After taking possession of the house the allottees have to get their
electrical service connection from TPCODL observing the
necessary formalities.

The allottees will pay monthly water rent & maintenance charges
of sewage system to CDA as per the bill raised by CDA, from the
day of possession till the systems (water supply & sewage system)

Odisha Apartments Ownership Act 1982 & Rule framed time to
time with amendments if any. The existing society is responsible
for operation and maintenance of all common utility spaces,
amenities and services.
Each member shall be bound by the rules, regulation & by law of
the society.

Construction of the project was started on May 2020 and completed. The project has been
registered in ORERA vide its Registration Number-RP/07/2022/00736 & RP/07/2022/00737.
A model flat on the ground floor is ready for visit of the prospective applicants at project
location.
Note:
1. The cost of the flats may undergo an escalation due to factors beyond control of CDA and in such
cases the escalated amount shall be added to the 2nd instalment and accordingly 2nd instalment
amount shall be revised. The allotee shall be required to pay this revised instalment within the
time specified in this brochure.
2. Other Statutory Charges, as applicable, shall have to be paid extra by the allottee before taking
possession of the asset.
3. The price is exclusive of registration charges which is to be borne by the allotee during
registration.
4. An application fee amounting Rs.1000/- (Rupees One Thousand Only) in the form of Demand
Draft in favour of “Cuttack Development Authority” payable at “Cuttack” shall be submitted
along with the Application Form.
5. Payment of initial deposit (1st instalment) of Rs. 1,72,056/- (Rupees One Lakh Seventy Two
Thousand and Fifty Six Only) shall be made on-line in favour of “Cuttack Development
Authority” payable at “Cuttack” through Bank transfer (NEFT/RTGS), from the applicant’s own
bank account only in favour of “EMD Account CDA” of HDFC Bank Ltd., Link Road Branch
bearing account No:50100528243722, IFSC Code HDFC0002571. The online deposit slip (1st
instalment) shall be submitted along with the Application Form to CDA as per the address
mentioned in Clause H (SUBMISSION OF APPLICATION), Sub-clause 4.
Payment of 2nd instalment of Rs. 15,48,505/- (Rupees Fifteen Lakh Forty Eight Thousand Five
Hundred and Five Only) shall be made by the allottee in favour of “Naranpur AHP LIG CDA” of
HDFC Bank Ltd., Link Road Branch bearing account No:50100528243761, IFSC Code
HDFC0002571 within 2 months from the date of issuance of Provisional Allotment Letter.
Note: Payment received from the account other than the applicant shall not be allowed

6. The responsibility for making timely payment on or before due date will be that of the applicant
or allottee as the case may be.
7. In case of any delay in construction and/or consequential delay in handing over of the
possession, the amount deposited by the allottee will not carry any interest and accordingly the
schedule period of handing over possession may be deferred without any cost & risk of CDA.
8. No claim for deficiency in quality of construction and amenities will be entertained after handing
over of the possession of asset.
2. A “Dwelling Unit” shall be allotted only to such beneficiary family, who do not
own a pucca house either in his/her name or in the name of any member of
his/her family in any part of India. (Submit an affidavit in this regard).
4. The applicant or his/ her family members is not the owner of any other house/
plot/ flat within CMC area as notified by Govt. of Odisha or allotted by CDA/CMC
or by any Govt./ Govt. Agency for the time being in force as on the date of
publication of this brochure.
5. Family means, husband, wife & minor children only. Required affidavit in
prescribed form in Annexure II is to be submitted by the applicant duly sworn-in
before the Executive Magistrate/ Notary Public. In case the facts stated in the
affidavit is found false, the same shall entail towards cancellation of flat or
forfeiture of entire amount in addition to other legal recourses including criminal
proceeding for filing false affidavit.
7. 5% of the total units are reserved for physically handicapped persons. This shall
be considered on production of required documents/ papers from the competent
authority. (As per Section 37 of the RoPwD Act, 2016, under Section 2 (r), “person
with benchmark disability” means a person with not less than forty present (40%)
of a specified disability where specified disability has been defined in a measurable
terms, as certified by the certifying authority).

