Task 1: The influence of peers

Question 1
The health and safety culture depends on influence, hierarchy and norms of peer group.
In the basic situation under the study, the callous and careless attitude towards health
and safety is noticed. The employer believes that health and safety is not that important
as it is not related to ambitious sales profit. This shows the extreme materialistic mindset,
which has a negative impact on entire organization. The managing director’s oblivious
attitude, for example demonstrates a mutinous interest in health and safety that is
divorced from normal course of business. Similarly, the belief of the head of sales is
extremely unassertive when it comes to deploying health and safety; this has a
aggravating negative impact not only on the subordinates but also on the company. As
from scenario we can see the managing director coordinates only with the head of sales,
strengthening his vocational influence on the experienced working apprentice that also
indirectly promotes his negligence concern for safety culture that seeps down from sales
supervisor to the leadership team and common labour.. Within the same vicinity, a sales
supervisor ignore safety concern by saying that there is no need for safety drills because
the fire risk is low, which is the obnoxious trickle down peer influence of HOS. Secondly
rushing the job because of sales margin shows the influence of the chain is command in
finishing the job at the expense of health and safety. The determination to do right
obligations in the front of peer lobby is one of the most perpetually imbricating
occurrences resulting from peer pressure impact. For example, a senior sales person’s
individual effort in the context of health and safety concerns is noted, but it is dominated
by the negative lobby pressure from subordinates and authorities, illuminating the
complex intricacy of fitting into a corporate culture. One of the unravelled domino effects
of bad viscount influence is witnessed during a travel event by laymen, which was
observed by the sales supervisor, who instead of reporting it chose to ignore it.

Task 2: Emergency procedures

Question 2 (a)
Following are the positive points about fire safety arrangements at the car showroom:
1: There are fire extinguishers on the premises of the showroom.
2: Sales person are more careful about the security precautions in the showroom and are
concerned about their safety. Individually, the salesperson is highly concerned with
safety precautions and keeps track of all work actions in the showroom.

in parking lots are provided. The use of safety signs in the parking lot is just a partial
solution to the demand for workers and visitors to avoid near misses and accidents.
4: In case of emergency, there is a marching point for the workers.
5: (EPR) is also available in the premises of showroom.
6: The post of sales supervisor is replaced by the post of fire marshal.
7: There was an emergency protocol in place.
8: A fire alarm system is also provided in the showroom’s premises area for fire detection.

Question 2 (b)
The negative points about fire safety arrangements at the car showroom are:
1: The workers are not properly trained about using a fire extinguisher also no
supervision for that is available and fire extinguishers are not inspected properly.
2: There is no sign of smoking and there is no smoke detectors alarm system is provided
in the premises of showroom. The alarm system is not installed at appropriate height.
3: The showroom, in particular, is in need of recurring and ongoing safety training to instil
fire related threats. The use and acquisition of foam, chemical, and dry ice based

extinguishing equipment, as well as the training dealing and ramification of the

Question 2 (c)
1: It is important to practice emergency procedure because emergency plan is a detailed
strategegy for dealing with wide range of scenarios. It is important because it teaches
employees how to respond to emergencies without exacerbating the problem. For variety
of reasons, this method is critical.
2: An emergency response process is necessary to avoid workplace fatalitities and
injuries. If we follow the safety method, Workers lives will be saved.
3: Using the ERP system, we can protect our environment and the general public.
4: Life safety is always the first priority in an emergency situation and second is to calm
the situation.
5: there are number of things that may be done to keep a situation under control and
minimise the amount of harm that can be done. With first aid CPR, trained personnel may
save lives.
6: the containment of a small chemical spill, as well as the monitoring of building utilities
and systems, can assist to safeguard the environment and limit building damage.

Task 3: Accident reporting

Question 3 (a)
As a result of the scenario, the sales supervisors noticed the appertice’s slip and trip
incident. He overlooks the situation and shows the rapid neglect instead of compiling the
incident report due to insolence necessity of health and safety attitude. Furthermore,
promoting a culture of health and safety is depressingly destructive. For example, a sales
supervisors was only joking when he said that the risk of fire was relatively minimal,
expect from the movement of a gasoline powered vehicles, and that drills and training
were discouraged. The officials overindulging the incident by concealing it among the
apprentices, but it should have been handled with suitable safety standards, and as a
result the worker has to suffer harm, which jeopardises his ability to do the job.

