Rejection Reasons:
1. All information received during tender stage have been
incorporated in tender drawings.
2. Formal information regarding the existing ITS installations duct
lines etc. were provided with tender drawings anticipating such
proposal/diversion with final Design NOC/Construction NOC
DE 01-80 Engineer's rejection to Claim 24-May-17 25-May-17 and cost implication incorporated under provisional sums.
3. Advised to prepare shop drawings based on the Final Design
NOC and to submit appropriate cost estimate.
4. Engineer's Instruction will be issued after consultation with
Employer.
5. Consultant are in the process of obtaining approval from the
Employer to perform the above work under provisional sums.

Company Reply:
1. ITS Network was not reflected in either Tender / Contract
Drawings.
2. In Consultant Letter 2017 dated 25th Apr 17, Engineer instructed
to take up this additional work.
DE 01-90 Company Replied to Engineer's rejection letter 26-May-17 30-May-17
3. 11 km of duct & 60 Nos of chambers. The resources required is
additional to originally planned resources and not extension of
existing resources.
4. This work constitutes a variation order and therefore cannot be
incorporated in Clause 8.3 Programme.

2. Based on the quantities, Cl 8.3 Programme is impacted and
impact is 14 days as on 14 Oct 17 and the impacted completion
date of the project is 5 Mar 19.

Engineer's comments:
1.ITS scope had been available to Company in Mid of May 2017
and Company failed to obtain the construction NOC on time.
2. As per Sub Clause 13.3 contractor should not delay any
additional work whilst awating engineer response.
DE 01-200 Engineer's rejection to Claim 15-Oct-17 20-Feb-18 3. Contractor's non-compliance to the requirements stipulated
under sub-clause 8.4 of the conditions of contract and PS 1/31 of
the Particular Specifications.
3. Company have to follow the commitment made during meeting
with Client on 26 Dec 2017 wherein the contractor agreed to
waived back all outstanding claims related to EOT.

DE 01-210 Company replied to Engineer's rejection letter
Company Comments:
1. We have not made any delay in awaiting responsed from the
Engineer.
2. As per Clause 8.4, Company has shown the delay in the Critical
Path of the Clause 8.3 Programme.
21-Feb-18 27-Feb-18 3.We have submitted all the notices, interim particulars and
detailed particulars on time ((within 28 days) but we have not
received the same from Aurecon.
4. In the meeting with Client Company promise to complete the all
major work on time, Except Underpass which will complete within
11 month after traffic diversion.