8. The allotment is being made on the basis of the information furnished by the
applicant and declared in the affidavit.
10. Income eligibility criteria for applicants applying for LIG housing shall be from
Rs.1,80,000/- (rupees one lakh eighty thousand) to Rs.6,00,000/- (rupees Six
lakh Only) per annum. The income will be certified on basis of the IT return
certificate i.e. processed Income Tax Return (ITR) for FY 2021-2022 and FY
2022-2023 or income certificate issued by a competent official of the Revenue &
Disaster Management Dept., Govt. of Odisha. Applications not falling within the
captioned income eligibility criteria will be rejected upfront.
11. The allottee shall not to transfer/ sub-lease/ sale/ gift/ mortgage etc. or any
other manner without prior permission of CDA.
12. The allotted LIG dwelling unit (FLAT) shall not be put on rent/ sub-let/ sub-lease
in any manner. No exchange of units shall be allowed, and any such request shall
be refused without assigning any reason thereof.
13. In case of surrender/ cancellation of the dwelling unit before final allotment, the
Authority shall have the right to cancel the allotment and take possession of the
flat and the 1st instalment shall be forfeited by the Authority and the balance
amount, if any, shall be refunded without any interest on production of the
money receipt/ deposit slip in original.
14. In case of cancellation mentioned above in Clause13, the authority shall initiate
process of re-allotment of such dwelling units for allotment to the second/
subsequent eligible beneficiaries.
15. The minimum lock-in period for transfer of ownership by the beneficiary will be
10 years from the date of handover of the unit (as per the policy for housing for
all in Urban Areas, Odisha, 2015) with due approval from CDA.
16. The allottee will have to pay a subsidized cost i.e. Rs. 17,20,561/- (Rupees
Seventeen Lakh Twenty Thousand Five Hundred Sixty One Only). towards the LIG
Unit. The same shall be payable by the selected applicant before taking
possession of the LIG Unit. The said amount shall be deposited in 2 instalments
i.e. Rs. 1,72,056/- (Rupees One Lakh Seventy Two Thousand and Fifty Six Only) i.e. 1st
instalment at the time of application & balance Rs. 15,48,505/- (Rupees Fifteen
Lakh Forty Eight Thousand Five Hundred and Five Only) i.e. 2nd instalment within 2
months from the date of issuance of provisional allotment letter.
17. In case the total subsidized cost i.e. Rs. 17,20,561/- (Rupees Seventeen Lakh
Twenty Thousand Five Hundred Sixty One Only) is not paid within above

mentioned 2 months then the Authority may allow further extension of 2 months
with a delayed payment of interest @12% per annum on the balance amount due.
If the 2nd instalment is not paid in full along with interest after the extension
period of 2 months, the allotment shall be cancelled and the initial deposit of 1 st
instalment shall be forfeited and CDA shall go ahead with reallotment to other
eligible allotees.
18. The allottee will have to pay the registration charges/ stamp duty/ any other fees
and other miscellaneous dues as per the prevailing rate of Govt. of Odisha/ CDA
for execution of the lease deed.
19. The allottee will not make any structural addition/ alternation in the allotted LIG
Unit or in the common area which may cause interruption for uses of other
allottees. In such case CDA reserves the right to necessary take action as deemed
proper on such deviations and the cost of the demolition/ eviction shall be borne
by the allottee.
20. Dwelling Unit shall be occupied by allottee within 2 months (two months) of
taking over of the possession of same after clearing all the dues of Govt. of
Odisha/ CDA/CMC or any authority on demand.
21. The allottee have to execute an Lease Deed with lock-in restrictions of 10 years
with CDA, after handing over possession by CDA. The allotment may be cancelled
if the allotee failed to execute the Lease Deed within 1 month of taking over of
possession.
22. The allottee will abide by the laws of the land, including the local laws and
directions of the Statutory Authorities and terms & conditions of allotment from
time to time. In case any penalty or fine is imposed by any Govt/ Statutory
Authority for violation of any terms & conditions of allotment, it shall be the sole
responsibility of the allottee towards compliance.
24. The allottee will be liable to pay all ground rent, statutory dues like holding tax/
any other taxes etc. prorated related to your unit to the ULB/ CDA/ any other
agency.
25. Cuttack Development Authority (CDA) reserves right to alter or modify any of the
terms and conditions for the interest of the scheme.
26. All the provisions applicable for Affordable dwelling units as per the policy and
any changes/ modifications shall also be applicable.

