Ako si SUSAN ESCUEDA MALAGA, 58 ka tuig ang idad, Filipino, may

asawa, kag pumuloyo sang Zone I Barangay Calumpang, Molo, Ciudad sang
Iloilo, nagasumpa sa idalom sang kasuguan kag nagasaysay sang mga
masunod:

MALAGA. 58 years old and a resident of Zone I Barangay Calumpang, Molo,
Iloilo City, state under oath as follows: )

Preliminary Statement

Ang nagapamankot sa akon sa sining Judicial Affidavit amo si Atty. Rex

Marcus B. Sarabia nga may opisina sa Marañon Sarabia & Cuadras Law
Office sa kalye E. Lopez, Jaro, Ciudad sang Iloilo. Ang mga pamangkutanon
ginhiwat sa opisina ni Atty. Rex Marcus B. Sarabia kag akon ginsabat ang
mga pamangkot sang may pag-intiende nga akon ini ginasumpaan sa idalom
sang kasuguan, nga ini tanan kamatuoran kag puede ako mapriso kon ako
nagabinutig. Ini nga Judicial Affidavit nasulat sa Ilonggo nga tinaga nga may
translasyon sa English. Ang mga pamangkut ginahambal sa akon sa Ilonggo
nga tinaga.

Office at No. 394 E. Lopez Street, Jaro, Iloilo City. The interrogation is being
held at his office and I am answering the questions fully conscious that I do
so under oath and may face criminal liability for false testimony. This Judicial
Affidavit is written in the local Ilonggo dialect with English translation and
the examination is also conducted in the local Ilonggo dialect.)

(Translation: Answer: I am SUSAN ESCUEDA MALAGA, 58 years old and

a resident of Zone I Barangay Calumpang, Molo, Iloilo City.

GELLANGARIN GALVAN, ay mga opisyal sang CALUMPANG 178 PEOPLE’S
ORGANIZATION INC. nga ginorganisar sang mga tinion sang Oktubre 2,
2019. Ang tinutuyo sang ini nga organisasyon ay tani maga represpentar
sang mga informal settlers nga naga okupar sang isa ka duta nga nakilala
bilang Lot 2095-B nga ara sa Barangay Calumpang, Distrito sang Molo,
Siyudad sang Iloilo. Ang ini nga duta may ara sang kalaparon nga FORTY
FOUR THOUSAND ONE HUNDRED FIFTY EIGHT (44,158) SQUARE METERS;
kag gina panag-iya ni RAMON DELA CRUZ. Naka-apid sa ini nga Affidavit
kag na markahan nga ANNEX “A” ay isa ka kopya sang Certificate of
Incorporation sang CALUMPANG 178 PEOPLE’S ORGANIZATION INC. Naka-
apid man diri kag na markahan man nga ANNEX “B” ay isa ka kopya sang
Articles of Incorporation nga kun diin na mensyonar man nga ang mga
Respondent ay mga member kag mga opisyales man sang amo nga
association.

BENDOY, SHIRLEY OBLIDO LASERNA, ELIZABETH DEL ROSARIO REVILLA,
RONA BILLION GALVAN, LARA MABAQUIAO HILAY, FLORDELIZA
GELLANGARIN GALVAN are the officers of CALUMPANG 178 PEOPLE’S
ORGANIZATION INC. that was organized sometime on October 2, 2019.
The purpose of the said organization was supposedly to represent the
informal settlers who are occupants of a parcel of land known as Lot 2095-
B located at Barangay Calumpang Molo, Iloilo City. The said parcel of land
has an area of about FORTY FOUR THOUSAND ONE HUNDRED FIFTY EIGHT
(44,158) SQUARE METERS more or less; and the same is owned by a certain
RAMON DELA CRUZ. Attached hereto and marked as ANNEX “A” is a copy
of the Certificate of Incorporation of CALUMPANG 178 PEOPLE’S
ORGANIZATION INC. and also attached hereto and marked as ANNEX “B”
is a copy of the Articles of Incorporation of the same wherein the
Respondents are mentioned to be members and officers therein.)

