CONSTRUCTION AGREEMENT

(TO BE PROPOSED)

THIS DEED OF AGREEMENT executed on this -- day of ---


BETWEEN
FULCRUM ENGINEERING CONSULTANCY a company
having its office at N0 4/101,Thandakkara Street, Silattur, Aranthangi,
Pudukkottai Dt- 614622 Represented by its propreitor
Mr.GANDHILAL (cell no 9384224079) S/O.K.S.MOHAN,
hereinafter referred to as the “PARTY OF THE FIRST PART” which
term shall wherever the context so permit mean and include his heirs,
executors, administrators, legal representatives and assigns
AND
MR,V.BALAJI (Aadhaarno:396776893147) (Cell No:9171321980)
Son of Mr. VENGATRAMAN, residing at Door no 8 Gandhi street
,Vivekananda theru,alathur,tiruchirapalli,tn.620011 (HEREINAFTER
referred to as the “PARTY OF THE SECOND PART” Which term shall
wherever the context so permit, mean and include his/her heirs, legal
representatives, executors, administrators, and assigns successors in
interest as the case may be.
WHEREAS the party of the Second part has proposed to
construct a house in plot no 1 described in the Schedule “A” hereunder
and has entered into an agreement with the “PARTY OF THE FIRST
PART”

AND WHEREAS the party of the second part is the absolute


owner for the above said schedule “A” property.
WHEREAS the party of the first part, has accepted to
construct one Residential house admeasuring 1107 Sq., Feet of Super
Plinth Area in GROUND FLOOR and 291 sq., feet of Super Plinth Area
in first floor on behalf of the party of the second part in the above said
“A” schedule property as per drawings attached and specifications
detailed in “B” Schedule.
WHEREAS to construct the said house as per the specification
mentioned in “B” Schedule, and a meeting out incidental expenses, the
party of the second part has agreed to pay a sum of Rs.24,78,000/-
(Rupees Twenty four lakhs and seventy eight thousand only)as per
schedule “C” and agreed to pay the above said sum as per the terms
mentioned in “D” Schedule.
All payments are to be received in the Name of FULCRUM
ENGINEERING CONSULTANCY A/C 38510126591 ifc SBIN138036,
state bank of india, Silattur branch
NOW THE PARTIES DO HEREBY AGREE TO THE FOLLOWING
TERMS AND CONDITIONS:-
1. The Lump sum contract amount for construction of the house,
and other incidental expenses described in the Schedule “C” shall
be Rs. 2000/ ft2 and the above said sum shall be payable in stages
as mentioned in Schedule “D”.
2. The Party of the First Part shall follow and adhere to standards
and specifications described in Schedule “B” in the construction
of the said building.
3. The party of the First part shall provide all materials for
complete execution of the work.
4. The Party of the First part shall engage its own laborers and sub
contractors and they shall be liable for the payment of wages to
laborers and sub contractors etc.,
5. If any GST is leviable in respect of the works contract involved
under this agreement the party of the first Part shall be liable to
pay the same.
6. If the party of the second part fails to pay any one or more
installments in the respective levels set out in Schedule “D” the
party of the Second part will be liable to pay interest on such
delayed payments at the rate of 24% per anum
7. The Party of the First part shall make every endeavor to
complete the construction of the building within 10 months from
the date of this agreement. The Said period shall however be
liable to be extended if such extension is warranted by
extraordinary circumstances such as Natural Calamity or any
unforeseen delay from Government Department like Electricity
Board etc.,
8. The Party of the First part shall not be liable to deliver possession
of the said building to the party of the Second Part unless and
until the party of the Second part shall make entire lump sum
contract amount Sales Tax if any on such work.
9. Minor deviations/alterations from the plan may be made by the
Party of the First Part if it is found necessary during the course of
construction. On account of such alteration, if the Super Plinth
Area is increased or decreased the parties shall be liable to make
necessary adjustment in the payment
10. Both the parties assure to extend mutually a very smooth, cordial
and friendly relationship till the completion of the project. Minor
difference of opinions can be sorted out mutually and amicably.
11. Any dispute regarding difference of opinion arising in
interpretation and meaning of any of the terms of this Agreement
and for enforcing any payment of claim arising under this
agreement shall be referred to an approved arbitrator, who shall
be appointed by the parties hereto by mutual consent.