rights towards cancellation and eviction of the allottee as well as forfeit the entire
amount deposited by the allottee.
28. All disputes shall be subject to the jurisdiction of courts situated within Cuttack
city.
H. SUBMISSION OF APPLICATION
The Brochure-cum-Application can be downloaded for CDA website:
https://cdacuttack.nic.in and submit the application through offline mode. The
procedure to be followed in each of these cases is detailed as below;
Offline Application:
1. The applicant may visit the help desk at CDA office located at Arunodaya Bhawan,
Cuttack for any clarification on the document.
2. The applicant shall pay an application fee of Rs. 1,000/- (Rupees One thousand
only) non-refundable through Demand Draft in favour of “Cuttack Development
Authority”, and payable at “Cuttack” from any scheduled commercial/
nationalized bank in India along with the Application form and other supporting
documents.
3. The Brochure cum Application Form will be available in the website of CDA from
11:00 AM of 21.11.2023 to 5:00 PM of 21.12.2023.
4. The filled-up application form can be submitted through Regd. Post/Speed post/
Courier along with the Demand Draft (application fee) & online deposit slip (1 st
instalment) superscribed “Application for LIG Unit at Naranpur AHP” on the
Envelop to the following address;

7. All the payments shall be in the form of demand draft from a scheduled
commercial/ nationalized bank in India in favour of “Cuttack Development
Authority”, and payable at “Cuttack”.

I. MODE OF ALLOTMENT
1. Allotment of houses/flats will be made on lottery basis. In case the number of
applicants under any category is more than the number of units, allotment will
be decided by way of lottery.
2. Allotment, particular House/Flat No. will also be allotted by lottery only amongst
selected the allottees.
3. While drawing the lot, care shall be taken to draw the lot for 150 % of the houses
available, so as to enable the PDA to have 50% of the applicants in the waiting
list. In case the selected applicant is unable to pay the dues within time period,
CDA shall cancel the allotment and initiate the process of re-allotment as per the
provisions amongst the waiting list.
4. In cases, where total number of applications received are less than the number
of assets available for allotment, then selection of allottees will also be through
Lottery.
6. CDA shall issue the Provisional Allotment Letter to the selected applicants after
observation of all formalities of allotment.
J. CANCELLATION
1. The relevant provision of RERA Act/ Rules and Regulations shall be followed for
refund / withdrawal and cancellation of application or allotment.
2. In case of surrender/ cancellation of the unit before the final allotment, the 1 st
instalment shall be forfeited and balance amount, if any, shall be refunded
without any interest.
3. In case of cancellation mentioned above, the authority shall initiate process of re-
allotment of such dwelling units for allotment to the second/ substitute allottee.
In such cases, only the eligible beneficiaries as per the provision of the HFA
policy, shall be allotted the cancelled dwelling unit.
K. Compensation –
The Lessor shall compensate the Allottee in case of any loss caused to him due to
defective title of the land, on which the project is being developed or has been
developed, in the manner as provided under the RERA Act and the claim for interest

and compensation under this section shall not be barred by limitation provided under
any law for the time being in force.
Except for occurrence of a Force Majeure event, if the Lessor fails to complete or is
unable to give possession of the Apartment (i) in accordance with the terms of this
Agreement, duly completed by the date specified herein; or (ii) due to discontinuance
of his business as a developer on account of suspension or revocation of the
registration under the Act; or for any other reason; the Lessor shall be liable, on
demand to the allottees, in case the Allottee wishes to withdraw from the Project,
without prejudice to any other remedy available, to return the total amount received
by him in respect of the Apartment, with interest at the rate specified in the ORERA
Rules within 45 days including compensation in the manner as provided under the
RERA Act.
2. The repayment of the Housing Loan shall be the responsibility of the allottee and
the Bank.
3. CDA shall not be responsible/ liable for any such repayment of the housing loan
or any default in payment of Loan.
4. The NOC shall be exclusively for the purpose of Housing Loan and not the
use/utilise the said NOC for any other loan either from the said Bank or from any
other Bank/ Financial Institutions
5. In case the allotee defaulted in payment of loan, the Bank may proceed to auction
the property under the Securitization and Reconstruction of Financial Assets and
Enforcement of Security Interest Act. 2002 (SARFAESI ACT 2002) with prior
permission from CDA.
6. Under such circumstances, the Bank shall bear all expenses towards registration
of the Lease Deed after the auction purchaser being considered as the Lessee.
7. After final allotment, the allotee may request NOC from CDA to mortgage the
assets in order to avail educational/ medical loan from any scheduled
commercial/ nationalized bank or any other Financial Institutions within India.
In case of default in payment of loan, the Clause 5 (SARFAESI ACT 2002) & Clause
6, mentioned above shall come into force.
8. The auction purchaser should satisfy all the terms and conditions of the
allotment of LIG as specified in the brochure.

