‫‪ -2‬إذا اﻗﺘﻀﺖ ﻗﺮارات ﺣﻜﻮﻣﻴﺔ ﺗﻌﺪﻳﻞ أﻧﻈﻤﺔ اﻟﺒﻨﺎء‪ ،‬ﻣﻤﺎ ﻳﻨﺘﺞ ﻋﻨﻪ ﺗﻌﺬر اﺳﺘﺨﺪام اﻟﻮﺣﺪات اﻹﻳﺠﺎرﻳﺔ‪.‬‬

‫‪ -3‬ﻗﻴﺎم اﻟﺪوﻟﺔ ﺑﺘﻤﻠﻚ اﻟﻌﻘﺎر أو ﺟﺰء ﻣﻨﻪ‪ ،‬ﺑﺤﻴﺚ ﻳﺘﻌﺬر اﺳﺘﺨﺪام اﻟﻮﺣﺪات اﻹﻳﺠﺎرﻳﺔ‪.‬‬

‫أو ﺗﻄﺒﻴﻘﻪ ‪ ،‬ﻓﻌﻠﻰ اﻟﻄﺮﻓﻴﻦ ﺣﻠﻪ ﺑﺎﻟﻄﺮق اﻟﻮدﻳﺔ ﺧﻼل ) ‪ ( 15‬ﻳﻮﻣ ًﺎ ﻣﻦ ﻧﺸﻮء اﻟﻨﺰاع وﻓﻲ ﺣﺎل ﻋﺪم اﻟﺘﻮﺻﻞ إﻟﻰ ﺣﻞ أو اﺗﻔﺎق ﺧﻼل ﻫﺬه اﻟﻤﺪة‪ ،‬ﻓﺈن اﻻﺧﺘﺼﺎص ﺑﺘﺴﻮﻳﺔ‬
‫ﻫﺬا اﻟﻨﺰاع ﻳﻨﻌﻘﺪ ل‪:‬‬

‫)‪ (500000‬ﻟﻠﻤﺆﺟﺮ اذا ﻛﺎن اﻟﻔﺴﺦ ﺧﻼل اﻟﺨﻤﺲ ﺳﻨﻮات اﻷوﻟﻰ ‪) .‬ج( دﻓﻊ ﻣﺒﻠﻎ )‪ (700000‬ﻟﻠﻤﺆﺟﺮ اذا ﻛﺎن اﻟﻔﺴﺦ ﺧﻼل اﻟﺨﻤﺲ ﺳﻨﻮات اﻟﺜﺎﻧﻴﺔ ‪ .‬ﻋﻠﻤ ًﺎ أن اﻟﻤﺒﺎﻟﻎ‬
‫اﻟﻤﺬﻛﻮرة ﺑﺎﻟﻔﻘﺮﺗﻴﻦ أﻋﻼه )ب\ج( ﻫﻲ ﻹﻋﺎدة اﻟﻌﻤﺎرة ﻟﺤﺎﻟﺘﻬﺎ اﻟﺴﺎﺑﻘﺔ )ﺷﻘﻖ( وﻟﻴﺲ ﻟﻬﺎ ﻋﻼﻗﺔ ﺑﻤﺒﻠﻎ اﻹﻳﺠﺎر اﻟﺴﻨﻮي ﻓﻲ ﺣﺎل إﺳﺘﺤﻘﺎﻗﺔ‪) .‬د( ﺗﺴﻠﻴﻢ اﻟﻌﻘﺎر ﻟﻠﻤﺆﺟﺮ ﺑﻌﺪ‬