PEOPLE’S ORGANIZATION INC sang mga gin hinambitan mo nga mga
Respondent?

respondents in the CALUMPANG 178 PEOPLE’S ORGANIZATION INC?)

S: Oo. Ruben Geminga Niño ay ang ila nga President. Shirley Oblido Laserna
ang ila nga Public Relations Officer. Maricel Bendoy ang ila nga Treasurer.

Elizabeth Del Rosario Revilla ay ang ila nga Auditor. Flordeliza Gellangarin
Galvan ay ang ila nga anay Treasurer while Lara Mabaquiao Hilay ay isa ka
opisyales nga ang iya nga posisyon indi ko madeterminar.

Answer: Yes. Ruben Geminga Niño is the President. Shirley Oblido Laserna
is the Public Relations Officer. Maricel Bendoy is the Treasurer. Elizabeth Del
Rosario Revilla is the Auditor. Flordeliza Gellangarin Galvan is the former
Treasurer while Lara Mabaquiao Hilay is an officer of which exact position I
could not determine.

(Question: You said that CALUMPANG 178 PEOPLE’S ORGANIZATION INC.

was organized by the Respondents to represent the informal settlers of Lot
2095-B located at Barangay Calumpang, Molo, are you one of the informal
settlers as well?)

S: Oo, amo ina kun ngaa nag-sulod man ko sa isa ka transaksyon sa mga
opisyal sang CALUMPANG 178 PEOPLE’S ORGANIZATION INC.

(Answer: Yes, that is why I transacted with the officers of the CALUMPANG
178 PEOPLE’S ORGANIZATION INC.)

6. P: Siling mo ang CALUMPANG 178 PEOPLE’S ORGANIZATION INC. ay gin

organisar sang mga Respondent para maga-representar sang mga informal
settler sang Lot 2095-B nga ara sa Barangay Calumpang, Distrito sang Molo,
ano ang kadamuon sang mga tao ang apektado sang ini nga association?

(Question: You said that CALUMPANG 178 PEOPLE’S ORGANIZATION INC.

was organized by the Respondents to represent the informal settlers of Lot
2095-B located at Barangay Calumpang, Molo, how many people were
involved?)

S: Hindi ako maka hatag sang exakto gid nga bilang pero mga dira sa
doscientos quince (215) ka mga pamilya ang apektado kag na implowensya
sang CALUMPANG 178 PEOPLE’S ORGANIZATION INC.

(Answer: I could not give an exact estimation but there are around two
hundred fifteen (215) families that are involved and are influenced by the
CALUMPANG 178 PEOPLE’S ORGANIZATION INC.)

CALUMPANG 178 PEOPLE’S ORGANIZATION INC.?

(Question: Can you tell me about the transaction you entered with
CALUMPANG 178 PEOPLE’S ORGANIZATION INC.?)

S: Sang mga tinion sang ulihi nga semana sang Agusto 2019, ang mga
opisyal sang CALUMPANG 178 PEOPLE’S ORGANIZATION INC. nagpatawag
sang isa ka meeting upod sa mga informal settler sang Lot 2095-B sang
Barangay Calumpang, Distrito sang Molo. Gin anonsyar nila nga si Ramon
Dela Cruz nga ang tag-iya sang amo nga duta, nagsulod sa isa ka Contract
to Sell upod sa association kag ang mga opisyal nagpa-andam sa amon nga
tanan nga may piligro nga kami nga paga-pahalinon ni Ramon Dela Cruz kag
ang amon nga mga balay amo ang idemolish dayon kun indi kami magupod
sang amon nga mga kaugalingon sa ini nga kontrata. Kag kun indi kami
maka-bayad sang amon nga partial payment sang among nga “Earnest
Money” nga diez porsyento (10%) sang balor sang duta nga gina okupar
namon pag abot sang adlaw nga Setyember 10, 2019 kag ang nagabilin nga
viente porsyento (20%) pag abot sang adlaw nga Desyember 2019, sigurado
kuno nga kami ang paga-halinon.

