That on January 10, 2021 at about 2:00 in the afternoon Maria Garcia Dela Cruz, 29 years old,
single, nurse, residing at Brgy. Santiago, Marcos, Ilocos Norte accompanied her sister Maricar Dela Cruz
Madrid, 25 years old, married, teacher residing at Brgy. Santiago, Marcos Ilocos Norte appeared at this
office and reported that Maricar Dela Cruz Madrid was allegedly forced by her husband Marco Tila
Madrid, 27 years old, married farmer residing at Brgy. Santiago, Marcos, Ilocos Norte to have sexual
intercourse against her will. The victim suffered from constipation at that time due to her monthly
period. According to the complainant, incidents took place at their residence at about 9:00 in the
evening of January 9, 2021 while the victim was having a rest his husband laid beside him and initiated
sexual intercourse. She was forced by his husband and further averred that she has been abused
sexually by her husband under the influence of liquor. Investigation-On-Case Police Captain Frances

2. On January 10, 2021 at about 2:00 in the afternoon Maria Garcia Dela Cruz, 29 years old,
single, nurse, residing at Brgy. Santiago, Marcos, Ilocos Norte accompanied her sister Maricar Dela Cruz
Madrid, 25 years old, married, teacher residing at Brgy. Santiago, Marcos Ilocos Norte appeared at this
office and reported that Maricar Dela Cruz Madrid was allegedly forced by her husband Marco Tila
Madrid, 27 years old, married farmer residing at Brgy. Santiago, Marcos, Ilocos Norte to have sexual
intercourse against her will.

3. Initial investigation disclosed at around 8:00 in the evening on January 9, 2021, the suspect
was having a drinking session with his companion at Mariano Store located at Brgy. Santiago, Marcos,
Ilocos Norte. The suspect went home at around 9:00 in the evening under the influence of liquor. The
suspect went to their bedroom. He laid beside he victim and intimately kissed the victim at its neck. The
suspect initiated sexual intercourse with the victim wherein she was at rest with constipation due to her
monthly period at that time. The suspect forcefully grasped the private body part of the victim and
intentionally forced the victim by means of his physical strength. The suspect tore away the victim’s
clothing. She tried to get up and stop the suspect and begged him but the suspect forcefully initiated the
sexual intercourse. The suspect abused the victim sexually.

detained at Ilocos Norte Provincial Jail. Investigation is terminated
