activities
as required by the Director/Principal or his/her representative;
h) consider himself/herself as in the service of the school for the period indicated above (1-
A) and such may be called upon to the service when necessary.
i) update his/her personnel file at the office of the Principal;
j) notify the Principal in writing in case of absence;
k) notify the Principal or his/her representative in writing at least two months before the
expiration of this contract for any change of plans for the next school year, unless
sooner terminated by either party for just causes.
2. It is understood that, unless specifically permitted in writing by the Principal, the teacher/employee
shall not take other employment or take further studies that might be detrimental to the delivery
of his/her services during the period indicated above (1-A).
3. If a teacher/employee under contract, takes other employment or takes further studies without the
written permission by the Principal or terminates this contract before the end of its term, he/she
shall be liable to pay the employer the following amount:
a) If he/she has signed a one (1) year employment contract, he/she has to pay Fifty
Thousand Pesos (=P=50,000.00) for violating the contract or terminating it
before the end of its term.
b) If he/she has signed a two (2) year employment contract, he/she has to pay Eighty
Thousand Pesos (=P=80,000.00) if the contract violation or termination
occurred during the first year of the contract; and Forty Thousand Pesos
(=P=40,000.00) if the above-stipulated contract violation or termination
happened in the second year or the last year of a 2-year employment contract.
c) If he/she has signed a three (3) year employment contract, he/she has to pay One Hundred
Five Thousand Pesos (=P=105,000.00) if the violation or termination occurred
during the first year of the contract; Seventy Thousand Pesos
(=P=70,000.00) if the violation or termination occurred in the second year
of the contract; and Thirty Five Thousand Pesos (=P=35,000.00) if the
violation or termination
occurred in the third or last year of a 3-year employment contract.
4. It is understood further that the teacher/employee shall exercise his/her professional duties in
accordance with the avowed vision, mission, core values, objectives and aims of the institution,
its policies and peculiar spirit.
5. If there shall be salary increases, it shall be based on the school’s salary scale and on the employee’s
efficiency and qualification, as well as on the fund’s availability.
6. In case of unjust violation of this agreement, the erring party shall be liable for any damages.

TERMINATION OF THE CONTRACT:

The following are just causes for terminating this contract by either the Employer or the
Teacher/Employee.

BY THE EMPLOYER:
a) the closing or cessation of the school and considerable decrease in enrolment;
b) serious misconduct or willful disobedience by the teacher/employee of the orders of
his/her employer or of his/her representative in connection with his/her work; the
school considers notoriously disgraceful or immoral the premarital sex, the extra-marital
relationships and a relationship with the same sex;
c) gross and habitual neglect of duty or gross inefficiency and incompetence of the
teacher/employee;
d) fraud or willful breach by the teacher/employee of the trust reposed in him/her by
his/her employer or his/her representatives;
e) gross violation of rules and regulations of the school and commission of a crime
involving moral turpitude and such offenses committed by the employee as immorality,
dishonesty, drunkenness, assaulting a teacher or any other school authority or
students, instigating or tampering with school records or forms;
f) grave emotional disturbances on the part of the teacher/employee which in the judgment
of the employer or his/her representatives could bring damage to the students and the
school in general;
g) frequent tardiness, absence, and undertime; teacher/employee is entitled to one week
sick leave and one week emergency leave or ten working days with pay, subject to the
approval of the Principal and any excess to this will mean a deduction from the
salary on the principle of “No Work, No Pay.”

BY THE TEACHER/EMPLOYEE:
a) serious insult by the employer or his/her representative on the honor or person of the
teacher/employee;
b) oppressive treatment accorded by the employer or his/her representative against the
person of the teacher/employee or any of the immediate members of the family;
c) failure to pay salaries on time;
d) other causes analogous to the foregoing;
e) gross violation of the terms and condition of employment;
f) restraining and coercing the teacher/employee in the exercise of her rights as
guaranteed by the Constitution.

OTHER CONDITIONS:

The term of employment from 2021 to 2026 contained in the letter of appointment shall be
considered part and parcel of this agreement.

In witness whereof, the parties hereunto sign this document/contract this 9th day of September,
2021 at Saint Augustine Institute, Gigaquit Surigao del Norte, Philippines.