Gani, sa kakibot kag sa kakulba namon nga kami paga-halinon, kami paagi
sa akon nga anak nga si Mary Joy S. Pelaez, ginsungka sa asosasyon ang
kwarta nga naga balor nga Isa ka Libo nga Pesos (P1,000.00) bilang partial
payment sang amon nga “Earnest Money” sa duta nga amon gina okupar.
Naka-apid kag na markahan man nga ANNEX “C” ay isa ka kopya sang
Company Registration Form sang CALUMPANG 178 PEOPLE’S
ORGANIZATION INC nga naga pamilit nga ang tanan nga mga informal
settler ay magbayad na sang ila nga “Earnest Money” nga ang kasunod sang
Contract to Sell nga gin sulod ni Ramon Dela Cruz.

(Answer: Sometime on the last week of August 2019, the officers of

CALUMPANG 178 PEOPLE’S ORGANIZATION INC. called for a meeting with
all the informal settlers of Lot 2095-B of Barangay Calumpang, Molo. They
announced that Ramon Dela Cruz, the owner of the parcel of land has
entered into a Contract to Sell with the association and the officers warned
all of us that we were in danger of being ejected by Ramon Dela Cruz and
that our houses will immediately be demolished if we do not include
ourselves in the supposed contract. That unless, we pay our partial payment
of our “Earnest Money” which is estimated to be ten percent (10%) of the
total value of the land we individually occupy by September 10, 2019 and
the remaining twenty percent (20%) by December 2019, we will certainly be
ejected from our homes.

Hence, in utter shock and fear of being summarily ejected, we through my

daughter Mary Joy S. Pelaez, surrendered to the association the amount of
One Thousand Pesos (P1,000.00) as partial payment of our “Earnest Money”
for the portion of the lot that we occupy. Attached hereto and marked as
ANNEX “C” is a copy of the Company Registration Form of CALUMPANG 178
PEOPLE’S ORGANIZATION INC that urges all the informal settlers to pay

their “Earnest Money” under the premise of a Contract to Sell with Ramon
Dela Cruz.)

8. P: Naghatag bala ang asosasyon sang insakto nga resibo para sa

pagbayad mo sang “Earnest Money”?

(Translation: Question: Did the association issue you a proper receipt for
your payment of your “earnest money”?)

S: Wala, nag hatag malang sila sang Acknowledgement Receipt pero indi
ang Official Receipt nga may ara sang serial number. Naka-apid man diri kag
namarkahan nga ANNEX “D” ay isa ka kopya sang Acknowledgement
Receipt nga gin permahan ni President Ruben Niño.

(Translation: Answer: They merely issued me an Acknowledgement Receipt

but not the Official Receipt that contains the serial number. Attached hereto
and marked as ANNEX “D” is a copy of the Acknowledgement Receipt
signed by the President Ruben Niño.)

9. P: Ano dayon ang natabo pagkatapos mo gin-sungka ang imo nga kwarta
nga inog bayad mo sang “Earnest Money”?

(Translation: Question: What happened next after you surrendered your

payment that represents your “Earnest Money”?)

S: Nadiskobrehan ko nga wala gali sang gina tawag nila nga Contract to Sell
na ginsulod sang tagiya sang duta nga si Ramon Dela Cruz upod sa
asosasyon nga CALUMPANG 178 PEOPLE’S ORGANIZATION INC. nga naga-
pabalido sang pagkolekta sang “Earnest Money” halin sa mga informal
settler sang Lot 2095-B. Na diskobre ko nga ang mga opisyal sang
asosasyon ay nagkumiter sang Estafa pamaagi sa sala nga pagkuno-kuno
ukon sa gina tawag nga false pretenses, nga may ara kuno sang Contract to
Sell nga gin sulod ni Ramon Dela Cruz upod sa asosasyon, kag paagi sa ina
nga pagpakuno-kuno, naintuan kami nga mga informal settler sa pagkolekta
halin sa amon sang tawag nga “Earnest Money”.

