I, CRISTITA C. ENRIQUEZ, Filipino, of legal age, married and with residence and postal address at 8 Pingpong Street, Saint Francis Village, Cainta, Rizal , after being duly sworn to in accordance with law, hereby depose and state:
That I am the new owner of a property covered by Transfer Certificate
of Title (TCT) No. 076-2012000410 of Registry of Deeds for the Tagaytay City of the Province of Cavite which I bought from DELFINA FE T. TACDERAS;
That I bought a parcel of property consisting of ONE THOUSAND
THREE HUNDRED FORTY SIX ( 1,346) SQUARE METERS last October 21, 2019 but it was only last March 22, 2021 that the Deed of Absolute Sale was notarized before ATTY. ELISEO S. CALMA JR. and docketed as Doc. No. 213, Page No. 41, Book No. VIII, Series of 2021;
That I was about to process the documentary requirements for the
transfer of the Transfer Certificate of Title to our name that’s why, it was only recently that I notarized the document;
That I am also about to construct a small house in the subject property
and I was surprised to find out that the property bought was being included in the sale of the entire property owned by the SELLER;
That, I am executing this Affidavit of Adverse Claim to protect my
rights as a buyer in good faith of a parcel of property of which I have exercise acts of ownership and possession from the time I bought the same; and
That as a consequence of the foregoing, I am executing this Affidavit
to of Adverse Claim for annotation purposes on the TCT No. 076- 2012000410 and for whatever purpose this may best serve. IN WITNESS WHEREOF, I have hereunto set my hand this ___________ at Tagaytay City, Cavite, Philippines.
