For EACH action:
Specific legal arguments: 100 to 150 words
Likelihood AND severity: 75 to 150 words
How effective the action is likely to be in controlling the risk: 100 to 150 words

Moral, general legal and financial arguments for ALL actions

Moral, general legal and financial MORAL ARGUMENT:

arguments
Tagros chemicals India Ltd has a moral duty to provide and protect safe workplace & environment
to workers from work related hazards. Because it has the potential to cause ill and health related
injuries to workers. Our organisation’s moral is to keep all workers healthy and in safe manner,
because employees working in the company to earn money and wages for their needs in life.
Tagros chemicals doesn’t want any workers to keep their life on risk, because incidents may likely
to have impact on employees and their family. The mental health of other workers also affected due
to these incidents.

GENERAL LEGAL ARGUMENT:

If Tagros Chemicals does not follow legal standards, there is chance of government or regulatory
body to give notice of probation stopping all work-related activities or they may give some time
period to improve legal standards. These legal actions can cause damage to Tagros Chemicals
reputation and also make huge loss to the organisation, business development can also be
affected.
Any breaching of health and safety legislation is usually a criminal offence might lead to:
• Formal enforcement action,
• Prosecution of organisation in criminal courts,
• Prosecution of individuals, workers.

Learner number: 00652283. Learner name: Ananda Badmanaban. Page 17 of 25

FINANCIAL ARGUMENT:
Normally any accidents and serious ill, affects the financial resources of any company and at times
this can put the organization out of business. Finance is focussing on money which a company
doesn’t like to loss. but once an accident happened and faced, the company has to loss the money
1. Direct loss:
• Workers sick pay,
• Treatment, etc.
2. Indirect loss:
• Loss of production,
• Loss of goodwill etc. in parallel to a person life.
Company will give insurance card to all workers. And when accidents happen, few losses include
1. Insured cost:
• Compensation,
• Medical cost etc.
2. Uninsured cost:
• Accident investigation time,
• Criminal & legal fines etc.

Justification for action 1

Action HAZARD CATEGORY: FIRE

For continuous monitoring of chlorine gas and operation, CCTV cameras, water sprinkler, fire alarm
to be installed and continuously monitored.

Specific legal arguments The ILO sets out an Occupational Safety and Health Recommendation, 1981 (R164) that
supplements convection (C155). Part IV of the Recommendation states that undertaking
(organisation) must:

Learner number: 00652283. Learner name: Ananda Badmanaban. Page 18 of 25

• “To provide and maintain workplace, machinery and equipment, and use work methods,
which are as safe and without risk to health as is reasonably practicable”.
The chlorine yard is a storage of huge quantity of liquid chlorine, if the fire happens it explodes
enormously with the combination of ammonia. The ILO codes of practise gives specific advice on
the measures that employees must to protect workers against risk identified by a risk assessment.
Due to this incident legal enforcement action can be taken by people on Tagros chemicals, which
affects organisation reputation and financial loss due to punishment in form of penalties.

Consideration of likelihood AND severity LIKELIHOOD:

The likelihood fire incident on chlorine storage is very likely, because Tagros chemicals has a
chlorine storage yard capacity of 20 tonnes. Weather condition such as high heat may cause
temperature raise of sulphur leads to fire incident and accident. Likelihood is considered as rare,
unlikely, possible, likely and very likely.
SEVERITY:
The severity of the risk could be ‘major’ because, huge fire may happen on the chlorine yard and
uncontrollable. Due to the inhalation of chlorine gas, it causes Burning pain, redness, and blisters
on the skin if exposed to gas. Health injuries similar to throat, eyes, coughing and burning sensation
in the nose. The impacts of incidents considered as negligeable, minor, moderate, major and
severe.
• Negligible - No medical treatment,
• Minor - Objective but reversible disability,
• Moderate - Irreversible disability,
• Major - Single fatality or severe irreversible disability,
• Severe - Multiple fatalities.

How effective the action is likely to be in

The new control measures are implemented, it will help to put off fire before it spreads more or it
controlling the risk. This should include:

fully control the risk.
• JUSTIFICATION FOR THE TIMESCALE:
I had given a time scale of 1 month because, proper approval from the top management, is
needed and particular funds is to be allotted for buying CCTV cameras, fire sprinkler, fire alarm
system, operational training takes 1 month including fixing on the desired location.
• WHETHER I THINK THE ACTION WILL FULLY CONTROL THE RISK:
By this new control measure, we can control hazard as much as possible. Eliminating &
substitution for chlorine yard is the only method to eliminate hazard.

Justification for action 2

Action HAZARD CATEGORY: WORKING AT HEIGHT

Health check-up, fitness of the person who (working at height) should be examined and give fitness
certificate by the medical in charge in regular interval (7 days once).

