    EXPLANATION FOR
    THE NOTICE OF DELAY

    To: Ascentia Construction Inc.- CityScape Grand Tower

    FIASMMS Contract Employment and Construction Services are hereby submitting our explanation for the notice of delayed for
    construction work JC-2136 Door Paints.

    When FIASMMS start to engage our scope of work with 30 days’ timeline as reflected in our contract. FIASMMS face some
    construction situation that needs to consider, to wit;

    a) FIASMMS agreed and sign the contract on the date as reflected in the document in good faith, without the other parties
    signatory which in effect there is an absence of the copies to the following document (i.e. JC, NTP, NOA) for one (1)
    week, awaiting this document FIASMMS suffer a delayed since this is a basic requirement to proceed at site, thereto
    FIASMMS halt to commence the work scope.

    b) Despite the absence of mention document, as per site instruction, FIASMMS agreed to proceed and commencing the work
    activities.

    c) FIASMMS appeals to ACI to correct on the slippage of negative -9.7 for this work scope since we have sufficient
    progress for this work scope. As per our latest update, 241 no’s of doors are already painted with 1 st pass for TOPCOAT-
    FINAL out of 370 doors in total, with an average percentage of 65%.

    d) In addition, as per contract this work scope covers only for 8th floor to 18th floor, however as agreed at site 6th floor and 7th
    floor are most priority, addition to the JC for the additional floor has been consider by FIASMMS and ask ACI for
    reconsideration and inclusion.

    e) Site preparation and methodology of workmanship has been observe by FIASMMS considering the avoidance of reworks
    and wasting of painting materials since last and final (TOP COAT-FINISHES) activities for this scope of work shall be
    commence on the final phase, limiting the other adjoining scope work may deface the paint esthetic for doors.

    As above mention explanation, FIASMMS ask and praying for reconsideration of the notice of delayed.
