CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT TO SELL, made and executed this _____________________________, 2022 BY


and BETWEEN:
JUANITO E. ADORA JR., of legal age, Filipino citizen, and with residence and postal address at Blk
11 Lot 29 Fairfield Margana Subdivision Barangay Tagapo Sta Rosa City Laguna, hereinafter referred to
as the ‘VENDOR”
-AND-
GLENN S. ESCASA married to MELANY P. ESCASA, both legal age and Filipino Citizen, with
residence and postal address at Block 5 Lot 36 Spinal Street Phase 5 Garden Villas 3 Brgy. Malusak
Sta Rosa Laguna, hereinafter referred to as the “VENDEES”

WITNESSETH:

WHEREAS, the VENDOR is the absolute and registered owner of a parcel of land with Improvement
consisting of SEVENTY SQUARE METERS 70 square meters more or less, located at Block 5 Lot 15
Calachuchi St., Progressive Village Brgy. Tagapo Sta Rosa Laguna, and covered by Transfer Certificate
of Title (T-651071) issued by the Registered of Deeds of Calamba City.

WHEREAS, the VENDEE, has offered to buy and the VENDOR has agreed to sell the above-mentioned
property under the terms and conditions herein below set forth;

NOW THEREFORE, for and in consideration of the total sum of FIVE MILLION PESOS Php
5,000,000.00 Philippine Currency and of the covenants herein after set forth, the VENDOR agrees to
sell and the VENDEE agrees to buy the aforesaid property subject to the following terms and conditions:

1. The total consideration shall be FIVE MILLION PESOS {Php 5,000,000.00) Philippine
Currency, payable as follows;

a. Down payment of One Million Pesos (Php 1,000,000.00)


b. The Balance of Four Million Pesos (Php 4,000,000.00) will be paid thru PAG IBIG Housing
Loan
2. The Down Payment is 100% REFUNDABLE in any case the Loan did not approved by PAG
IBIG Housing loan.
3. In case the approved amount from Pag Ibig Housing Loan is lower than the amount applied, the
difference should be paid in cash by the VENDEE;
4. Real Estate Tax, Documentary Stamp Tax, Registration Fees, Registration Expenses, and all
other miscellaneous fees shall be shouldered by the VENDEE;
5. Capital Gains Tax will be shouldered by the VENDEE;
6. Possession to the subject property shall be delivered by the VENDOR to the VENDEE upon Full
Payment of the total consideration;
7. Upon release of the Letter of Guarantee (LOA), the VENDOR shall sign and execute a DEED OF
ABSOLUTE SALE in favor of the VENDEE. The VENDOR shall likewise sign and execute and
or deliver any and all documents, including but not limited to the original copy of Transfer
Certificate of Title, Tax Declaration and all other documents necessary for the transfer of
ownership from the VENDOR to the VENDEE

I, Juanito E. Adora Jr. and Bernadette B. Mariñas received an amount of
One Million Pesos (1,000,000.00) from spouses, Glenn S. Escasa and
Melany P. Escasa, as earnest money or down payment for the
house to be constructed at B5L15 Calachuchi Street, Progressive Village Tagapo, Santa Rosa
City. A two-storey house consisting of 70sq. meter lot with a 120 sq.
meter floor area. Consisting of four rooms, three bathrooms, one car garage,
semi-furnished house with built in cabinets, fence with gate, and a fully tiled
floor and paint. The total contract price of the house that is to be constructed is Five Million Pesos only
(5,000,000.00). The remaining balance will be paid through Pag Ibig Housing Loan, both
parties agreed to refund the down payment if the housing loan is not approved.
But in any chance that the loan is approved and the buyers change their mind
and decide to back out from the transaction, the said down payment will be forfeited.
The CGT (Capital Gains Tax), transfer, and documentary stamp will be shouldered by the buyer.
The said project will start by November 2022, and will be finished in five to six months.