Specific legal arguments According to the International Labour Organisation (ILO), Tagros chemicals has moral duty to
provide safe work environment to workers & also make sure that processes are reasonably safe. As
per specific set of regulations – Work at Height Regulations 2005,
• “The person who working at height, health conditions of individual to be monitored”.
Emergency rescue procedure should be readily available. The ILO codes of practice gives specific
advice on the measures, that employers must to protect workers against risks identified by a risk
assessment. Tagros chemicals should compliance with these regulations and standards. Failure to
follow these standards leads to repercussions, including workmen compensation.
Consideration of likelihood AND severity LIKELIHOOD:
The likelihood of incidents caused the work at height is very likely, because Tagros Chemicals has
more columns & tower maintenance works which has a potential to cause injuries to workers. Due

to multiple jobs taken at a time also leads to occurrence of incidents very likely. The likelihood is
considered as rare, unlikely, possible, likely and very likely.

SEVERITY:
The severity of risks occurring could be major. Because if the workers may fall from height it leads
to irreversible disability or fatality and also ends up in repercussions. Impact of incidents considered
as negligible, minor, major, moderate and severe.
• Negligible - No medical treatment,
• Minor - Objective but reversible disability,
• Moderate - Irreversible disability,
• Major - Single fatality or severe irreversible disability,
• Severe - Multiple fatalities.

How effective the action is likely to be in

This health condition of individual monitoring helps Tagros Chemicals to engage a competent
controlling the risk. This should include:
person on work, it controls hazards which can happen, if unhealthy person engaged on work.

fully control the risk.
• JUSTIFICATION FOR THE TIMESCALE:
Timescale given for the action is 1 month because, procedure for health condition monitoring
should be developed, all trained workers who authorized to work at height have to do this medical
examination which is conducted by the medical officer.
• WHETHER I THINK THE ACTION WILL FULLY CONTROL THE RISK:
This health condition monitoring is one of the risk control measures, we have to follow all
other actions along with this, to control the risk or the Tagros Chemicals has to eliminate this kind of
planned activity in the plant to control the risk.

Justification for action 3

Action HAZARD CATEGORY: CONFINED SPACE

Providing personal gas detection systems for the person who entering the confined space and
installed inside the walls of the confined space.

Specific legal arguments As per the approved code of practise on

The Confined Space Regulations 1997, ILO Convention 155 (C155), ILO Recommendation
164 (R 164, Dubai Municipality code of practice chapter 19),
• “All of these laws specify hazards and safety precautions taken in confined space entry. It is
mandatory to monitor workplace by active or passive monitoring system”.
Tagros Chemicals has more confined entry inspection and maintenance activities on vessels, tanks
and columns.
Noncompliance with standards causes danger to workers. Tagros Chemicals has moral duty to
provide safe workplace to workers. The ILO code of practice gives specific advice on the measures
that employees, must to protect workers against risk identified by a risk assessment.
Noncompliance of procedures also leads of injuries or fatality of person. Legal enforcement action
such as prosecution of Tagros Chemicals in criminal courts may happen.

Consideration of likelihood AND severity LIKELIHOOD:

The likelihood of incidents caused by working in confined spaces is likely, because these activities
planned mostly at the showdown period. Tagros Chemicals have more tanks, columns, cooling
tower maintenance works which have a potential to release toxic gas or vapours occurs likely at
any time of job.
The likelihood is considered as rare, unlikely, possible, likely and very likely.

SEVERITY:
The severity of risk occurring could be Major, if workers exposed to toxic gas which may leads to
unexpected incident and accident on workplace with series injuries or disabilities.

Impact of incidents considered as Negligible, Minor, Moderate, Major & Severe.
• Negligible - No medical treatment,
• Minor - Objective but reversible disability,
• Moderate - Irreversible disability,
• Major - Single fatality or severe irreversible disability and
• Severe - Multiple fatalities.

How effective the action is likely to be in

Providing portable personal gas detector is one of the active monitoring methods, it helps workers
controlling the risk. This should include:

fully control the risk.
• JUSTIFICATION FOR THE TIMESCALE:
The timescale given for this action is 3 weeks, because the safety officer has to discuss with
concern department head to procure number of portable gas detectors. Providing training about
how to use while entering into the confined space to prevent risk factors.
• WHETHER I THINK THE ACTION WILL FULLY CONTROL THE RISK:
By providing gas detectors, we can prevent from toxic & poisonous gases inside the
confined space. It is one of the control methods, the workers should follow along with safe system
of work (SSW) procedures and practices to control risks associated with the confined space.