Along with this, he committed malpractice by misadvising the subordinate to provide a

Question 3 (b)
Employers should have an appropriate incident and accident recording, investigating and
reporting procedures, according to RIDDOR UK regulation (2013) and ILO guidance
document of recording and notification of occupational accident and diseases (1996),
reporting accidents and dangerous occurrences regulations. Some of the ways in which
the employer should report the apprentice’s accident within 24 hours as the victim is
injured are:
Law enforcement agencies and regulatory agencies can all be contacted using the
ONLINE internet reporting forms.
To report the accident to the appropriate authorities, utilise a written report email.
Through a phone call to external authorities within business hours.
Via phone calls or emails to the victims’ relatives and caregivers.

Task 4: The legal reasons for health and safety management

Question 4
Health and safety management in the workshop is legally required for the following
reasons:
Employers and employees both have legal obligations when ot comes to dealing with
health and safety issues. In order to protect others from the danger of anticipated
mishaps, accidents, and Injuries both the employer and the employee must take
reasonable precautions. Compliance with national’s laws and international norms are the
legal ground. It also establishes a foundation and establishes limits, as well as governing
the norms for conducting business at the workplace.
In the Article 16 of the ILO Occupational safety and health convection 1981, C155
employers are outlined certain fundamental general legal obligations towards their
employees.
Employers must manage risk for a variety of legal reasons:
Assuming that a international level auto showroom employ’s a large number of people,
the business is legally accountable for the health and safety of its employees as well as
all visitors. Organization must take substantial measures to ensure a safe workplace for
employees and visitors, according to internaltions authorities such as the ILO.
If a person, whether an inside or outside employee, is seriously injured or dies as a resul
of an unsafe workplace, the company is considered a direct participant in the crime and
will face a slew of penalties.
Organizations are required by law to provide training and information about the
workplace and its hazards, which could serve as the foundation for a serious accident.
In addition, laws require organization to provide sufficient supervision and communication
channels, as well as the freedom to speak openly about harmful situations and conduct.
It also involves avoiding punitive damages. The aim is to bring the guilty to justice.
Monetary fines are one sort of penalty that can be imposed. Individuals are imprisoned.
 Forcing the organization to make their wrongdoing public (such as newspaper pr
trade journals).
Compensation is intended to recompense them for any financial losses, such as:
Earnings lost as a result of the organizations poor reputation.
 Future earnings loss, which may include medical treatment costs.
 Additional compensation for severe injuries and excruciating agony.

Task 5: Workers’ responsibilities in the workplace

Question 5

ILO (International labour organization) imposes some strict obligations upon workers
which are working in large workplaces. In this context, ILO convention C-155 (article-19)
and ILO Recommendation R-164 (article-16) are prominent. Some of the clauses of
above-mentioned conventions and Recommendation, which are contrived according to
the scenario are:
Concern on the violation of ILO convention c-155 (article-19)
 There were signs posted at the showroom prohibiting the use of mobile phone
while driving in the parking lot and test drive area, but the apprentice was
breaking the law of the organization, which was clearly communicated in the form
of signage, according to the situation.(Clause-a).
 According to the scenario, the sales supervisor did not inform upper management
about the apprentice accident. (Clause-c).
 According to the scenario, when a young apprentice fell from a car while listening to
a phone call on his mobile phone, he did not report the incident to his immediate
supervisors, despite the fact that, according to clause-f of convention C-155
(Article-19) he had the responsibility to immediately inform upper management
about any near miss or incident.
Recommendation R-164 of the international labour Oraganization (ILO) has been
violated(Article-16)
 The Worker or employee yelled take care of himself when doing safe job, but
he did not take care of himself while driving while listening to a phone
conversation (clause-a)
 In the scenario, safety signs prohibiting the use of cell phones were shown,
but he ignored the warning about potential risks(clause-b)
 When he slipped and fell on hard concrete, he merely got up quietly and did
not inform his supervisors about mishaps. Workers have a responsibility to
report any dangerous behaviour or situation they or their co-workers see in
the workplace, according to the requirements set by labour law making
authorities (clause-d and e)

Task 6: Near misses

Question 6
The findings of previous near misses investigations will help to prevent such kind
indicator to an accident that, if scrutinized and used correctly, can prevent injuries and
damages. Near misses will be useful in the following ways.
 It can help in determining the incident immediate and core causes. Dangerous
behaviours are unsafe working conditions are the most common causes of
workplace incidents. Once these reasons are recognized, we may take
appropriate corrective and preventative activities to address them as soon as
possible.
 It will assist in the recording of near miss information, the recording of factual proof,
and the improvement of control mechanism.
 The employer has an implied legal responsibility to investigate incident. As a result,
by reviewing near misses, the flaws will be addressed quickly, avoiding any legal
action against auto dealership in the event of accident.
 Investigating near-misses has a negative impact on morale and safety culture
because employees believe the company cares about their safety.
 The investigation will also assist in the updating and revision of the risk assessment
by correcting the flaws and weaknesses.
 Apply the findings of the study to better safety systems, hazards management, risk

reduction, and lessons learned. All of these indicate the availability of training,
performance evaluation, and a commitment to continual development.
 Near misses investigation can be used to discipline workers because their
behaviour has fallen short of the accepted standard and to improve health and
safety culture in the company.
 Near misses statistics can be used to identify the trends and patterns of such
incident occurring in the workplace and can be used highlight the gaps in the car
showroom.

