AFFIDAVIT OF PASSENGER

I, MAGDALINA R. SAMONTINA, Filipino citizen, of legal age, married,

and presently residing at Ladgaran, Claver, Surigao del Norte, after having been
duly sworn in accordance with law, hereby depose and say:

1. That on March 2, 2022, together with my daughter, her husband (Larry

Jun S. Escutin, who drive the van) and their child, were bound to Davao
City on board Nissan Van (hereinafter referred as VAN) with Plate No.
NEH 6571 registered in the name MARIE CHRIS S. QUIAMBAO.

2. We were going to Davao City because the Honorable Regional Trial

Court Branch 10, Davao City, ordered my son-in-law to present the
vehicle before its final release from the constructive custody of the
Court.

3. Upon reaching Brgy. Ampayon, my son-in-law decided to stop,

together with my daughter and their child, they disembarked to buy
some medicines, foods and other provisions necessary for their long
travel to Davao City.

4. To my surprise, an unknown person suddenly got inside the VAN and

sat at the second row of the passenger seats.

5. The VAN was then approached by a group of persons who were

known later as LTFRB Apprehending Team, interogated the unknown
person, the latter stating that she was bound for Tagum.

6. The VAN was apprehended without considering the explanation of my

son-in-law and his wife.

7. That my son-in-law never solicited any passenger.

8. That I am executing this affidavit to attest to the truth of the foregoing

facts and to support the Motion for Consideration of the VAN owner
MARIE CHRIS S. QUIAMBAO.

PRAYER

WHEREFORE, foregoing considered, it is respectfully that this Affidavit

shall be considered in the resolution of the Motion for Reconsideration of the
VAN owner.
