AFFIDAVIT OF LOSS

The undersigned, CASIANO VALDEZ ARCIA, of legal age, single, and a

resident of Barangay Danzo, Gerona, Tarlac after having been sworn in
accordance with law aver that:

1. The undersigned is one of the children-heirs of the late Hipolito

Arciaga, who is the registered owner of a parcel of land located in
Pinasling, Gerona, Tarlac, which is more particularly described as
follows, to wit:

2. Before Hipolito Arciaga’s death on 01 May 2005, he entrusted to

the undersigned a long brown expanding envelope containing
important documents which included the original Owner’s Copy
of TCT No. 39900.

3. The late Hipolito Arciaga then made a specific instruction to the

undersigned to safekeep the original Owner’s Copy of TCT No.
39900 and, upon his death, to facilitate the extrajudicial
settlement of his estate including the subject parcel of land, and
the registration and titling of the subject parcel of land in the
children-heirs’ names.

4. The undersigned then kept the long brown expanding envelope

containing the original Owner’s Copy of TCT No. 39900, among
others, at the family’s ancestral house situated in Barangay
Danzo, Gerona, Tarlac.
 5. Recently, or several years after the demise of Hipolito Arciaga,
and upon the consent of his co-heirs, the undersigned started the
interconnected processes of extrajudicial settlement of estate,
registration and titling in accord with the wishes of the late
Hipolito Arciaga when he discovered that the long expanding
envelope and its contents (the original Owner’s Copy of TCT No.
39900 included) he had safekept was already missing.

6. Subsequently, the undersigned made earnest and rigorous efforts

to locate and retrieve the original Owner’s Copy of TCT No. 39900
by literally scouring the entire ancestral house and by asking his
co-heirs and house maids/caretakers if they had happened to
come across and/or into possession thereof, but to no avail.

7. Since the undersigned could not find the original Owner’s Copy of
TCT No. 39900 despite diligent efforts, he is of the honest belief
that it is now lost beyond recovery.

8. The undersigned is executing this affidavit to attest to the truth of

the foregoing circumstances and for all legal intents and purposes
it may well serve.
