BAC RESOLUTION DECLARING FAILURE OF BIDDING RESORTING TO NEGOTIATED

PROCUREMENT
RESOLUTION NO. 12-135 s. 2021

WHEREAS, the Department of Education (DepEd) through the Schools Division Office (SDO)
of Romblon posted the Invitation to Bid (ITB) for the Procurement of Supplies for the School Based-
Feeding Program (SBFP) for SY 2021-2022 Lot 2 and Lot 3 with an Approved Budget for the Contract
(ABC) amounting to Two Million Nine Hundred Sixty-Six Thousand Six Hundred Eighty-Eight
Pesos (Php 2, 966, 688.00) in the Philippine Government Electronic Procurement System (Phil-GEPS)
and lobby of _______, _________ Provincial Capitol and ________ Municipal Hall on October 9, 2021;

WHEREAS, an Opening of Bid was conducted by the Bids and Awards Committee (BAC) on
November 5, 2021;

WHEREAS, no bidder submitted bids for the said project thus, the Bid and Awards
Committee direct the BAC Secretariat to repost the Invitation to Bid (ITB);

WHEREAS, the Department of Education (DepEd) through the Schools Division Office (SDO)
of ___________ reposted the Invitation to Bid (ITB) for the Procurement of Supplies for the School
Based-Feeding Program (SBFP) for SY 2021-2022 Lot 2 and Lot 3 with an Approved Budget for the
Contract (ABC) amounting to Two Million Nine Hundred Sixty-Six Thousand Six Hundred Eighty-
Eight Pesos (Php 2, 966, 688.00) in the Philippine Government Electronic Procurement System (Phil-
GEPS) and lobby of SDO _______, _______Provincial Capitol and _______ Municipal Hall on
November 29, 2021;

WHEREAS, an Opening of Bid was conducted by the Bids and Awards Committee (BAC) on
December 20, 2021;

WHEREAS, no bidder submitted bids for the said project thus, the Bid and Awards
Committee declared 2nd failure of bidding;

NOW, THEREFORE, in consideration of the foregoing premises, we, the members of the Bids
and Awards Committee, hereby RESOLVE, as it is hereby RESOLVED:
a. to declare 2nd failure of bidding pursuant to the provisions stated in the RA 9184,
Implementing Rules and regulation under Section 35.1. a “No bids are received”;
b. to resort to negotiated procurement per RA 9184 Section 35.5.
c. to proceed on reposting of project in the Phil-GEPS and other conspicuous places for seven
(7) calendar days.
