MEMORANDUM OF AGREEMENT

This Memorandum of Agreement is made and entered

into this ____ day of ______________, 2021 by and between:

The PROVINCIAL GOVERNMENT OF DAVAO DEL SUR,

a local government unit organized and existing by virtue of its
Charter under Republic Act No. 4867, with seat of government
at the Davao del Sur Provincial Capitol, Digos City, Davao del
Sur, represented by its Governor, DOUGLAS RA. CAGAS, JD,
MBE, MNSA, duly authorized by virtue of Sangguniang
Panlalawigan Resolution No. ______, hereinafter referred to as
the FIRST PARTY;

The MUNICIPAL GOVERNMENT OF MATANAO, DAVAO

DEL SUR, a local government unit organized and existing by
virtue of its Charter under Republic Act No. 1902, represented
by its Mayor, VINCENT F. FERNANDEZ, duly authorized by
virtue of Sangguniang Bayan Resolution No. ______,
hereinafter referred to as the SECOND PARTY.

W I T N E S S E T H:

WHEREAS, The PARTIES in furtherance of their lawful

directive as Local Government Units (LGUs) to be self-reliant
and in their exercise of powers and discharge of other
functions and responsibilities necessary, appropriate, or
incidental to efficient and effective provision of the basic
services and facilities, undertake this endeavor;
WHEREAS, the basic services and facilities mandated to
the LGUs by the Local Government Code include the provision
and maintenance of local roads.
NOW THEREFORE, the parties hereby agree to be subject
to the following terms and conditions:
A. The FIRST PARTY (Provincial Government of Davao del
Sur) shall:
 1. Be responsible for the maintenance of the completed
local road project, through its Provincial Engineering
Office, including routine and periodic repair and
rehabilitation;
2. Accept and receive the donated land, with gratefulness
for the generosity and liberality of the SECOND
PARTY.

B. The SECOND PARTY (Municipal Government of Matanao,

Davao del Sur) shall:

1. Undertake the acquisition of land and improvements

affected by the road construction / reconstruction project,
through donation, negotiated sale, expropriation, or other
means allowed by law, in behalf of the FIRST PARTY;
a. The land to be acquired shall comprise of five (5)
meters in width along the length of the local road
project;
b. The acquisition shall be for the road right of way.
2. Donate the acquired land to the Provincial Government of
Davao del Sur, to form part of the provincial road from
Junction New Visayas to Poblacion, Matanao, Davao del
Sur;