M. DELIVERY OF POSSESSIONS
9. CDA will make its best efforts to deliver the possession of the asset to the allottee
subject to “Force Majeure” provision and other circumstances beyond the control
of CDA.
10. On payment of all final dues by the allottees, they will be intimated to register in
the registered agency.
11. The applicants will be informed in writing the date by which CDA would be
handing over possession of the asset. The allottee shall personally take delivery
of the assets within 30 (thirty) days from the date of issue of intimation.
12. In case the allottee fails to take possession of the asset within 30 (thirty) days
from the date of issue of intimation to take possession, the Authority shall have the
right to cancel the allotment of the flat and 30% of the 1 st instalment shall be deducted
due to loss sustained by the Authority and the balance amount shall be refunded without
any interest on production of the money receipt/ deposit slip in original.
2. The registration of the lease deed will be done in the concerned Sub-Registrar’s
office and the duplicate copy will be submitted to CDA within 7 days from the
date of delivery of the document.
3. All charges and expenses relating to registration of lease deed & execution of
lease agreement shall be borne by the allottee.
O. TRANSFER OF OWNERSHIP
Transfer of ownership shall only be permitted after expiry of 10(Ten) years
from the date of taking over possession of the asset.
By no way the allotee can transfer or sell the property after 10 years. The allotee
shall have inheritable rights after execution of final lease deed post 10 years of
completion of lock-in lease period. In case the allotee transfer or sale the
property he/she shall be debarred from any allotment under any other scheme
floated by CDA/ CMC or by any Govt./ Govt. Agency in future.

prevailing “Policy for Housing for All in Urban Areas, Odisha, 2015” and CDA shall
charge a processing fee of 2% of prevailing Sale Price as per above captioned
policy to the new eligible allottee. But in case of inheritance/ succession the
processing fee shall be limited to Rs. 10,000 only.
P. CONDITIONS OF ALLOTMENT
1. The allotment shall be on lease basis for a lock-in period of 10 years “Lock-in
Lease Period”. After completion of the lock-in lease period, the allotee shall have
to execute a lease deed as per prevailing regulations of CDA.
2. The Authority reserves the right to reject any application without assigning any
reason thereof.
3. CDA also reserves the right to alter or modify the lay-out plan, the size and shape
of the assets due to exigencies arising out of site condition and other
contingencies or due to force majeure.
4. All information on dimension and area are approximate. The allotment of the
asset is subject to alteration necessitated during the construction of the
residential complex. CDA, in pursuance thereof, reserves the right to effect
suitable and necessary alteration in the lay-out plan.
5. All the assets shall be allotted in a transparent manner from amongst all the
eligible applicants, who have applied as per conditions of this brochure.
6. The allottee shall not use the asset for such activities, which are likely to cause
nuisance, annoyance or disturbance to other occupants and refrain from those
activities which are against law or any directive of the Authority.
7. The allottee shall use the asset for residential purpose only and shall not store
any goods of hazardous or combustible nature or which can cause damage to the
structure and or assets of other occupants or the equipment’s in the allotted flat
premises or use the asset for criminal or illegal activities or activities prohibited
under law of the land.
10. The allottee shall carry out the maintenance of his asset at own cost. The
insurance of all the residential blocks in the scheme as well as the interiors of
these residential blocks in the scheme shall be the responsibility of the allottee.

