You recall that in a Ruling of 29th September 2023, the Deputy registrar assessed costs due to the the seven Respondents (including Sedco) at
Kshs 160, 875.
She promised to furnish us with a copy of the Ruling within a week but none has been provided.
In the circumstances we are unable to give our opinion whether your should file a Reference challenging the Award or not.
In the meanwhile the Applicants against whom the costs were awarded have filed an application for stay of execution to recover the amount
pending their intended Reference challenging the Award.
Whilst we consider the Award low, they consider it too high.
Attached is their application and our grounds opposing it.
it is set for mention on 4th March 2024 to confirm filing of a Response to it (this has been done), parties' submissions and taking Directions on its
hearing.
We shall give our opinion on whether or not you should file Reference challenging the Award of costs as soon as we receive a copy of the court's
Ruling of 29th September 2023.
