One of the problems involved in applying treaty as a source of law is that there are many states

in the world that are agreeing to treaties provisions as important piece of State practice.
However, the treaties apply to member states only and leaving out the non-member states. The
confusion arises where the states abides to the customary law and does not abide to the treaty.
Then the difficulty emerges I applying the treaty to member state of customary international law
whereas rejecting the treaty.
