COMMENDING THE LOCAL WATER UTILITIES ADMINISTRATION (LWUA) ACTING ADMINISTRATOR, HON. JECI
A. LAPUS FOR ITS IMMEDIATE ACTION ON THE APPEAL OF THE CITY GOVERNMENT OF MASBATE OF THE
MASBATE-MOBO WATER DISTRICT (MMWD) ISSUES

WHEREAS, Section 3 (b), Title I of Presidential Decree No. 198 or otherwise known as the Provincial Water Utilities
Act of 1973, as amended provides that the person empowered to appoint the members of the board of
Directors of a local water district will depend on the geographic coverage and population make-up of
the particular district. In the event that more than seventy-five percent (75%) of the total active water
service connections of a local water district are within the boundary of any city or municipality, the
appointing authority shall be the mayor of that city or municipality, as the case may be;

WHEREAS, if portions of more than one province are included within the boundary of the district, the appointing
authority shall be the governor of the province within which the district is located; and the appointing
authority is to be the governors then the power to appoint shall rotate between the governors involved
with the initial appointments made by the governor in whose province the greatest number of service
connections exists.

WHEREAS, MMWD does not involve more than one province and therefore the appointing authority is the Mayor of
the City of Masbate;

WHEREAS, as to who should be the appointing authority for the members of the MMWD Board of Directors has
been raised and appealed by the City Government of Masbate to LWUA for its final resolution;

WHEREAS, the City of Masbate comprises of eighty-two (82%) percent of the total active number of water service
connections of MMWD as of July 2016 as compared to only eighteen (18%) percent of the Municipality
of Mobo, Masbate;

WHEREAS, the City of Masbate has the required more than seventy-five percent (75%) of the total active service
connections which therefore legally confers the power to appoint the members of the MMWD Board of
Directors to the Mayor of the City of Masbate;

WHEREAS, by virtue of this resolution, legally confers the power to appoint the members of the MMWD Board of
Directors to the Mayor of the City of Masbate;

WHEREAS, on motion of Hon. Andrei B. Diez Sr., duly seconded and concurred in by all the members present, BE
IT:

RESOLVED, as it is hereby resolved, to commend the Local Water Utilities Administration (LWUA) Acting
Administrator, Hon. Jeci A. Lapus for its immediate action on the appeal of the City Government of
Masbate of the Masbate-Mobo Water District (MMWD) issues;

RESOLVED FINALLY, to furnish copy of this resolution to the MMWD Board of Directors, Interim Board of Directors of
MMWD, Office of the Provincial Governor, Office of the Acting LWUA Administrator, Office of the City
Mayor and all concerned for their information and appropriate action.