(Translation: Answer: I found-out that there was no such Contract to Sell

that was entered by and between the landowner Ramon Dela Cruz and the
association CALUMPANG 178 PEOPLE’S ORGANIZATION INC. that justified
the collection of the “Earnest Money” from the informal settlers of Lot 2095-
B. I discovered that the officers of the said association committed Estafa
through false pretenses by falsely pretending to have entered into a Contract
to Sell with Ramon Dela Cruz, and through that false pretense, swindled the
informal settlers by collecting from them their “Earnest Money”.)

10. P: Pwede mo masay-say sa akon kun paano mo nadiskubre nga wala

gali sang gina tawag nga Contract to Sell nga ginsulod ni Ramon Dela Cruz
upod sa asosasyon?

(Translation: Question: Can you tell me how you found-out that there was
no such Contract to Sell that was entered by and between the landowner
Ramon Dela Cruz and the association?)

S: Sa mga tinion sang Septembre 14, 2019, si Ramon Dela Cruz pamaagi sa
iya nga abogado nga si Attorney Melwen A. Sustento, nag-palapta sang isa
ka sulat nga naka butang nga si Ramon Dela Cruz wala nagakilala nga may
ara sang pabaligya sang iya nga duta nga nakilala bilang Lot 2095-B. Ang
gin publikar nga sulat ay mabasahan bilang sa masunod:

“Please consider this letter that my client, RAMON S. DE LA

CRUZ, who is the registered owner of Lot No. 2095-B covered by
TCT No. 095-2016004752 located in Calumpang, Molo, Iloilo
City. Any transactions, negotiations or actions which is in the
nature of sale or disposition of his property taken by other
person other than by the undersigned counsel or personally by
the registered owner himself, RAMON S. DE LA CRUZ, SHALL
NOT BE RECOGNIZED NOR IT WILL BE HONORED BY HIM.

Furthermore, considering that there exists proliferated

illegal transactions and negotiations of the alleged disposal of my
client’s property, which eventually result to disturbance among
innocent buyers in your community, the undersigned is
constrained to inform you of my client’s intention, and to allow
him to post in your public bulletin a copy of this letter as the
attached NOTICE.”

Naka-apid mang diri kag na markahan nga ANNEX “E” ay isa ka kopya
sang sulat nga gin publikar ni Atty. Melwen A. Sustento pabor kay Ramon De
La Cruz.

(Translation: Answer: Sometime on September 14, 2019, Ramon Dela Cruz

through his lawyer, Attorney Melwen A. Sustento, distributed to us his letter
that stated that Ramon does not recognize the existence of any sale or
disposition of his property known as Lot 2095-B. The publicized letter reads
as follows:

“Please consider this letter that my client, RAMON S. DE LA

CRUZ, who is the registered owner of Lot No. 2095-B covered by
TCT No. 095-2016004752 located in Calumpang, Molo, Iloilo
City. Any transactions, negotiations or actions which is in the
nature of sale or disposition of his property taken by other
person other than by the undersigned counsel or personally by

the registered owner himself, RAMON S. DE LA CRUZ, SHALL

NOT BE RECOGNIZED NOR IT WILL BE HONORED BY HIM.

Furthermore, considering that there exists proliferated

illegal transactions and negotiations of the alleged disposal of my
client’s property, which eventually result to disturbance among
innocent buyers in your community, the undersigned is
constrained to inform you of my client’s intention, and to allow
him to post in your public bulletin a copy of this letter as the
attached NOTICE.”

Attached hereto and marked as ANNEX “E” is a copy of the publicized letter
by Atty. Melwen A. Sustento in favor of Ramon De La Cruz.

