BARANGAY ORDINANCE No. 02

Series of 2022

AN ORDINANCE PROHIBITING PERSONS FROM OPEN DEFECATION

WHEREAS; human feces disposed improperly is a detriment to public health of the National
Government,

WHEREAS; Barangay Bahit supports the ideals of the Clean and Green Program of the
National Government

WHEREAS; The Local Government Code of 1991 (RA 7160). Particularly par. 5 sub-par/. XIII,
section 447 Art. Three Chapter 3 Title Two Book III thereof, empowers the Sangguniang
Barangay to imposed Ordinances and pass resolutions to prohibit persons from open
defecation.
Be enacted by the Sangguniang Barangay of Bahit, Panay Capiz in session assembled.

Art. I Title- This ordinance shall be known as the “Anti-Open Defecation” of 2022

Art. II – Statement of the study- it should be unlawful for any person to commit open
Defecation in the entire Barangay of Bahit, Panay Capiz.

Art. III – Definition of Terms

A. Defecation – refers to all withdrawal of all human waste from the intestines.
B. Public places – refers to public plaza, basketball courts, river banks, barangay roads and
such other places to be defines as public by subsequent.
C. Community service – refers to any activity beneficial to the community that will
alleviate or mitigate the impact of the offense committed.

Art. IV- Penalty- Section I. Any person caught violating this ordinance shall be fined as
follows:

A. First offense - P100,00

B. Second offense -P200,00
C. Third offense - P300,00

Section 2- Any person caught violating this ordinance for the fourth ( 4th) time or oftener
shall suffer a fine of Five Hundred Pesos ( P 500,00) plus Half day community service.

Section 3- any persons who reports and identifies a violator of this ordinance shall be
entitled to be utilized for the cleanliness and sanitation of this Barangay.

Art. V- Revenue Utilization – All revenues generated by this ordinance shall accrue to a
true fund to be utilized for the cleanliness and sanitation of this Barangay.

Art. VI- Repealing clause- Resolutions or ordinance shall or Provisions thereof,

inconsistent with this ordinance are deemed repealed.

Art. VII- Effectivity – this ordinance shall take effect upon its approval.