Task 7: Health and safety culture

Question 7
From the scenario, following are some negative indicators of health and safety in the car
showroom:
1: The main focus of the showroom management is on car sales mostly and they are not
focusing on health and safety which is negative indicator of health and safety culture.
2: The sales team was provided with excessive freedom which was leading towards
negative health and safety culture.
3: The majority of the sales team takes risks in order to benefits the team as a whole and
maximize the profits and bonuses.
4: They find it funny to use a fire extinguisher to wake up the sales supervisors who is
sleeping during the break. Fire extinguishers, on the other hand are only meant to be
used in an emergency.
5: The attitude towards safety is very poor as the sales supervisors ignored the
accidental use of the fire extinguisher as a routine occurrence.
6: They put the used emptied fire extinguisher back to the position without inspecting or
refilling.
7: During the movement of vehicle lack of attention is noticeable.
8: The senior sales person has observed near misses in which the apprentice was found
using phone while driving although there was signs saying do not use mobile phone while
driving.
9: The staff was observed over speeding for the purpose of show off.
10: lack of supervision and training is observed.
11: The safety induction was too short, which was not sufficient.
12: There have been a few incidents in the past, some of which resulted in minor injuries
this is also a negative health and safety indicator.
13: there was no record maintained of any the near misses or injuries, as the only one
fire related incident has been recorded since 12 years.
14: The sales supervisor had taken the job of fire marshal, and guided visitors and
personnel to the designated assembly site in the stated emergency plan, despite his lack
of training.
15: They underestimating the risk as they felt that overall fire risk is low there is no need
for frequent fire drills.
16: The senior salesman is still under a lot of pressure to fit in with the team of people
who have a negative attitude about safety as scene from scenario so this is also a
negative health and safety indicator.
17: The staff was unconcerned about working in an unsafe manner, and it was a frequent
practise.
18: Rather than designating a committed competent and accountable individual the
health and safety obligations were given to the head of sales.
19: The head of sales, who has given responsibility for health and safety, was not given a
health and safety training to carry out his duties.
20: The managing director was aware and accept that there have been lucky escapes
from incidents that could have been more serious but they thought that in the past
nothing bad has happened so far, so why decided not to be worried about any possible
incident in the future.
21: the managing director has seen senior salesperson has courageously raised the fire
evacuation testing safety issue with him, but he didn’t give it importance as the company
meeting the sales targets.
22: The accident was happened due to lack of attention, mobile phone usage, and the
trip over of the seat belt which has not quite fully retracted.
23: The incident was seen by the sales supervisor, but they had a conversation that “it is
a matter for you, and you alone; as long as you don’t say a word to anyone else neither
will I” which shows they have very weak incident reporting system.

Task 8: Health and safety management roles and responsibilities

Question 8
As per scenario, effectiveness and responsibilities in relation to health and safety
management in the car showroom as follows:
1: the organization has not given any job description to any of worker which shows very
poor commitment towards health and safety.
2: There is very limited supervision, instructions, and training in showroom by the
organization.
3: No proper training is provided to workers and also no written record was maintained by
the store manager.
4: There was no clear process of reporting is available in the showroom; therefore they
had no idea how to submit any issue, fault or problem to their senior managers.
5: There was no acceptable accountable person for health and safety concern since,
according to the scenario, the health and safety obligations were handed to HOS (head
of sales).
6: The head of the organization always has superior authorities and functions and
obligations in terms of the showroom’s worker’s health and safety. The showroom’s MD,
on the other hand, was unconcerned about the health and safety of his employees.
7: Safe operating procedures was planned by the shift manager but not implemented so
the workers could not understand the sop of the concerned drivers in the showroom.
8: senior management and sales groups had a negative influence on peer pressure in the
business because they prioritised sales over worker health and safety.
9: no workers and upper manager were aware of the roles and responsibilities in case of
any emergency, as according to the given information in the scenario, when the fire
alarm case happened, no one was acknowledge about his roles responsibilities in that
situation.
10: There was no balance between sales and employee safety, including a bad culture in
which MD and sales supervisors first priority was to focus on a huge quantity of sales.
The organization showed a lack of attention to health and safety.