11. P: Bangod nga nadiskobre mo nga wala sang Contract to Sell nga
ginsulod sang asosasyon upod kay Ramon Dela Cruz para sa pagbakal sang
Lot 2095-B, ano dayon ang ginhimo mo?

(Translation: Question: Since you discovered that there was no Contract to

Sell that was entered by and between the association and Ramon De La Cruz
for the purchase of Lot 2095-B, what did you do next?)

S: Nagpangayo ako sa mga opisyal sang asosasyon sang pag-uli sang akon
nga kwarta nga gin-sungka ko sa ila.

(Translation: Answer: I requested the officers of the association to return

my money that was surrendered to them.)

12. P: Pero gin-uli gid man bala sa imo ang kwarta?

(Translation: Question: Did they return your money?)

S: Wala nila gin-uli. Porsigido gid sila nga indi mag-uli sang akon nga
kwarta; bisan pagkatapos ko na pag-serve sa ila sang Demand Letter nga i-
uli lang ang amo nga kwarta. Naka-apid man kag na markahan nga ANNEX
“F” ay isa ka kopya sang amo nga Demand Letter nga ginpadala sa mga
opisyal sang CALUMPANG 178 PEOPLE’S ORGANIZATION INC.

(Translation: Answer: No, they did not. They persistently refused to return
my money; even after I have served them a Demand Letter to return the
same. Attached hereto and marked as ANNEX “F” is a copy of the Demand
Letter sent to the officers of CALUMPANG 178 PEOPLE’S ORGANIZATION
INC.)

GERALDINE CONLU BLANCO ay mga Respondent sa ini nga reklamo. Ano

ang ila nga kahilabtanan sa ini nga reklamo sa Syndicated Estafa?

ROBERTO NIÑO JR. and Calumpang Barangay Secretary HON.
GERALDINE CONLU BLANCO are respondents in this case. What is their
involvement in this Complaint for Syndicated Estafa?)

S: Ang mga Respondent nga si Roberto Niño and Geraldine Blanco ay mga
Principal pamaagi sa Direct Participation bangod sa pagpamahog kag pag-
ipit sang mga informal settler nga magbayad sa asosasyon sang ila nga
“Earnest Money” ilabi na gid kun may pagtinipon-tipon sang mga myembro
nga akon nga gina partisipar sang gin mensyonar ko sa ibabaw, amo man
sila ang tama ka bokal nga dapat kami ang paga-halinon sa amon nga mga
puluy-an okun paga-gub-on ang amon nga mga panimalay kun kami
mapaslawan nga magbayad sang amon nga “Earnest Money” na suno sa
Contract to Sell sang asosasyon upod kay Ramon Dela Cruz. Halin sadto,
tanan nga pagtipon-tipon sang asosasyon nga gin patawag, sila nga duwa
amo man ang ara.

(Translation: Answer: The Respondent Roberto Niño and Geraldine Blanco

were Principals by Direct Participation when they consistently threatened and
pressured the informal settlers to pay to the association their “Earnest
Money”. Especially during the meeting that I attended as mentioned above,
they were the ones who were very vocal that we would be ejected and our
houses would be demolished unless we pay our “Earnest Money” in view of
the Association’s Contract to Sell with Ramon Dela Cruz. Since then, every
meeting which the association called for, the two of them are present.)

16. P: Nakahibalo ikaw kag naintendihan mo nga ginasabat mo ang ining

mga pamangkot sa imo kag ginsumpaan mo ini sa idalom sang kasuguan
kag ikaw puede akusaron, sentensyahan kag prisohon sa sala nga perjury
kag false testimony kon indi matuod ang imo nga ginsaysay.

(Translation: Question: Do you know and understand that your answers to

all the questions stated above are sworn under oath and you can be

accused, sentenced and imprisoned for the crime of perjury and false
testimony if what you stated above is not true.)
