Subject: - Notice of Erection Work Without Approval and Justification of Work with Proper Impact
Analysis for Loss Reduction under the RDSS Scheme beyond the scope of work or approved
drawing/SLD by TKC-NCC Ltd. (Cluster-5) in Zone- Devipatan, EDC-Balrampur, EDD-Balrampur, ESD-II,
Substation-Steam power House, Feeder-11KV Sonpur, Location-Ramnagar.

Sir,

For your reference, RDSS loss-reduction works in Devipatan Zone (Cluster-5), District-Balrampur
have been awarded to M/s NCC Limited, Hyderabad, and the agreement for the same was done on 21.01.23.

This is with reference to the above mentioned subject; it is worth mentioning here that we would like
to bring to your attention that during the site inspection, it has been found that erection activity was carried
out without written consent in the form of work requirement or justification for work and without keeping us
in our knowledge as well as approval of the Nodal Officer Concerned, leading to non-approval of SLD or
BOQ for the same location, which is a serious violation of the terms and conditions of the agreement and
guidelines envisaged to attain the target of loss reduction with material supplied under the RDSS Scheme.

On the basis of our random inspection, It has been found that 15 8.5-meter PCC poles erected for LT
re-conductoring work with material supplied for the RDDS scheme were erected without the approval or
consent of the PMA and concerned nodal officer, which is a serious breach of guidelines and norms by
TKC-M/s NCC Ltd in Zone-Devipatan (Cluster-5), EDC-Balrampur, EDD-Balrampur, ESD-II, Substaion-
33/11KV Steam Power House, Feeder Name- 11KV Sonpur, Location- Ram Nagar (Existing LT Line, 63KVA DTR)

(For the aforementioned matter, there is an attachment enclosed).

As per LOI Section-9 Other Terms & Conditions, Sub-Section-Sub-Section-XXII “In case the
material supplied or work executed by the Contractor is not found accordance with the contract, the
cost of rectification or replacement shall be deducted from the invoice amount. If the damage is
significant then no payment shall be made for that part of material/Erection work.”

In view of the above context, prima facie, it cannot be denied that the unethical work or practices are
being carried out without the consent of the competent authority concerned through proper channel, and
work permission in the form of justification of work and impact analysis may result in significant losses for
the department.

Therefore, in the aforementioned situation, the competent authority may issue appropriate instructions to
TKC-M/s NCC Ltd. and it should be made clear that this is a very severe matter, and M/s NCC Ltd. may be
asked to submit an explanation report.

For the same reasons as above, necessary action may be taken as per norms, keeping in view the prime
objectives of loss reduction; all works shall be executed to be accomplished in accordance with the tender
specification, guidelines, and standard terms and conditions of REC guidelines.
