AN ORDINANCE MANDATING ALL PASSENGERS WITHOUT NEGATIVE RT PCR OR ANTIGEN SWAB TEST RESULTS TO
UNDERGO MANDATORY ANTIGEN SWAB TESING, FOR A FEE, UPON ARRIVAL AT ANY POINT OF ENTRY OF THE CITY
OF MASBATE AS PART OF THE ITS HEALTH ASSESSMENT TO CURB THE CONTINUOUS RISE OF NUMBER OF COVID-19
CASES WITHIN ITS TERRITORIAL JURISDICTION

WHEREAS, pursuant to the declaration of a public health emergency due to Corona Virus Infectious Disease-2019 (COVID-19),
President Rodrigo R. Duterte has imposed strict health protocols measures;

WHEREAS, the City of Masbate Inter-Agency Task Force for the Management of Emerging Infectious Disease (City-IATF) convened
last April 7, 2021 at the 2 nd Floor CHO Building, City Hall Compound, for an emergency meeting to discuss measures to

counter the alarming increase of COVID-19 cases within the City of Masbate;
WHEREAS, the rapid increase of active cases may be attributed to the relaxing of protocols for all returnees and travelers going in and
out of the City;
WHEREAS, in order to curb the accelerating cases of COVID-19, the City-IATF deemed it necessary to establish protocols for all
arriving passengers within any point of entry of the City, in accordance with the existing laws, rules and regulations;
WHEREAS, the City Government of Masbate is mandated by the Local Government Code of 1991 to promote and protect the health
and safety of their constituents within their jurisdictions;
WHEREAS, with the foregoing, there is a need to require all arriving passengers at any point of entry of the City of Masbate to undergo
a mandatory antigen swab testing if no negative RT PCR or Antigen Swab Test result is presented to the authorized
personnel of the City Government prior to its entry in the City as part of its health assessment to curb the continuous
increase of COVID-19 cases in the City;

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of Masbate, in session assembled:

SECTION 1. Title. This Ordinance shall be known as the, “Antigen Swab Testing Fee Ordinance of the City of Masbate for
Vice Mayor/Presiding Officer

Arriving Passengers”.

SECTION 2. Applicability. This Ordinance shall apply to all passengers arriving, and will be staying, or having business in the
City, coming from any point of entry of the City of Masbate, without a negative RT-PCR or Antigen Swab
Results.

SECTION 3. Definition of Terms. The following terms shall mean as:


a. Passenger - refers to person arriving, and will be staying, or having business in the City, coming from any
point of entry of the City of Masbate, specifically LSI’s, Returning Patients and Tourists, as defined under
this Ordinance.
b. Locally Stranded Individuals (LSIs) – shall mean foreign nationals or Filipino citizens (e.g. construction and
domestic works, students, among other) in specific locality within the Philippines who have expressed intention
to return to their place of residence/home origin.
c. Returning Patients – refers to individual seeking medical attention outside the Province of Masbate,
including his/her maximum of two (2) companion.
d. Authorized Person Outside Residence (APOR)
i. Non-Essential Private APOR – refers to sector that does not belong to essential services (e.g.

entertainment and leisure, sales of furniture and appliances and among others )
ii. Essential APOR – refers to sector belonging to essential services (e.g. food and groceries deliveries,

medical deliveries and services, sectors such as electric power plant, water, mining and the-like ).
iii. Government APOR – refers to all officers and employees of the National and Local Government
Unit/Agencies, including the uniformed and law-enforcement personnel.

e. Tourist – a person who is travelling or visiting the City of Masbate for leisure and for other tourism-related
activities.

SECTION 4. Imposition of Antigen Swab Testing Fee. Failure of the person arriving, and will be staying, or having business in

the City, coming from any point of entry of the City of Masbate to present a valid negative result of Antigen Swab
Test or RT-PCR upon arrival, he/she shall undergo a Rapid Antigen Swab Test in the amount of:

PASSENGER FEE
a) LSI, Returning Patient, or Tourist Php 500.00
b) Government APOR Exempted (Not required, but if opted to
undergo the test, an amount of Php 500.00
shall be paid)
c) Essential APOR Exempted
d) Non-Essential APOR Exempted PROVIDED that a valid negative
swab test result is presented, OTHERWISE
shall undergo swab testing at any
recognized/accredited testing center within
the City of Masbate.
e)Senior Citizen, PWD, or Student Php 400.00
f) Passenger with valid Certificate of Indigency Free

SECTION 5. Validity. A negative result of the Antigen or RT-PCR Swab Test taken by the person arriving in the City of

Masbate shall be valid only if the test has been conducted within three (3) days prior to their arrival in the City.

SECTION 6. Prohibited Acts. The following shall constitute prohibited acts under this Ordinance:
a. Except for persons bearing a valid negative Antigen or RT-PCR COVID-19 swab test result, it shall be
prohibited for any person staying or conducting business in the City of Masbate to refuse to undergo the
mandatory Antigen Swab Testing upon their arrival.
b. It shall be prohibited for any person to submit to the City of Masbate a falsified COVID-19 test result.

SECTION 7. Duties of the City of Masbate Disaster Risk & Reduction Management Office (CDRRMO). The City of Masbate
Disaster Risk & Reduction Management Office (CDRRMO), in close coordination with the City of Masbate Inter-
Agency Task Force (CIATF), City Health Office, and the City Treasurer’s Office, being the office tasked in the

implementation of this Ordinance shall:

a) provide the Antigen Swab Test Fee matrix as prepared and certified by the Secretary to the
Sanggunian;
b) provide the City of Masbate’s protocols for all arriving passengers coming from the outside of the
Province of Masbate, subject to the existing laws, rules and regulations; and
c) ensure proper information and dissemination in the City of Masbate.

SECTION 8. Enforcement. This Ordinance shall be implemented by the City of Masbate Disaster Risk & Reduction
Management Office (CDRRMO), in close coordination with the City of Masbate Inter-Agency Task Force
(CIATF), City Health Office, and the City Treasurer’s Office.

SECTION 9. Penalty. The following shall constitute the penalties for the prohibited acts as provided in this Ordinance:
a. For those not bearing a valid negative Antigen or RT-PCR COVID swab test result who refuse to
undergo the mandatory Antigen Swab Testing upon arrival in the City of Masbate, the penalty shall be
denial of entry to the territorial jurisdiction of the City.
b. For person falsifying their COVID-19 test results, a fine of Five Thousand Pesos (Php 5,000.00) per
instance, or imprisonment of not less than one (1) month but not more than six (6) months, or both, at

the discretion of the court.

SECTION 10. Separability Clause. If any part of this Ordinance is declared unconstitutional or invalid, such parts or provisions
thereof not so declared shall remain valid and subsisting.

SECTION 11. Effectivity. This Ordinance shall take effect immediately, and shall continue in effect only during the