CDA shall not in any case be held liable for any damage or loss incurred on
account of any rejection or omission of the allottee or any act of the third party.
11. CDA will provide power supply up-to the panel board of individual block. The
allottee shall be responsible for obtaining individual electricity connection from
the meter panel board of individual block from concerned Agency at his/her own
cost. The allottee shall also pay holding tax/ground rent and any other taxes as
applicable to the concerned agencies and authorities.
12. The allottee shall abide by the Act(s), Rule(s), & Regulation(s) of the land,
including the local laws and directions of the statutory Authorities as well as
terms and conditions of allotment. In case any penalty or fine is imposed by any
govt./statutory or other local authority for violation of any law by the allottee,
the same shall be paid and complied by the allottee.
13. The allottee shall not sub-divide or demolish any structure of the residential
block of the scheme or any portion thereof or cause to make any new
construction in the residential block of the scheme. The allottee however should
undertake that he/she shall not divide/sub-divide the apartment in any manner.
The allottee shall not change the colour and façade of outer walls to his/her flat.
14. No transfer of the allotted asset will be allowed in case of existence of any form
of encroachment, addition and alteration of existing structure.
15. In case of death of the applicant and/or the allottee, the legalheirs shall act as
successors and accordingly all actions taken, consent given, approval made, shall
bind the successors of the applicant/ allottee in all respects. In this regard the
successors must produce legalheirs certificate received by the competent
authority of R&DM Dept. Govt. of Odisha or any competent Court to claim
allotment on succession basis.
Note: Cuttack Development Authority (CDA) reserves right to alter or modify any of the terms and conditions
for the interest of the scheme.
5. In case of failure on part of the allottee or the RWA to make such payment, the
Authority shall have the power to recover the dues as arrears of land revenue
under Odisha Public Demand Recovery Act, 1962.
6. The RWA shall perform its functions, responsibilities and shall adhere to the
provisions of Cuttack Development Authority Regulations and applicable Acts/
Rules/ Regulations in delivering its services and duties.
7. The functioning of the RWA shall be sole responsibility of its constituent members
and the allottees. CDA shall not be liable in any manner for breach of any law or
rules or regulations and for any kind of misconduct by the RWA.
R. FORCE MAJEURE
If the construction/ allotment of flats/ blocks in the CDA Affordable Housing Project is
delayed for reasons beyond control of CDA such as civil commotion or war or criminal
action or earth quake or any act of GOD, delay in obtaining decision/ clearance from
any statutory body, or due to any notice, order, rule or notification of the Govt., or any
other public or competent Authority, or any other reason beyond the control of CDA
and in any other aforesaid events, CDA shall be entitled to a reasonable extension of
time stipulated for delivery of possession of the asset. CDA also reserves the right to
alter any terms or condition of allotment in the event of any such contingency, as
aforesaid and if the circumstances are beyond the control of the Authority, it may defer
or suspend the scheme for such period as it may consider expedient and the allottee in
such an event shall not claim any compensation or damage of any nature whatsoever
for such delay or suspension.
If for any reason whatsoever, CDA is not in a position to handover/ allot the asset to
the allottees, CDA shall refund the deposited amount, except the cost of Brochure cum
Application form, in full without any interest.

T. JURISDICTION OF COURTS
All disputes arising out of the above shall be subject to the jurisdiction of Civil Courts
at Cuttack City Only.
U. INTERPRETATION
1. All matters relating to the allotment of apartments through lottery shall be dealt as
per the provisions of the RERA Act/ Rules/ Regulations along with along with other
applicable Act/ Rules/ Regulations.
2. Applicants are requested to go through same for understanding the provisions of law
applicable to allotment of such assets. In case of conflict between the provisions of
this Brochure cum Application form and the regulation; provision of regulations will
prevail.
3. In case of any dispute or doubt with regard to interpretation of any clause or terms
of this brochure, the decision of the CDA shall be final and binding on the applicants/
allotees.

on the date of publication of this brochure, either on leasehold or freehold basis or allotted to

4. I do not own any Pucca House either in my name or in the name of any member of my family in
any part of India.
5. I/ my family have not sold/ transferred any asset allotted by the General Administration (GA)
Dept./ R&DM Dept./ CDA/ CMC or any Other Government Agency/any Co-operative Housing
Society. By this affidavit, I indemnify CDA to compensate any future loss of whatsoever nature.
6. This affidavit is required to be submitted before Cuttack Development Authority for allotment
of LIG Unit at Affordable Housing Project at Naranpur, Cuttack.
7. That I have not supressed any material fact and in case any material fact found false in future in
connection with the affidavit and/or in support of the connections made in the affidavit, I shall
be held responsible before the Court of Law including Criminal liability.
8. I, further undertake that if any information given above are found incorrect, the allotment/ lease
of plot/ Flat/ Core House granted in my favour on the basis of incorrect information furnished
by me, the allotment and the lease, if any, shall be cancelled/ terminated by Cuttack
Development Authority at my cost and risk and Authority is free to initiate legal proceeding and
/or complaint as permissible under law.
