CONTRACT TO SELL KNOW ALL MEN BY THESE PRESENTS This CONTRACT TO SELL made and entered into this ________ day of __________ 20___ at Quezon City, Metro Manila, Philippines by and between:

Mrs. Leticia Magno Magsino, of legal age, married to Alfonso Magsino with postal and resident of San Jose, Baliwag, Bulacan, Filipino Citizen, lawful owner of a parcel of land, married, with SPA to Ms. Ma. Lourdes Cabatlao, legal age, Filipino Citizen and resident and postal address at #43 Samonte St. Brngy. Holy Spirit Diliman Quezon City, covered to sell, transfer , convey sign and execute in all documents relative to aforementioned parcel of land described under TCT No. RT-56465 (134136) Lot 3 BLK-2 herein after knows as the SELLER/VENDOR; -ANDMAGSINO HOME OWNERS ASSOCIATION (MHOA) and all officers and members of an Association, Beneficiaries Contracted Buyers from Ms. Leticia M. Magsino : paying 1. We agreed to pay Php. 35.00 per day each (Total members of 30 benificiaries of MHOA to pay Php. 1050 per day). Within 15 days to be deposited the amount with the total 30 beneficiaries.(Php. 15, 750 per 15 days). Every 16th of the moths to be deposited to the account of Ms. Ma. Lourdes Cabatlao, SPA of the land owner in behalf of the account of land owner Mrs. Leticia Magno Magsino to be handled and managed by the President of MHOA under of Ms. REGINA CREDO. 2. The payment scheduled starts on the month of _________________ 2012 up to complete 5 years or not exceeding 60 months terms including holidays and Saturdays and Sundays, no exception for holidays in payment terms. And under the President Ms. Regina Credo, Filipino Citizen, Married, of legal age, representative of MHOA above all with postal address at Lot 3 Block 2 Daisy St. Maligaya Park Subd. Nova Quezon City., Property Location of Mrs. Leticia Magno Magsino hereafter to be the PURCHASER. -WITNESSETHWe are the OFFICERS AND MEMBERS OF ASSOCIATION F MAGSINO HOME OWNERS ASSOCIATION (MHOA) under President MS. REGINA CREDO, President of MHOA. We occupied the whole lot containing 643 sq. m., more or less, without a consent of land owners. We negotiate the property and we are here to express our desire to buy the whole lot containing 643 sq. m. more or less payable in 60 months or 5 years term, paying Php. 35.00 per day each beneficiaries, including holiday an Saturdays and Sundays, starts on month of __________ 2012, up to the 5th year or not exceeding 60 months term, to be paid and deposited to the account of Ms. Ma. Lourdes Cabatlao, SPA of the land owner, in behalf of Ms. Leticia Magno Magsino through China Bank under the Account Number _____________ described under TCT. No. RT-56465 (134136) at Lot 3 Blk. 2 Daisy St. Maligaya Park Subd. Nova, Quezon City. WHEREAS, the VENDEE agreed to buy and the VENDOR agreed to sell the above described property through Direct Buying; NOW THEREFORE, here in the parties agreed that the following condition has follows; 3. Default of BUYER/VENDEE due to non-payment of monthly amortization and the disqualification of BUYER/VENDEE shall execute a waiver of his right to the allocated property. The waiver or notification to the default BUYER/VENDEE shall be responsibility of the president of MHOA, under Ms. REGINA CREDO, and surrender the property to the VENDORE/SELLER or under SPA of the land owner, Ms. Ma. Lourdes Cabatlao, and all payments by the BUYER/VENDEE to the SELLER should be deemed, forfeited and become liquidated damages as rental and cancellation of contract by the SELLER/VENER and enforce the foreclosure without legal action like eviction/ejection. 4. Withdrawal of the BUYER/VENDEE for any reason and transfer by us without written consent to the president Ms. REGINA CREDO, president of MHOA. The SELLER or SPA of the land owner shall constitute considered as NULL and Void and as a valid ground to cancellation of contract to sale. 5. Transfer of Title (Legal and Notarization, expenses, relative to the execution of the Deed of Sale) Tax Declaration from the SELLER to the BUYER/VENDEE and subdivision of titles and other necessary expenditures for transfer of title shall be paid or shouldered by the BUYER/VENDEE. 6. Survey and subdivision plan of the property showing allocation of lot of the BUYER/VENDEE and including all expenses shall be the responsibility to be paid or shouldered by the BUYER/VENDEE . 7. All taxes and other fees. The BUYER/VENDEE shall be responsible to pay all taxes and other fees of taxes in relation to the transfer of title, and whatever changes agreed on the mention parcel of land to the portion of their lot allocation. 8. Real Estate Tax on the property allotted to the BUYER/ VENDEE covered the year beginning on the date of signing of the contract and shall be the responsibility to be paid or shouldered by the BUYER/VENDEE. 9. All documents for transfer of title shall be delivered to the BUYER/VENDEE in favor of the BUYER/VENEE after payment in completion of 60 months to the SELLER. 10. All processing documents shall be the obligation of the BUYER/VENDEE in connection of the, sale in the subject parcel of land under TCT No. R.T. 56465 (134136).
